DECISION

Annulling part or the whole of a number of Decisions of the Prime Minister in the field of land finance^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 22, 2015 Law on Promulgation of Legal Documents, and the June 18, 2020 Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;

Pursuant to the January 18, 2024 Land Law; and June 29, 2024 Law No. 43/2024/QH15, Amending and Supplementing a Number of Articles of Land Law No. 31/2024/QH15, Housing Law No. 27/2023/QH15, Law No. 29/2023/QH15 on Real Estate Business and Law No. 32/2024/QH15 on Credit Institutions;

Pursuant to the Government’s Decree No. 34/2016/ND-CP of May 14, 2016, detailing a number of articles of, and measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 154/2020/ND-CP of December 31, 2020, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP of May 14, 2016, detailing a number of articles of, and measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 59/2024/ND-CP of May 25, 2024, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP of May 14, 2016, detailing a number of articles of, and measures for implementing, the Law on Promulgation of Legal Documents, which has a number of articles amended and supplemented under the Government’s Decree No. 154/2020/ND-CP of December 31, 2020;

Pursuant to the Government’s Decree No. 103/2024/ND-CP of July 30, 2024, on land use levy and land rental;

At the proposal of the Minister of Finance;

The Prime Minister promulgates the Decision annulling part or the whole of a number of Decisions of the Prime Minister in the field of land finance.

Article 1. To annul the whole of decisions

To annul the whole of the following Decisions:

1. The Prime Minister’s Decision No. 44/2010/QD-TTg of June 10, 2010, on exemption from land use levy and land rental for construction of auxiliary works of national expressways.

2. The Prime Minister’s Decision No. 57/2010/QD-TTg of September 17, 2010, on exemption of land rental for projects to build reserve warehouses each of the capacity of 4 million tons of rice and corn, cold storages for preserving aquatic products, vegetables and fruits, and temporary storages for coffee according to the relevant master plans.

3. The Prime Minister’s Decision No. 33/2011/QD-TTg of June 10, 2011, on exemption of land use levy for households in fishing villages, people living on rivers and lagoons who move to resettlement areas and points.

4. The Prime Minister’s Decision No. 48/2012/QD-TTg of November 1, 2012, amending and supplementing the Prime Minister’s Decision No. 204/2005/QD-TTg of August 15, 2005.

5. The Prime Minister’s Decision No. 11/2015/QD-TTg of April 3, 2015, providing exemption from and reduction of land use levy when recognizing land use rights and ownership rights for houses and other land-attached assets for households and individuals for residential land allocated (granted) ultra vires before October 15, 1993, in areas with difficult or extremely difficult socio-economic conditions, border areas, and islands.

6. The Prime Minister’s Decision No. 22/2020/QD-TTg of August 10, 2020, on reduction of land rental for 2020 for subjects affected by the Covid-19 pandemic according to the Government’s Resolution No. 84/NQ-CP of May 29, 2020.

7. The Prime Minister’s Decision No. 27/2021/QD-TTg of September 25, 2021, on reduction of land rental for 2021 for subjects affected by the Covid-19 pandemic.

8. The Prime Minister’s Decision No. 01/2023/QD-TTg of January 31, 2023, on reduction of land rental and water surface rental for 2022 for subjects affected by the Covid-19 pandemic.

9. The Prime Minister’s Decision No. 25/2023/QD-TTg of October 3, 2023, on reduction of land rental for 2023.

Article 2. To annul part of the Prime Minister’s Decision No. 42/2012/QD-TTg of October 8, 2012

To annul Clause 4, Article 3 of the Prime Minister’s Decision No. 42/2012/QD-TTg of October 8, 2012, on support for organizations and units employing ethnic minority people in mountainous areas and areas with extreme difficulties.

Article 3. Implementation provisions

1. This Decision takes effect on the date of its signing.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and related units shall implement this Decision.-
