DECISION
Approving the plan to implement tasks on monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea in the 2018-2020 period

THE PRIME MINISTER
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Law on Environmental Protection dated June 23, 2014;
Pursuant to the Law on Natural Resources, Environment of Sea and Islands dated June 25, 2015;
Pursuant to the Law on Chemicals dated November 21, 2007;
Pursuant to the Vietnam Maritime Code dated November 25, 2015;
Pursuant to the Government's Decree No. 30/2017/ND-CP dated March 21, 2017, stipulating the organization and operation of response to incidents, natural disasters, and search and rescue;
Pursuant to the Prime Minister's Decision No. 02/2013/QD-TTg dated January 14, 2013, promulgating the Regulation on oil spill incident response operation; Decision No. 63/2014/QD-TTg dated November 11, 2014, amending and supplementing a number of articles of the Regulation on oil spill incident response promulgated together with the Prime Minister's Decision No. 02/2013/QD-TTg dated January 14, 2013;
Pursuant to the Prime Minister's Decision No. 26/2016/QD-TTg dated July 1, 2016, promulgating the Regulation on toxic chemical incident response operation;
Considering the proposal of the Minister of Natural Resources and Environment,
DECIDES:
Article 1. Approving the Plan to implement tasks on monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea in the 2018-2020 period with the main contents as follows:
I. OBJECTIVES AND REQUIREMENTS
1. Objectives
To ensure that by 2020, the legal framework is completed, and the capacity and effectiveness of monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea are consolidated and improved.
2. Requirements
To ensure the synchronous and effective implementation of monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea when incidents occur.
II. CONTENTS
1. Developing and completing the legal framework and system of legal normative documents on monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea.
2. Developing, consolidating, and improving the capacity of the system for monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea.
3. Training, coaching, disseminating, and raising community awareness on monitoring, remedying, and resolving consequences of oil and toxic chemical spills at sea.
4. Researching and applying scientific and technological advances in monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea.
5. International cooperation on monitoring, risk assessment, remediation and handling of consequences of oil and toxic chemical spills at sea.
III. SPECIFIC TASKS: (Attached Appendix).
IV. IMPLEMENTATION FUNDS
- State budget;
- Sponsorship from domestic and foreign organizations and individuals, and other lawful capital sources in accordance with the law;
Based on the contents and tasks assigned in this Plan, related ministries and agencies shall prepare annual budget estimates and submit them to competent authorities in accordance with the Law on the State Budget and guiding documents for implementation.
V. IMPLEMENTATION ORGANIZATION
1. The Ministry of Natural Resources and Environment shall be responsible for:
a) Guiding and urging the implementation of the Plan;
b) Taking the lead in monitoring and evaluating the results of the Plan implementation, and reporting to the Prime Minister; in case of supplementing or adjusting the Plan, the Ministry of Natural Resources and Environment shall take the lead and coordinate with related ministries and sectors to propose and report to the Prime Minister;
c) Implementing the tasks under its assigned responsibilities in the Plan.
2. The Ministries of: Natural Resources and Environment, Industry and Trade, Agriculture and Rural Development, the Vietnam Academy of Science and Technology, and related ministries and agencies shall be responsible for:
a) Proactively allocating funds in the assigned annual budget estimates to implement the assigned tasks in the plan;
b) Periodically reporting the implementation results to the Ministry of Natural Resources and Environment before December 15 every year for consolidation and reporting to the Prime Minister.
Article 2. This Decision takes effect from the date of its signing and promulgation.
Article 3. The Chairman of the National Committee for Incident, Natural Disaster Response and Search and Rescue; Ministers, Heads of sectors and Chairpersons of People's Committees of related provinces and cities shall be responsible for implementing this Decision./.
