Resolution 47/2022/QH15 on the 2023 oversight program of the National Assembly

RESOLUTION

On the 2023 oversight program of the National Assembly

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to Law No. 87/2015/QH13 of the Law on Oversight Activities of the National Assembly and People’s Councils;

After examining the National Assembly Standing Committee’s Recommendation Report No. 221/TTr-UBTVQH15 of May 20, 2022, on the 2023 tentative oversight program of the National Assembly; and Report No. 234/BC-UBTVQH15 of June 1, 2022, on assimilation of and explanation about opinions of National Assembly deputies on the 2023 tentative oversight program of the National Assembly;  

RESOLVES:

Article 1. Contents of the oversight program

1. At the 5^th session

a/ Examining the Government’s reports on additional evaluation of results of the implementation of the 2022 socio-economic development and state budget plans; the practical implementation of the 2023 socio-economic development and state budget plans in the first months of the year; the 2021 state financial report; the 2021 state budget finalization report; and the report on thrift practice and wastefulness combat in 2022;

b/ Examining the National Assembly Standing Committee’s report on results of the oversight of the settlement of voters’ recommendations sent to the 4^th session;

c/ Making questions and answers to questions of National Assembly deputies;

d/ Examining the topical oversight report on “the mobilization, management and use of resources for the COVID-19 pandemic prevention and control, and the implementation of grassroots health and preventive medicine policies and laws”;    

dd/ Examining the National Assembly Standing Committee’s report on implementation of oversight recommendations of the National Assembly Standing Committee, the Nationality Council, the National Assembly’s Committees, deputy delegations and deputies (if any);

e/ Examining other reports of concerned agencies in accordance with law.

2. At the 6^th session

a/ Examining the Government’s reports on:

a/ Mid-term evaluation of results of the implementation of the 2021-2025 five-year plans on socio-economic development, economic restructuring, medium-term public investment, national finance, borrowing and payment of public debts;

- Results of the implementation of the socio-economic development and state budget plans, and 2024 socio-economic development plan, state budget estimates and central budget allocation plan; and results of the implementation of the 2023 public investment plan and the 2024 tentative public investment plan;

- Results of the implementation of the National Assembly’s resolutions on the 2021-2025 five-year plan; the national target program on building of the new countryside; the national target program on sustainable poverty reduction; the national target program on socio-economic development in ethnic minority and mountainous regions;

- The practical implementation of the National Assembly’s Resolution No. 43/2022/QH15 of January 11, 2022, on fiscal and monetary policies in support of the program on socio-economic recovery and development;

- The corruption and negative practice prevention and combat; crime and law violation prevention and combat, and judgment execution;

- The implementation of the Constitution, laws, ordinances, and resolutions of the National Assembly and National Assembly Standing Committee;

- The realization of the national goal on gender equality;

- Results of the operation and the management and use of the Fund for Prevention and Control of Tobacco Harms in 2021 and 2022; results of the two years’ (2022 and 2023) implementation of the National Assembly’s Resolution No. 68/2013/QH13 on acceleration of the implementation of policies and laws on health insurance, with a view to providing all-people health insurance; the practical implementation of social security policies and regimes, management and use of the Social Security Fund in 2022; and the management and use of the Health Insurance Fund in 2022;

- The practical implementation of the Long Thanh International Airport Project under the National Assembly’s Resolutions No. 94/2015/QH13 and No. 95/2019/QH14;

- The practical implementation of the project on construction of the Eastern North-South Expressway for the 2021-2025 period under the National Assembly’s Resolution No. 44/2022/QH15.

b/ Examining reports of the Government, Supreme People’s Court, and Supreme People’s Procuracy on settlement of complaints and denunciations; reports of the National Assembly Standing Committee on results of the oversight of the settlement of voters’ recommendations sent to the 5^th session; results of citizen reception, settlement of complaints and petitions, and oversight of the settlement of citizens’ complaints and denunciations filed to the National Assembly;

c/ Examining reports of the cabinet members, the Chief Justice of the Supreme People’s Court, the Procurator General of the Supreme People’s Procuracy, and the State Audit Office of Vietnam on the implementation of a number of resolutions of the 14^th National Assembly on topical oversight and questioning, and the National Assembly’s resolutions on topical oversight and questioning from the beginning of the 15^th legislature to the end of the 4^th session;

d/ Making National Assembly deputies’ questions and answers thereto;

dd/ Examining the topical oversight report on “the implementation of the National Assembly’s resolutions on the national target programs on building of the new countryside in the 2021-2025 period, sustainable poverty reduction in the 2021-2025 period, and socio-economic development in ethnic minority and mountainous regions in the 2021-2025 period”;

e/ Holding vote of confidence for post-holders elected or approved by the National Assembly;

g/ Examining reports on results of topical oversight of the National Assembly Standing Committee; working reports for 2023 of the National Assembly Standing Committee, Nationality Council, the National Assembly’s Committees, Government, Supreme People’s Court, Supreme People’s Procuracy, and the State Audit Office of Vietnam;

h/ Examining reports of the National Assembly Standing Committee on the implementation of oversight recommendations of the National Assembly Standing Committee, Nationality Council, the National Assembly’s Committees, deputy delegations and deputies (if any);

i/ Examining other reports of concerned agencies in accordance with law.

Article 2. Organization of implementation

1. The National Assembly Standing Committee shall promulgate a plan on and organize the effective implementation of this Resolution; direct and regulate oversight activities of the Nationality Council and Committees of the National Assembly; guide the National Assembly’s deputy delegations and deputies in performing oversight activities; direct the monitoring, supervision and summing up of results of the implementation of post-oversight recommendations; report on results of the implementation of the National Assembly’s 2023 oversight program to serve as a basis for the formulation of the 2024 tentative oversight program, ensuring combination of oversight activities with legislative activities and decision on the country’s important issues.

2. Based on the National Assembly’s 2023 oversight program and practical conditions and situation, the National Assembly Standing Committee, Nationality Council, the National Assembly’s Committees, deputy delegations and deputies shall take the initiative in formulating and implementing their own oversight programs and reporting implementation results in accordance with law; continue to renew their oversight activities so as to ensure proper oversight over right subjects and matters, clearly indicating addresses and responsibility of organizations and individuals subject to the oversight, and make recommendations to improve the State’s policies and laws.

In the course of oversight, it is necessary to clarify matters and responsibility of agencies, organizations and individuals subject to the oversight; use information provided by the state audit and inspection agencies. Resolutions on oversight and questioning must be concise and clear, state quantitative criteria, deadlines and specific responsibility of related agencies, organizations and individuals, and assign the task of monitoring and supervising the implementation of post-oversight resolutions and recommendations.

3. The Secretary General and Office of the National Assembly shall base themselves on their functions and tasks to improve the professionalism in the organization of implementation and create more favorable conditions for oversight activities to be performed in a convenient, quality and efficient manner.         

4. Related agencies, organizations and individuals shall report and provide adequate, timely and accurate information and necessary documents on oversight contents upon requests; fully, promptly and seriously implement post-oversight recommendations; clearly identify reasons and responsibility of each agency, organization or individual for failure to implement or properly implement such recommendations and report implementation results to the National Assembly and National Assembly Standing Committee.

The National Assembly Standing Committee, Government, Central Committee of the Vietnam Fatherland Front, Supreme People’s Court, Supreme People’s Procuracy, State Audit Office of Vietnam, the National Assembly’s agencies, deputy delegations and deputies, and related agencies, organizations and individuals shall, within the ambit of their assigned functions and tasks, coordinate with one another and organize the implementation of this Resolution.

This Resolution was adopted by the 15^th National Assembly of the Socialist Republic of Vietnam on June 6, 2022, at its 3^rd session.
