SUMMARY

From 2020, not prioritize to register prepaid mobile subscriber in commune post office

This new content is prescribed in the Circular No. 11/2019/TT-BTTTT dated October 22, 2019 of the Ministry of Information and Communications on amending, supplementing, repealing a number of Article of the Circular No. 17/2013/TT-BTTTT dated August 02, 2013 on the operation of commune postal and cultural point.

Accordingly, staff in commune postal and cultural point shall work under labor contract, be entitled to remuneration and other policies in agreement between he/she and the enterprise that manages system of commune postal and cultural points in accordance with relevant law.

In addition to basic mail service with address, weight per each mail up to 02kg and public press distribution service in compliance with the Prime Minister’s Decision, commune postal and cultural point shall provide service of receiving dossiers, getting results of the settlement of administrative procedures via public postal service and other postal services.

This Circular also repeals Point b Clause 2 Article 3 which regulates: Commune postal and cultural point is the prior places to register information of prepaid mobile subscribers in accordance with provisions on prepaid mobile subscribers.

This Circular takes effect on January 01, 2020.

CIRCULAR

On amending, supplementing, repealing a number of Article of the Circular No. 17/2013/TT-BTTTT dated August 02, 2013 of the Minister of Information and Communications regulating on operations of commune postal and cultural points

Pursuant to the Post Law dated June 17, 2010;

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Government’s Decree No. 17/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

Pursuant to the Decision No. 41/2011/QD-TTg dated August 03, 2011 of the Prime Minister on appointing enterprises to maintain, manage public post network, supply services of public interest post and international post ;

At the proposal of the Director of the Department of Post;

The Minister of Information and Communications hereby promulgate the Circular on amending, supplementing, repealing a number of Article of the Circular No. 17/2013/TT-BTTTT dated August 02, 2013 of the Minister of Information and Communications regulating on operations of commune postal and cultural points.

 

Article 1. To amend, supplement, repeal a number of Article of the Circular No. 17/2013/TT-BTTTT dated August 02, 2013 of the Minister of Information and Communications regulating on operations of commune postal and cultural points

1. To amend, supplement Clause 2 Article 4 as follows:

“2. Staff in commune postal and cultural point shall work under labor contract, be entitled to remuneration and other policies in agreement between he/she and the enterprise that manages system of commune postal and cultural points in accordance with relevant law.

2. To amend, supplement Clause 1 Article 5 as follows:

“1. Commune postal and cultural points shall provide the following postal services:

a) Basic mail service with address, weight per each mail up to 02kg and public press distribution service in compliance with the Prime Minister’s Decision;

b) Receiving dossiers, getting results of the settlement of administrative procedures via public postal service;

c) Other postal services as State’s requirements.”

3. To amend, supplement Clause 3 Article 5 as follows:

“3. The providing postal services specified in Clause 1 of this Article shall in compliance with corresponding national standard of each service and relevant provisions.

4. To amend Clause 1 Article 9 as follows:

“1. The transferring of books among commune postal and cultural point and other relevant parties shall be carried out at least semi-annual.”

5. To amend Point a Clause 1 Article 13 as follows:

“a) To preside to examine, supervise the commune postal and cultural point’s operation.”

6. To amend, supplement Clause 2 Article 14 as follows:

“2. To organize, manage, maintain and develop commune postal and cultural point system all over the country.”

7. To repeal sentence in Clause 9 Article 14 as follows: “Registration point of prepaid mobile subscribers’ information”

8. To add Clause 10 into Article 14 as follow:

“10. Annually report the Ministry of Information and Communications and direct its branches to report provincial/municipal Information and Communications Department about the operation, number of commune postal and cultural points that are established, shut-down or suspend operation.”

9. To repeal some Points and Clauses as follows:

a) To repeal Point b Clause 2 and Clause 3 Article 3;

b) To repeal Point b Clause 2 Article 13;

c) To repeal Clause 1 Article 14;

c) To repeal Clause 3 Article 15;

Article 2. Implementation provisions

1. This Circular takes effect on January 01, 2020.

2. The Director of the Department of Post, heads of relevant units of the Ministry of Information and Communications, Director of provincial/municipal Ministry of Information and Communications Department, Vietnam Post and relevant units are responsible to implement this Circular.

3. Any problems or difficulties arising in the course of implementation should be reported to the Ministry of Information and Communications for consideration and settlement./.
