RESOLUTION

On application of specific mechanisms in mineral exploitation

Pursuant to the Law on Organization of the Government of February 18, 2025;

Pursuant to the Law on Promulgation of Legal Documents of February 19, 2025;

Pursuant to the Law on Minerals of November 17, 2010;

Pursuant to the Government’s Decree No. 78/2025/ND-CP of April 1, 2025, detailing a number of articles and providing measures to organize and guide the implementation of the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 39/2022/ND-CP of June 18, 2022, promulgating the Working Regulation of the Government;

Pursuant to the Government’s Decree No. 158/2016/ND-CP of November 29, 2016, detailing the implementation of a number of articles of the Mineral Law;

Pursuant to the Government’s Decree No. 10/2025/ND-CP of January 11, 2025, amending and supplementing a number of articles of decrees in the field of minerals;

At the proposal of the Minister of Agriculture and Environment in Reports No. 20/TTr-BNNMT of April 3, 2025; No. 35/TTr-BNNMT of May 9, 2025;

The Government issues the Resolution on application of specific mechanisms in mineral exploitation.

Article 1. Contents of specific mechanisms in mineral exploitation

1. Mineral mines for common building materials, that have been granted mining licenses under which the mineral exploitation period has not yet expired, serving as a source of supply of common building materials for the Long Thanh International Airport Project (below referred to as the Project) shall continue to enjoy the specific mechanisms specified in the Government’s Resolution No. 60/NQ-CP of June 16, 2021, on the application of specific mechanisms in the grant of licenses for exploitation of minerals used as common building materials for supply to the investment project to build a number of sections of the eastern North-South expressway in the 2017-2020 period (that have been already commenced and are about to commence), which was amended and supplemented under the Government’s Resolution No. 133/NQ-CP of October 19, 2021.

2. Stone quarries for common building materials in Dong Nai province that are conformable with master plans on land use for mineral activities and have completed agreements on acquisition of land use rights (compensation for ground clearance) from households having land but have not yet completed procedures for lease of land for mineral exploitation may continue operations to supply building materials to national important projects and key transport projects. The volume of stone exploited during the period the land lease procedures have not been completed shall only be supplied to national important projects and key transport projects.

For mineral exploitation projects that are suspended according to competent agencies’ inspection conclusions, the projects must comply with opinions of inspection conclusion-issuing agencies.

Article 2. Implementation provisions

1. This Resolution takes effect on the date of its signing.

2. The Dong Nai Provincial People's Committee shall:

a/ Direct the increase of the maximum exploitation capacity by 50% of the capacity stated in the mining license with the entire exploitation output to be supplied only to the Project specified in Article 1 of this Resolution.

b/ Direct contractors, organizations and individuals that are granted mining licenses to adopt measures to ensure safety and environmental protection in the course of exploitation and capacity increase. The capacity increase shall end once sufficient materials are supplied to the Project.

c/ Request organizations and individuals exploiting minerals specified in Clause 2, Article 1 to complete land lease procedures as soon as possible.

3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and the Chairperson of the Dong Nai Provincial People's Committee shall implement this Resolution.
