RESOLUTION

On separation of the content of compensation, support and resettlement of the nuclear power project for which the National Assembly has decided on the investment policy into an independent project

Pursuant to Law No. 63/2025/QH15 on Organization of the Government;

Pursuant to Law No. 72/2025/QH15 on Organization of Local Administration;

Pursuant to Law No. 64/2025/QH15 on Promulgation of Legal Documents which is amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the National Assembly’s Resolution No. 41/2009/QH12 on the investment policy for the Ninh Thuan nuclear power project;

Pursuant to the National Assembly’s Resolution No. 174/2024/QH15 on the 8th session of the 15th National Assembly;

Pursuant to the National Assembly’s Resolution No. 189/2025/QH15 on a number of special mechanisms and policies on investment in the construction of the Ninh Thuan nuclear power project;

Pursuant to Law No. 58/2024/QH15 on Public Investment which is amended and supplemented under Law No. 90/2025/QH15;

Pursuant to Law No. 83/2015/QH13 on the State Budget which is amended and supplemented under Law No. 56/2024/QH15 and Law No. 90/2025/QH15;

Pursuant to Land Law No. 31/2024/QH15 which is amended and supplemented under Law No. 43/2024/QH15;

Pursuant to Law No. 22/2023/QH15 on Bidding which is amended and supplemented under Law No. 57/2024/QH15 and Law No. 90/2025/QH15;

Pursuant to the Law on Oversight Activities of the National Assembly and People’s Councils which has a number of articles amended and supplemented under the National Assembly’s Resolution No. 96/2023/QH15 of June 23, 2023;

Pursuant to the National Assembly’s Resolution No. 206/2025/QH15 on special mechanisms for handling difficulties and obstacles caused by law;

At the proposal of the Minister of Finance;

The Government promulgates the Resolution on separation of the content of compensation, support and resettlement of the nuclear power project for which the National Assembly has decided on the investment policy into an independent project.

Article 1. Scope of regulation and subjects of application

1. Scope of regulation

This Resolution prescribes the handling of difficulties and obstacles in separating the content of compensation, support and resettlement of the nuclear power project for which the National Assembly has decided on the investment policy into an independent project.

2. Subjects of application

This Resolution applies to localities with nuclear power plants for which the National Assembly has decided on the investment policy (the specific case of Khanh Hoa province), project owners, units assigned the Ninh Thuan nuclear power project preparation task and other organizations and individuals involved in the implementation of the Ninh Thuan nuclear power project.

Article 2. Specific mechanisms and policies for implementation of the compensation, support and resettlement project for implementation of the Ninh Thuan nuclear power project

1. To allow the separation of compensation, support, and resettlement content of the Ninh Thuan nuclear power project into an independent project (below referred to as the project).

2. To assign the Khanh Hoa Provincial People's Committee as the Project management agency. To assign the Chairman of the Khanh Hoa Provincial People's Committee to decide on investment in the Project when the competent authority has not yet decided to adjust the investment policy, and approve the adjustment of the Ninh Thuan nuclear power project in accordance with law.

3. While waiting for resettlement arrangements, the Khanh Hoa Provincial People's Committee may arrange make-shift housing or provide rental support for people having their residential land recovered for the project. The specific duration and level of support shall be prescribed by the Khanh Hoa Provincial People's Committee, ensuring transparency, publicity and suitability to local conditions.

4. To assign project owners of Ninh Thuan 1 nuclear power plant and Ninh Thuan 2 nuclear power plant to update contents of the Project into the pre-feasibility study reports of the Ninh Thuan 1 nuclear power plant project and Ninh Thuan 2 nuclear power plant project to ensure consistency.

5. To apply the form of contractor appointment according to the fast-track procedures for consultancy and non-consultancy service bidding packages to implement the Project according to the law on bidding.

6. Land recovery for the implementation of the Project is prescribed as follows:

a/ Based on the land use master plan approved by the competent authority, the competent state agency shall recover land in accordance with the Land Law and issue a notice on organization of investigation, survey, measurement, inventory and verification of the origin of the land and land-attached assets.

The notice on organization of investigation, survey, measurement, inventory and verification of the origin of the land and land-attached assets shall be sent to each land user and announced on mass media, and posted at the office of the commune-level People's Committee and at the communal place of the residential area;

b/ Based on the notice specified at Point a of this Clause, the unit assigned the compensation, support and resettlement tasks in accordance with the land law may carry out investigation, survey, measurement, inventory, and verification of the origin of land and land-attached assets before the competent state agency issues the land recovery notice.

The commune-level People's Committee shall coordinate with the unit assigned the compensation, support and resettlement tasks in carrying out investigation, survey, measurement, inventory and verification of the origin of land and land-attached assets.

Land users shall coordinate with the unit assigned the compensation, support and resettlement tasks in conducting investigation, survey, measurement, inventory and verification of the origin of the land and land-attached assets in order to serve the formulation a compensation, support and resettlement plan.

c/ After the Project is approved by the competent authority in accordance with Clause 2 of this Article, the state agency competent to recover land in accordance with the Land Law shall issue the land recovery notice and use the results of investigation, survey, measurement, inventory and verification of the origin of the land and land-attached assets carried out under Point b of this Clause to formulate a compensation, support and resettlement plan.

The formulation, appraisal, approval and organization of the implementation of the compensation, support and resettlement plan and the land recovery decision must comply with the land law.

Article 3. Funding sources for the project implementation

The funding sources for the Project implementation shall include the central budget, increased revenue, savings in expenditures, annual contingencies of the central budget and other lawful capital sources.

Article 4. Effect

1. This Resolution takes effect from the date of signing to February 28, 2027.

2. During the time this Resolution takes effect:

a/ In case there are different provisions on the Project implementation in this Resolution and laws and resolutions of the National Assembly or resolutions of the National Assembly Standing Committee, this Resolution shall prevail.

b/ In case new provisions in a law or resolution of the National Assembly or resolution of the National Assembly Standing Committee are promulgated after the effective date of this Resolution and contain more favorable content, ensuring higher lawful rights and benefits for the people and organizations compared to the provisions of this Resolution, the new provisions of that law shall prevail.

Article 5. Organization of implementation

1. The implementation of the project on migration and settlement of nuclear power plant projects in Ninh Thuan province under the Prime Minister’s Decision No. 794/QD-TTg of June 8, 2015 shall be ceased.

2. The Ministry of Agriculture and Environment shall assume the prime responsibility for, and coordinate with the Ministry of Justice, the Ministry of Industry and Trade and the Khanh Hoa Provincial People's Committee in reviewing and reporting to the competent authority for the annulment of the Prime Minister’s Decision No. 1504/QD-TTg of August 28, 2013.

3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People's Committees at all levels and other related organizations and individuals shall implement this Resolution.

4. The Ministry of Finance shall, within the ambit of its assigned tasks and powers, assume the prime responsibility for, and coordinate with relevant ministries, sectors, and localities in guiding, inspecting, monitoring and urging the implementation of this Resolution; periodically report to the Government and the Prime Minister for handling difficulties and obstacles (if any) in the course of implementation; and advise the Government to report to the National Assembly at the upcoming session.

5. The People's Council of Khanh Hoa province shall oversee the organization and implementation of the Resolution in accordance with the Law on Oversight Activities of the National Assembly and People’s Councils, ensuring publicity, transparency and control of the implementation in the locality.

6. The People's Committee of Khanh Hoa province shall:

a/ Bear responsibility for organizing the implementation of this Resolution, ensuring progress, quality, publicity and transparency during the implementation process and concurrently ensure national defense and security and social order and safety requirements.

b/ Closely coordinate with the Ministry of National Defense and the Ministry of Public Security in managing and controlling security, protecting key areas and preventing the emergence of hotspots or complex complaints that affect political stability and social order and safety.

c/ Closely coordinate with the Ministry of Science and Technology and the Ministry of Industry and Trade in ensuring radiation safety and nuclear security in the projects’ areas.

d/ Periodically report to the Prime Minister; direct the examination, inspection and post-inspection of the implementation, ensuring the compliance with law and the approved schedule.

7. In case the competent authority decides to adjust the investment policy or approves the adjustment of the Ninh Thuan nuclear power project, the People's Committee of Khanh Hoa province shall review, update, and adjust the Project information to ensure the consistency and synchronization of the investment scope.
