RESOLUTION
ON EXPLANATION A NUMBER OF ARTICLE OF THE LAW ON PLANNING
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law No. 57/2014/QH13 on Organization of the National Assembly;
Pursuant to the Law No. 80/2015/QH13 on promulgation of legal documents;
Pursuant to the Law No. 21/2017/QH14 on Planning;
After consider the Statement No. 314/TTr-CP dated August 06, 2019 and the supplement Statement No. 322/TTr-CP dated August 12, 2019 of the Government, the Verification report No. 1518/BC-UBKT14 dated August 10, 2019 of the Economic Committee of the National Assembly;
RESOLVES:
Article 1. To explain a number of the Law on Planning
1. To explain Clause 1 Article 6 and Clause 2 Article 20 as follow:
Plans as regulated in the Law on Planning and other laws, ordinance on amending and supplementing a number of the Law on Planning can be made simultaneously. Former made and appraised shall be decided or approved in advance. After the planning is decided or approved, if there is a conflict, the lower level plans must adjust to a higher level plans.
2. Point c Clause 1 Article 59 shall be construed as follow:
Plans prescribed at point c Clause 1 Article 59 of the Law on Planning which have been decided or approved before January 01, 2019, in the course of implementation shall be amended in content in accordance with relevant laws provision which take effect before the effective date of the Law on Planning. Such amendment shall be implemented in order to satisfy socio-economic development until national, regional, provincial under the Law on Planning be decided of approved.
Article 2. Implementation
The Government shall takes responsibility to command the formulation and appraisal plans in Ministries, branches, localities in order to guarantee the linkage, synchronization, inheritance, stability and system among plans.
Article 3. Effect
1. This Resolution takes effect on the signing date.
2. This Resolution shall be applied simultaneously with the Law on Planning.
