Circular 10/2023/TT-NHNN cease the effect of a number of provisions of Circular 39/2016/TT-NHNN, provision of loans by credit institutions

CIRCULAR

CESSATION OF THE EFFECT OF A NUMBER OF PROVISIONS OF THE GOVERNOR OF THE STATE BANK OF VIETNAM’S CIRCULAR NO. 39/2016/TT-NHNN DATED DECEMBER 30, 2016, PRESCRIBING THE PROVISION OF LOANS BY CREDIT INSTITUTIONS AND FOREIGN BANK BRANCHES TO CLIENTS (SUPPLEMENTED UNDER THE GOVERNOR OF THE STATE BANK OF VIETNAM’S CIRCULAR NO. 06/2023/TT-NHNN DATED JUNE 28, 2023)

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credits Institutions dated June 16, 2010; Law on Amending and Supplementing a Number of Articles of the Law on Credit Institutions dated November 20, 2017;

Pursuant to the Government's Decree No. 102/2022/ND-CP dated December 12, 2022, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Monetary Policy Department;

The Governor of the State Bank of Vietnam promulgates the Circular ceasing the effect of a number of provisions of the Governor of the State Bank of Vietnam’s Circular No. 39/2016/TT-NHNN dated December 30, 2016, prescribing the provision of loans by credit institutions and foreign bank branches to clients (supplemented under the Governor of the State Bank of Vietnam’s circular no. 06/2023/TT-NHNN dated June 28, 2023)

Article 1. To cease the effect of the provisions of Clause 8, Clause 9 and Clause 10 Article 8 of the State Bank of Vietnam’s Circular No. 39/2016/TT-NHNN dated December 30, 2016, prescribing the provision of loans by credit institutions and foreign bank branches to clients (supplemented under Clause 2 Article 1 of the Governor of the State Bank of Vietnam’s Circular No. 06/2023/TT-NHNN dated June 28, 2023, amending and supplementing a number of articles of Circular No. 39/2016/TT-NHNN) from September 1, 2023,s until the effective date of the newly issued legal document providing for regulations on these provisions.

Article 2. Effect

This Circular takes effect from September 1, 2023.

Article 3. Responsibility for implementation organization

The Chief of Office, Director of the Monetary Policy Department, heads of State Bank of Vietnam’s affiliated units, directors of provincial-level branches of the State Bank of Vietnam, credit institutions and foreign bank branches shall organize the implementation of this Circular./.
