Decision 109/QD-NHNN 2023 publish administrative procedures in foreign exchange activities

DECISION

On publishing amended and supplemented administrative procedures in the field of foreign exchange activities at single-window section under the management of the State Bank of Vietnam

THE GOVERNOR OF THE STATE BANK

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Institutions dated June 16, 2010; Law Amending and Supplementing a Number of Articles of the Law on Credit Institutions dated November 20, 2017;

Pursuant to the Government’s Decree No. 102/2022/ND-CP dated December 12, 2022, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

Pursuant to the Government’s Decree No. 63/2010/ND-CP dated June 8, 2010, on controlling of administrative procedures;

Pursuant to the Government’s Decree No. 48/2013/ND-CP dated May 14, 2013; the Government’s Decree No. 92/2017/ND-CP dated October 31, 2017, amending and supplementing a number of articles of decrees concerning control of administrative procedure;

Pursuant to the Government Office’s Circular No. 02/2017/TT-VPCP dated October 31, 2017, guidelines on control of administrative procedures;

Pursuant to the State Bank of Vietnam’s Circular No. 24/2022/TT-NHNN dated December 30, 2022, amending and supplementing a number of articles of the Circulars providing for administrative procedures in the field of foreign exchange management;

At the proposal of the Director of the Foreign Exchange Management Department and the Chief of the Office of the State Bank of Vietnam.

DECIDES:

Article 1. To publish together with this Decision the amended and supplemented administrative procedures in the field of foreign exchange activities specified in Circular No. 24/2022/TT-NHNN dated December 30, 2022 implemented at the single-window section under the management of the State Bank of Vietnam.

Article 2. This Decision takes effect on February 15, 2023 and annuls the Governor of the State Bank’s Decision No. 1529/QD-NHNN dated July 20, 2017, on publishing the amended and supplemented administrative procedures under the management of the State Bank of Vietnam.

This Decision amends and supplements the contents of administrative procedures with codes of 1.000581, 1.000569, 1.000555, 1.000541 published in Decision No. 2307/QD-NHNN dated November 5, 2019; administrative procedures with codes of 1.003338, 1.003331 published in Decision No. 1629/QD-NHNN; administrative procedures with codes of 1.000186 published in Decision No. 1262/QD-NHNN dated August 12, 2016; administrative procedures with codes of 1.000107,2.000074, 1.000545 published in Decision No. 1700/QD-NHNN dated October 28, 2021; administrative procedures with codes of 2.000085, 1.000195 published in Decision No. 1488/QD-NHNN dated July 20, 2016.

Article 3. The Chief of Ministry Office, the Director of the Foreign Exchange Management Department, and the heads of units of the State Bank shall implement this Decision./.
