CIRCULAR

Repealing a number of legal documents promulgated by the Governor of the State Bank of Vietnam

Pursuant to the Law on the State bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015;

Pursuant to the Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

Pursuant to the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 154/2020/ND-CP dated December 31, 2020, amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP of May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 102/2022/ND-CP dated December 12, 2022, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Department of Legal Affairs;

The State Bank Governor of Vietnam hereby issues the Circular repealing a number of legal documents promulgated by the Governor of the State Bank of Vietnam.

Article 1. Wholly repeal of legal documents

Wholly repealing the following legal documents promulgated by the State Bank Governor:

1. Circular No. 07/1997/TT-NHNN7 dated December 4, 1997, of the State Bank Governor, guiding the implementation of Decision No. 802-TTg of September 24, 1997, of the Prime Minister, on solving the existing problems in opening letters of credit.

2. Decision No. 403/1997/QD-NHNN2 dated December 5, 1997, of the State Bank Governor, permitting the Management Boards of bank projects to apply book-keeping account systems promulgated together with the State Bank Governor’s Decision No. 269/QD-NH2 dated December 4, 1992, by the State Bank.

3. Decision No. 456/2003/QD-NHNN dated May 12, 2003, of the State Bank Governor, amending and supplementing Clause 1, Article 1 of the Regulation on interbank electronic clearing payment, promulgated together with the State Bank Governor's Decision No. 1557/2001/QD-NHNN of December 14, 2001.

4. Circular No. 34/2012/TT-NHNN dated December 27, 2021, of the State Bank Governor, regulating the development and maintenance of commercial banking operation software of the State Bank of Vietnam.

5. Circular No. 13/2021/TT-NHNN dated August 23, 2021, of the State Bank Governor, amending and supplementing a number of articles of Circular No. 26/2013/TT-NHNN dated December 05, 2013, of the State Bank of Vietnam, on promulgating the State Bank of Vietnam’s Payment Services Fee Schedule.

Article 2. Effect

This Circular takes effect from July 22, 2024.

Article 3. Implementation organization

The Director of the Department of Legal Affairs, heads of units under the State Bank of Vietnam, directors of State Bank branches of provinces and centrally run cities, credit institutions and foreign bank branches shall implement this Circular./.
