Amending and Supplementing a Number of Articles of Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law No. 29/2023/QH15 on Real Estate Business, and Law No. 32/2024/QH15 on Credit Institutions[1]
Pursuant to the Constitution of the Socialist Republic of Vietnam,
The National Assembly promulgates the Law Amending and Supplementing a Number of Articles of Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law No. 29/2023/QH15 on Real Estate Business, and Law No. 32/2024/QH15 on Credit Institutions.
Article 1. To amend and supplement a number of articles of Land Law No. 31/2024/QH15
1. To amend and supplement Clause 2, Article 251 as follows:
“2. To annul the National Assembly’s Resolution No. 132/2020/QH14 of November 17, 2020, on pilot implementation of a number of policies to remove obstacles and limitations in the management and use of land for national defense and security purposes combined with production and economic activities, from January 1, 2025.”.
2. To amend and supplement Clause 1, Article 252 as follows:
“1. This Law takes effect on August 1, 2024, except the cases specified in Clauses 2 and 3 of this Article.”.
3. To amend and supplement Clause 10, Article 255 as follows:
“10. For an investment project eligible for land allocation or land lease not through auction of land use rights in accordance with Land Law No. 45/2013/QH13 and other relevant laws and conformable to land-use master plans and land use plans of which land has not been allocated or leased, subsequent steps in the order and procedures for land allocation or land lease may continue to be carried out to allocate or lease land to the investor or project owner in accordance with this Law if the project falls into one of the following cases:
a/ The investor or project owner has been selected in accordance with the investment law, housing law and bidding law during the period from July 1, 2014, to August 1, 2024;
b/ The investor has submitted a valid dossier for carrying out the procedures for investor or project owner selection before August 1, 2024, and the investor or project owner has been selected before January 1, 2025.
The selection of the investor or project owner for the project specified at this Point must comply with the investment law, housing law and bidding law effective at the time of dossier submission.”.
4. To amend and supplement the first paragraph of Clause 4, Article 260 as follows:
“4. Land use plans and land and house disposal and rearrangement plans approved by competent agencies before January 1, 2025, in accordance with the National Assembly’s Resolution No. 132/2020/QH14, on pilot implementation of a number of policies to remove obstacles and limitations in the management and use of land for nation defense and security purposes in combination with production and economic activities, shall be implemented.”.
Article 2. To amend and supplement Clause 1, Article 197 of Housing Law No. 27/2023/QH15
To amend and supplement Clause 1, Article 197 as follows:
“1. This Law takes effect on August 1, 2024.”.
Article 3. To amend and supplement Clause 1, Article 82 of Law No. 29/2023/QH15 on Real Estate Business
To amend and supplement Clause 1, Article 82 as follows:
“1. This Law takes effect on August 1, 2024.”.
Article 4. To amend and supplement Clause 2, Article 209 of Law No. 32/2024/QH15 on Credit Institutions
To amend and supplement Clause 2, Article 209 as follows:
“1. Clause 3, Article 200 and Clause 15, Article 210 of this Law take effect on August 1, 2024.”.
Article 5. Effect
This Law takes effect on August 1, 2024.
This Law was passed on June 29, 2024, by the 15th National Assembly of the Socialist Republic of Vietnam at its 7th session.-
