CIRCULAR
Providing the List of applicable compulsory standards on digital signature and digital signature certification service
Pursuant to the Law on E-Transactions dated November 29, 2005;
Pursuant to the Government's Decree No. 26/2007/ND-CP dated February 15, 2007 detailing the implementation of the E-transaction Law on the digital signature and digital signature certification service, the Decree No. 106/2011/ND-CP dated November 23, 2011 and the Decree No. 170/2013/ND-CP dated November 13, 2013;
Pursuant to the Government's Decree No. 132/2013/ND-CP dated October 16, 2013 defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
At the proposal of the Director of the Department of Science and Technology,
The Minister of Information and Communications hereby promulgates the Circular providing the List of applicable compulsory standards on digital signature and digital signature certification service.
Article 1. Scope of adjustment
This Circular provides the List of applicable compulsory standards on digital signature and digital signature certification service (attached Appendix).
Article 2. Subjects of application
This Circular applies to:
1. The National digital signature certification authority;
2. Public digital signature certification authorities;
3. The specialized digital signature certification organization which is granted a certificate of eligibility to provide digital signature safety service by the Ministry of Information and Communications;
4. The foreign digital signature certification organization which is granted a certificate of recognition by the Ministry of Information and Communications.
Article 3. Organization of implementation
1. The Ministry of Information and Communications shall consider, amend and supplement the List of applicable compulsory standards on digital signature and digital signature certification service prescribed in Article 1 of this Circular in accordance with the situation of technology development and the State's management policies.
2. The Department of Science and Technology shall take charge of periodically reviewing, updating the List of applicable compulsory standards on digital signature and digital signature certification service prescribed in Article 1 of this Circular.
3. National Electronic Authentication Centre shall take charge of guiding the application of standards of the List of applicable compulsory standards on digital signature and digital signature certification service prescribed in Article 1 of this Circular.
Article 4. Implementation provisions
1. This Circular takes effect on September 15, 2015.
2. The Decision No. 59/2008/QD-BTTTT dated December 31, 2008 of the Minister of Information and Communications on promulgating the List of applicable compulsory standards on digital signature and digital signature certification service shall be null and void from the effective date of this Circular. The provision on “Secure Hash Standard” in Section 2.3 of the List of applicable compulsory standards on digital signature and digital signature certification service issued with the Decision No. 59/2008/QD-BTTTT shall remain valid till the end of March 31, 2016.
3. If there is any difference between the provisions of this Circular and the provisions of the Circular No. 22/2013/TT-BTTTT dated December 23, 2013 promulgating the List of technical standards for information technology application in state agencies on the same standards related to the use of digital signatures and digital signature certification service provided by organizations in state agencies, this Circular shall be applied.
4. Chief Office, Deputy Minister of the Department of Science and Technology, Director of the National Electronic Authentication Centre, the heads of agencies and units under the ministries, the relative organizations and individuals are responsible to implement this Decision.
5. Any problems arising in the course of implementation should be promptly
reported to the Ministry of Information and Communications for consideration and settlement./.
