Amending and Supplementing a Number of Articles of the Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law on Real Estate Business No. 29/2023/QH15 and Law on Credit Institutions No. 32/2024/QH15

Pursuant to the Constitution of the Socialist Republic of Vietnam;

The National Assembly hereby promulgates the Law Amending and supplementing a Number of Articles of the Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law on Real Estate Business No. 29/2023/QH15 and Law on Credit Institutions No. 32/2024/QH15.

Article 1. Amending and supplementing a number of articles of the Land Law No. 31/2024/QH15

1. To amend and supplement Clause 2 Article 251 as follows:

“2. To annul the National Assembly’s Resolution No. 132/2020/QH14 of November 17, 2020, on pilot implementation of a number of policies to remove obstacles and limitations in the management and use of land for national defense and security purposes combined with production and economic activities, from January 1, 2025.”.

2. To amend and supplement Clause 1 Article 252 as follows:

“1. This Law takes effect on August 1, 2024, except the cases specified in Clauses 2 and 3 of this Article.”.

3. To amend and supplement Clause 10 Article 255 as follows:

“10. For investment projects eligible for land allocation or land lease not through auction of land use rights in accordance with Land Law No. 45/2013/QH13 and other relevant laws and conforming to land use master plans and land use plans, for which the land area has yet to be allocated or leased, subsequent steps in order and procedures for land allocation or lease may continue to be carried out to allocate or lease land to the investor or project owner in accordance with this Law, if they are:

a) Investment projects for which the investors or project owners are selected in accordance with the investment law, housing law and bidding law during the period from July 1, 2014, to before August 1, 2024;

b) Projects for which investors have submitted valid dossiers to carry out procedures for selection of investors or project owners before August 1, 2024, and the investors or project owners have been selected before January 1, 2025.

The selection of investors or project owners for projects prescribed at this Point shall comply with the law on investment, housing law and bidding law in force at the time of dossier submission.”.

4. To amend and supplement the first paragraph of Clause 4 Article 260 as follows:

“4. Land use plans and land and house disposal and rearrangement plans approved by competent agencies in accordance with the National Assembly’s Resolution No. 132/2020/QH14, on pilot implementation of a number of policies to remove obstacles and limitations in the management and use of land for nation defense and security purposes in combination with production and economic activities, which are issued before January 1, 2025, shall be implemented under approved plans.”.

Article 2. Amending and supplementing Clause 1 Article 197 of the Housing Law No. 27/2023/QH15

To amend and supplement Clause 1 Article 197 as follows:

“1. This Law takes effect from August 1, 2024.”.

Article 3. Amending and supplementing Clause 1 Article 82 of the Law on Real Estate Business No. 29/2023/QH15

To amend and supplement Clause 1 Article 82 as follows:

“1. This Law takes effect from August 1, 2024.”.

Article 4. Amending and supplementing Clause 2 Article 209 of the Law on Credit Institutions No. 32/2024/QH15

To amend and supplement Clause 2 Article 209 as follows:

“2. Clause 3, Article 200 and Clause 15, Article 210 of this Law shall take effect from August 1, 2024.”.

Article 5. Effect

This Law takes effect from August 1, 2024.

This Law was passed on June 29, 2024, by the XV^th National Assembly of the Socialist Republic of Vietnam at its 7^th session.
