RESOLUTION

On a number of special and outstanding mechanisms and policies to create breakthroughs in education and training development

Pursuant to the Constitution of the Socialist Republic of Vietnam, which has a number of articles amended and supplemented under Resolution No. 203/2025/QH15;

Pursuant to Law No. 57/2014/QH13 on Organization of the National Assembly, which has a number of articles amended and supplemented under Law No. 65/2020/QH14 and Law No. 62/2025/QH15;

Pursuant to Law No. 64/2025/QH15 on Promulgation of Legal Documents, which has a number of articles amended and supplemented under Law No. 87/2025/QH15;

RESOLVES:

Article 1. Scope of regulation and subjects of application

1. This Resolution provides a number of special and outstanding mechanisms and policies to create breakthroughs in education and training development.

2. This Resolution applies to education institutions within the national education system, and related organizations and individuals.

Article 2. Development of human resources in the education sector

1. The mechanisms on recruitment, employment and management of human resources in the education sector are prescribed as follows:

a/ Directors of provincial-level Departments of Education and Training have the competence to recruit and receive teachers, education administrators and employees in public early childhood education institutions, general education institutions, continuing education institutions, specialized schools and vocational upper secondary schools (below referred to as public education institutions) in the provinces; and have the competence to transfer, reassign, second, appoint and change job positions of teachers, education administrators and employees in public education institutions under their management and public education institutions involving two or more commune-level administrative units in the provinces;

b/ Chairpersons of commune-level People's Committees have the competence to transfer, reassign, second, appoint, relieve from duty and change job positions of teachers, education administrators and employees in public education institutions under their management;

c/ Vocational and higher education institutions have the autonomy in determining job positions for, recruiting, and signing labor contracts with foreign and overseas Vietnamese experts and scientists holding doctoral degrees according to their internal regulations; decide on, and take accountability for, the recruitment and certification of foreign experts and scientists eligible for exemption of work permits for a maximum period of 3 years for teaching and scientific researches.

2. Specific and outstanding policies regarding treatment for human resources in the education sector are prescribed as follows:

a/ Professional incentive allowances shall comply with the Government-prescribed roadmap for public early childhood education institutions and general education institutions, with a minimum rate of 70% for teachers, 30% for employees and 100% for teachers working in border areas, on islands, and in ethnic minority and mountainous areas and areas with extremely difficult socio-economic conditions;

b/ Vocational and higher education institutions have the autonomy in determining the additional income for their teachers, public employees and workers from the retained amounts of lawful non-state budget revenue sources in accordance with law, which must comply with their internal spending regulations and operation efficiency results.

Article 3. Development of education programs

1. The Minister of Education and Training shall decide on a set of general education textbooks for uniform use nationwide from the 2026-2027 school year; by 2030, it is targeted to complete the provision of free textbooks to pupils, with priority given to those in border areas, on islands, and in ethnic minority and mountainous areas and areas with extremely difficult socio-economic conditions.

The State shall ensure resources for tuition exemption and free course books for national defense and security education at vocational and higher education institutions according to the Government- prescribed roadmap in conformity with the state budget balancing capacity and in accordance with relevant laws.

2. Education institutions may cooperate with science and technology organizations, research institutes, enterprises and other organizations in implementing education or training programs associated to the labor market’s demands, scientific research and innovation.

Article 4. Digital transformation and international cooperation

1. The State shall prioritize investment in building a national database on education and training, digital infrastructure and a shared-use platform. By 2030, higher education institutions shall complete their synchronous and inter-connected digital infrastructure and platforms. Enterprises are encouraged to invest in developing digital education products and services in the form of public-private partnership.

2. Vocational education institutions, higher education institutions and science and technology organizations may take initiative in organizing international conferences and seminars and notify their direct managing agencies before organizing international conferences and seminars in the fields of mathematics and statistics, computer science and information technology, engineering technology, engineering, natural sciences, life sciences, environmental sciences, the environment and environmental protection, economics, business and management, production and processing, architecture and construction, agriculture, forestry and fisheries, animal health, health, educational science and teacher training, transport services, and international conferences and seminars with themes serving urgent tasks as required or directed by, or under the order placement of the Party, the National Assembly, the Government, and ministries and sectors.

International conferences or seminars attended by ministers or holders of the equivalent or higher titles from countries, territories or international organizations; or international conferences and seminars with themes and contents related to borders, territory, national sovereignty, defense, security, ethnicity, religion, or human rights, or falling within the scope of state secrets, must comply with the Prime Minister’s regulations and the law on the protection of state secrets.

3. The Minister of Education and Training shall decide on the establishment of branches of Vietnamese public higher education institutions or Vietnamese public higher education institutions overseas under schemes approved by direct managing agencies and in accordance with the laws of the host country. The organization of training, grant of degrees, or grant of joint degrees shall be carried out according to the schemes’ content and the host countries’ regulations.

Article 5. Support for learners and training of highly qualified human resources

1. Learners may access to preferential credit sources from the Vietnam Bank for Social Policies to cover their study and living expenses in accordance with law.

The Government shall consider and submit to competent authorities priority mechanisms on addition of capital for the Vietnam Bank for Social Policies to implement the learner credit policy at the Vietnam Bank for Social Policies in accordance with law.

2. The Government shall specify the national key program for full-time doctoral training. Doctoral students participating in the key program under the order placement of, or as assigned by, the State, associated with the country’s priority science and technology tasks, shall be granted scholarships and receive living expense support.

3. Support policies for education and training in specialized disciplines in arts and high-performance sports are prescribed as follows:

a/ To early identify, select, and nurture talents through a permeable roadmap across different levels of education and training; to link training with achievements, national development needs and international integration; and to develop highly qualified human resources for traditional arts;

b/ The Ministry of Culture, Sports and Tourism shall implement a mechanism for assigning tasks and placing long-term training orders with domestic education and training institutions that provide training in specialized disciplines in arts and high-performance sports, allowing the inclusion of all specialized expenses in the orders’ unit prices under regulations;

c/ Vocational and higher education institutions that provide training in specialized disciplines in arts and high-performance sports may sign contracts for the performance of professional and technical tasks with artisans, artists and coaches. Expenses for contract payments, professional incentive allowances and other task-related expenditures as prescribed shall be covered by the state budget and other lawful revenue sources of the training institutions. Contract signatories may participate in professional further-training and upskilling courses in accordance with law.

Article 6. Investment incentives for education and training

1. Provincial-level People's Councils shall decide to add medium-term investment projects to the field of education and training, and approved land use plans without waiting for the next adjustment period. The order and procedures for land repurposing, land allocation and land lease for such projects shall be implemented according to the fast-track procedures prescribed by the Government.

2. Provincial-level People's Committees shall prioritize the allocation of sufficient land areas for education and training institutions in provincial-level master plans and provincial-level land use master plans; prioritize the allocation of land areas managed by State agencies or organizations or surplus public headquarters to attract investment projects in education and training; and allow organizations and individuals to lease surplus public headquarters and state-owned facilities for education and training activities.

3. Residential land, land for construction of working offices or non-business facilities other than education and training facilities and land for non-agricultural production and business activities may be used for education and training purposes without being based on land use master plans or plans.

4. The State shall ensure the allocation of at least 20% of the total state budget expenditure to education and training; and allocate budget from increased revenue sources to education and training development with priority given to border areas, islands, and ethnic minority and mountainous areas and areas with extremely difficult socio-economic conditions

Article 7. Handling of transitional contents upon the termination of operation of the school council of public education schools

1. Within 6 months after a school council terminates its operation, the agency directly managing public nursery schools, pre-primary schools, early childhood schools, general education institutions, vocational education institutions and higher education institutions (below referred to as education institutions) shall decide on the management and administration tasks previously undertaken by the school council regarding the organization and personnel work and decide on the heads based on the standards and conditions for the heads of education institutions prescribed by the Minister of Education and Training.

 2. The agency directly managing education institutions shall decide on the number of deputy heads during the personnel arrangement phase, allow the number of deputy heads to exceed the law-prescribed maximum number for 5 years after the school council terminates its operation and formulate a plan on gradual reduction in such number for implementation in accordance with law.

Article 8. Organization of implementation

1. The Government shall guide the implementation of this Resolution; and annually report the results of the implementation of this Resolution to the National Assembly in the report on education operations and the implementation of the budget for education.

2. The Ministry of Education and Training shall act as the focal point and bear responsibility before the Government; assume the prime responsibility for, and coordinate with ministries, ministerial-level agencies, government-attached agencies and provincial-level People's Committees in, guiding, monitoring, urging, inspecting, summarizing and evaluating the implementation of this Resolution.

3. The National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, the Committees of the National Assembly, delegations of National Assembly deputies, National Assembly deputies, People's Councils, Boards of People's Councils and People's Council deputies, and the Vietnam Fatherland Front shall, within the ambit of their tasks and powers, oversee the implementation of this Resolution.

Article 9. Implementation provisions

1. This Resolution takes effect on January 1, 2026.

2. In case provisions in this Resolution and those in other laws or resolutions of the National Assembly on the same issue remain divergent, this Resolution shall apply, except the case prescribed in Clause 3 of this Article.

3. In case the National Assembly’s documents issued after this Resolution provide more preferential or favorable mechanisms or policies than those in this Resolution, those mechanisms or policies shall apply.

This Resolution was passed on December 10, 2025, by the 15th National Assembly of the Socialist Republic of Vietnam at its 10th session.-
