Decree 133/2024/ND-CP amending Decree 58/2021/ND-CP on the provision of credit information services

DECREE

Amending and supplementing a number of articles and appendices of the Government’s Decree No. 58/2021/ND-CP dated June 10, 2021, on the provision of credit information services

Pursuant to the Law on Organization of the Government dated June 19, 2015, and the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on the State bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Institutions dated January 18, 2024;

Pursuant to the Law on Enterprises dated June 17, 2020;

Pursuant to the Law on Investment dated June 17, 2020;

At the proposal of the Governor of the State Bank of Vietnam;

The Government hereby promulgates the Decree amending and supplementing a number of articles and appendices of the Government’s Decree No. 58/2021/ND-CP dated June 10, 2021, on the provision of credit information services (hereinafter referred to as Decree No. 58/2021/ND-CP).

Article 1. Amending and supplementing Clause 2 Article 10 and the resume template provided in Appendix VI to Decree No. 58/2021/ND-CP

1. To amend and supplement Clause 2 Article 10 of Decree No. 58/2021/ND-CP as follows:

“2. For copies of documents in a dossier that are neither certified nor issued from the master register, the concerned credit information company shall produce their originals (documents or other forms of legal value equivalent issued by competent agencies as prescribed by law) for collation; the person carrying out the collation shall put his/her signatures on copies and take responsibility for the truthfulness of the copies to the originals.”

2. To amend and supplement Section 1, Section 4 and Note of the resume template provided in Appendix VI to Decree No. 58/2021/ND-CP as follows:

“1. Personal information

a) Regarding Vietnamese citizen:

- Full name

- Date, month and year of birth

- Identity card number or personal identification number

- Place of birth (4)

- Citizenship (current citizenships) (4)

- Place of permanent residence registration (4)

- Place of domicile (if the place of domicile is different from the place of permanent residence registration) (4)

- Name, address and tax identification number of the organization represented by the declarant, portion of contributed capital and share capital presented by the declarant (in case such person is the representative of the share of contributed capital)

-  Wife or husband; father, mother; child(ren) of the declarant (full name, identity card number or personal identification number (for Vietnamese citizens); passport number or passport alternatives, date of issuance, place of issuance (for individuals other than Vietnamese citizens))

b) For individuals other than Vietnamese citizens:

- Full name

- Date, month and year of birth

- Passport number or passport alternatives, date of issuance, place of issuance

- Place of birth

- Citizenship (current citizenships)

- Address registered in the passport or passport alternatives (province/city, district, ward/commune)

- Place of domicile in Vietnam (province/city, district, ward/commune) (if an)

- Name, address and tax identification number of the organization represented by the declarant, portion of contributed capital and share capital presented by the declarant (in case such person is the representative of the share of contributed capital).”

“4. Commitments before the law

- I, ……………….., commit not to violate the provisions of the law and the Charter of the credit information company…….(1)

- I commit that the above statements are true. I will take full responsibility for any information that is not true in this declaration.”

“Note:

- (4) Declarant is only required to fill when officer receiving dossiers cannot exploit the information in the National Population Database.

- In addition to basic information as mentioned above, the declarant may provide additional information if necessary.”

Article 2. Effect

1. This Decree takes effect from November 1, 2024.

2. Dossiers of request for grant of certificates of eligibility for provision of credit information services submitted to the State Bank of Vietnam before the effective date of this Decree shall continue to be considered and processed in accordance with the law applicable at the time of dossier submission.
