THE NATIONAL ASSEMBLY

Resolution No. 89/2015/QH13 dated June 09, 2015 of the National Assembly on adjusting the 2015 Law- and Ordinance-making program and approving the 2016 Law- and Ordinance-making program

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Law No. 30/2001/QH10 on Organization of the National Assembly, which was amended and supplemented under Law No. 83/2007/QH11;

Pursuant to Law No. 17/2008/QH12 on Promulgation of Legal Documents;

Considering the National Assembly Standing Committee s Proposal No. 861/TTr-UBTVQH13 of May 11, 2015, on tentative adjustments to the 2015 law-and ordinance-making program of the XIIIthNational Assembly and its 2016 law- and ordinance-making program; and the National Assembly Standing Committee s Report No. 893/BC-UBTVQH13 of June 7, 2015, explaining and assimilating National Assembly deputies’ opinions about tentative adjustments to the 2015 law- and ordinance-making program of the XIIIthNational Assembly and its 2016 law- and ordinance-making program,

RESOLVES:

Article 1.

To add the following projects and drafts to the law- and ordinance-making program of the XIIIthNational Assembly:

1. The Resolution amending and supplementing Resolution No. 1269/2011/NQ-UBTVQH12 of July 14, 2011, on environmental protection tariff (which was adopted by the National Assembly Standing Committee at its March 2015 meeting);

2. The Resolution amending and supplementing a number of articles of Resolution No. 712/2013/UBTVQH13 of December 16, 2013, promulgating royalty rates;

3. The National Assembly’s Resolution on implementation of lump-sum payment of social insurance for workers after one year of unemployment;

4. The Ordinance on Market Management.

Article 2.

To adjust the 2015 law- and ordinance-making program as follows:

1. To add to the 2015 Program the following projects and drafts:

- The Resolution amending and supplementing Resolution No. 1269/2011/NQ-UBTVQH12 of July 14,2011, on environmental protection tariff (which was adopted by the National Assembly Standing Committee at its March 2015 meeting);

- The Resolution amending and supplementing a number of articles of Resolution No. 712/2013/UBTVQH13 of December 16, 2013, promulgating royalty rates;

- The amended Law on Import Duty and Export Duty to be passed at the 10thsession (to be discussed and passed at the same session);

- The amended Law on Pharmacy to be discussed at the 10thsession;

- The National Assembly’s Resolution on implementation of lump-sum payment of social insurance for workers after one year of unemployment already passed at the 9th session (to be discussed and passed at the same session);

- The Ordinance on Market Management.

2. To adjust the time limit for submitting the following bills to the National Assembly:

- To transfer the draft Law on Hydrometeorology from the list of drafts to be discussed at the 10thsession to that to be discussed at the 9thsession and passed at the 10thsession;

- To postpone the submission of the draft Law on Demonstration from the list of drafts to be discussed at the 9th session to that to be discussed at the 11thsession; to postpone the submission of the draft Law Amending and Supplementing a Number of Articles of the Law on Technology Transfer from the list of drafts to be passed at the XIIIthNational Assembly’s 10thsession to that to be discussed at the XIVthNational Assembly’s 2ndsession;

- To withdraw the draft Law on Population from the 2015 Program.

Article 3.

To approve the 2016 law-and ordinance-making program as follows:

I. BILLS

1. At the XIIIthNational Assembly’s 11thsession (scheduled in March 2016)

a/ The National Assembly shall pass 6 bills, namely:

1. The Law on Information Access;

2. The amended Law on Conclusion, Accession to and Implementation of Treaties;

3. The Law on Planning;

4. The amended Press Law;

5. The amended Law on Child Protection, Care and Education;

6. The amended Law on Pharmacy;

b/ The National Assembly shall discuss 1 bill:

1. The Law on Demonstration.

2. At the XIVthNational Assembly’s 1stsession (scheduled in July 2016)

The National Assembly shall pass 1 bill:

1. The National Assembly’s Resolution on the 2017 law-and ordinance-making program.

3. At the XIVthNational Assembly’s 2ndsession (scheduled in October 2016)

a/ The National Assembly shall pass 5 bills, namely:

1. The Law on Promulgation of Administrative Decisions;

2. The Law on Demonstration;

3. The Law on Associations;

4. The Law on Beliefs and Religions;

5. The Law on Asset Auction.

b/ The National Assembly shall discuss 17 bills, namely:

1. The amended Law on National Defense;

2. The Law on Communal Police;

3. The Law on Certification;

4. The Law on Blood and Stem Cell;

5. The amended Railway Law;

6. The amended Anti-Corruption Law;

7. The Law on Foreign Trade Management;

8. The Law on Management and Use of Weapons, Explosives and Supporting Tools;

9. The Law on Support of Medium- and Small-sized Enterprises;

10. The amended Law on Management and Use of State Assets;

11. The Law on Irrigation;

12. The amended Law on Nuclear Energy;

13. The Law Amending and Supplementing a Number of Articles of the Law on Technology Transfer;

14. The amended Law on State Compensation Responsibility;

15. The Law on Security Guard;

16. The amended Law on Tourism;

17. The amended Law on Legal Aids.

II. DRAFT ORDINANCES

The National Assembly Standing Committee shall pass 2 draft ordinances, namely:

1. The amended Ordinance on Plant Varieties;

2. The amended Ordinance on Livestock Breeds.

Article 4.

1. Agencies, organizations and individuals shall strictly implement the Law on Promulgation of Legal Documents; properly implement solutions set out in the XIIIthNational Assembly’s Resolutions on the law- and ordinance-making program; not submit to the National Assembly and its Standing Committee projects and drafts whose quality and schedule are not ensured; clearly review and identify reasons and responsibilities for failure to complete the program for reporting to the National Assembly.

Related agencies and organizations shall create favorable conditions for National Assembly deputies and other subjects to exercise the right to legal initiative.

2. The Government, ministers, heads of ministerial-level agencies and related agencies shall strictly promulgate documents detailing the implementation of laws, the National Assembly’s resolutions, and ordinances and resolutions of the National Assembly Standing Committee so that such documents will take effect at the same time with relevant laws, ordinances, and resolutions; properly allocate law-making support funds to facilitate agencies and organizations in implementing the law-and ordinance-making program.

The Government shall assign responsible agencies to further study and review relevant current regulations for proposing amendments and supplements to, and promulgation of, projects, in order to implement the Constitution and meet practical requirements of life.

3. The National Assembly Office shall create conditions regarding funds and other necessary material conditions; the National Assembly Standing Committee’s Institute for Legislative Studies shall assist National Assembly deputies in making and completing law- and ordinance-making proposal dossiers in accordance with the Law on Promulgation of Legal Documents for submission to the National Assembly Standing Committee and the National Assembly.-

This Resolution was adopted on June 9, 2015, by the XIIIthNational Assembly of the Socialist Republic of Vietnam at its 9thsession.-
