RESOLUTION

Promulgating the Plan on implementation of the National Assembly’s Resolution No. 189/2025/QH15 on a number of special mechanisms and policies for investment in the construction of the Ninh Thuan nuclear power project^[1]

THE GOVERNMENT

Pursuant to the February 18, 2025 Law on Organization of the Government;

Pursuant to the November 29, 2024 Law on Investment;

Pursuant to the November 30, 2024 Law on Electricity;

Pursuant to the June 18, 2014 Law on Construction, and the June 17, 2020 Law Amending and Supplementing a Number of Articles of the Law on Construction;

Pursuant to the June 27, 2025 Law on Atomic Energy;

Pursuant to the National Assembly’s Resolution No. 174/2024/QH15 of November 30, 2024, on the 8^th session of the 15^th National Assembly;

Pursuant to the National Assembly’s Resolution No. 189/2025/QH15 of February 19, 2025, on a number of special mechanisms and policies for investment in the construction of the Ninh Thuan nuclear power project;

Pursuant to the National Assembly’s Resolution No. 176/2025/QH15 of February 18, 2025, on the organizational structure of the Government during the 15^th National Assembly;

Pursuant to the Government’s Decree No. 39/2022/ND-CP of June 18, 2022, promulgating the Working Regulation of the Government;

At the proposal of the Minister of Industry and Trade,

RESOLVES:

Article 1. To promulgate together with this Resolution the Plan on implementation of the National Assembly’s Resolution No. 189/2025/QH15 on a number of special mechanisms and policies for investment in the construction of the Ninh Thuan nuclear power project.

Article 2. This Resolution takes effect on the date of its signing.

Article 3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, the Chairperson of the People’s Committee of Khanh Hoa province, and related agencies, organizations and individuals shall implement this Resolution.

PLAN

On implementation of the National Assembly’s Resolution No. 189/2025/QH15 on a number of special mechanisms and policies for investment in the construction of the Ninh Thuan nuclear power project

(Promulgated together with the Government’s Resolution No. 249/NQ-CP
of August 22, 2025)

In pursuance to the National Assembly’s Resolution No. 189/2025/QH15 of February 19, 2025, on a number of special mechanisms and policies for investment in the construction of the Ninh Thuan nuclear power project (below referred to as Resolution No. 189/2025/QH15), the Government promulgates the Resolution on the Plan on implementation of Resolution No. 189/2025/QH15 as follows:

I. Objectives, requirements

1. To institutionalize and implement in an adequate, strict and effective manner mechanisms and policies specified in Resolution No. 189/2025/QH15.

2. To ensure compliance with the National Assembly’s directions and requirements for the tasks assigned to the Government under Resolution No. 189/2025/QH15.

3. To concretize mechanisms and policies adopted by the National Assembly through guiding legal documents in order to have a complete legal framework, create favorable conditions for the implementation, and mobilize resources for implementation of the project.

4. To clearly specify the competence, responsibilities and schedule of task performance of ministries, sectors and localities.

II. SPECIFIC TASKS

1. To assign the project owner to implement the project.

2. To conclude treaties with partner countries for implementation of the Ninh Thuan 1 and Ninh Thuan 2 nuclear power projects:

a/ To approve the policy of negotiating treaties on the implementation of the Ninh Thuan 1 and Ninh Thuan 2 nuclear power projects with partners, as a basis for carrying out negotiations on the relevant agreements;

b/ To organize negotiations to complete the relevant order and procedures, and to proceed with the conclusion of treaties with partners on cooperation in construction investment of the Ninh Thuan 1 and Ninh Thuan 2 nuclear power plant projects;

c/ To organize negotiations to complete the relevant order and procedures, and to proceed with the conclusion of treaties with partners on cooperation in credit extension for the Ninh Thuan 1 and Ninh Thuan 2 nuclear power plant projects.

3. To coordinate with the International Atomic Energy Agency (IAEA) in evaluating and completing Vietnam’s nuclear power infrastructure according to IAEA standards; to accede to treaties on atomic energy.

4. To amend and complete regulations on nuclear power.

5. Organization of implementation of the project:

a/ To submit dossiers of request for approval of the adjustment of the project investment policy to competent authorities for consideration and approval;

b/ To appraise and submit to the Prime Minister for approval the investment project and the dossier for location approval;

c/ To appraise and approve dossiers and documents in the course of construction of the nuclear power plant;

d/ To organize the construction of the project and put it into operation.

6. To organize population relocation, resettlement and site clearance for the Ninh Thuan nuclear power project.

7. To carry out public communication about the project, ensuring consensus within the people.

8. To train nuclear power human resources.

9. To manage and use capital and resources in an economical and efficient manner; to prevent corruption, waste and other negative practices; to ensure national defense and security, social order and safety, radiation safety and environmental protection.

10. To establish a working team composed of representatives of the Ministry of National Defense, the Ministry of Public Security, the Ministry of Finance, the Government Inspectorate, the State Audit Office of Vietnam, and other related ministries and sectors to supervise the implementation in accordance with Point a, Clause 12, Article 3 of Resolution No. 189/2025/QH15.

Specific tasks of ministries, sectors and localities, and the deadlines for completion of related jobs, are provided in the Appendix to this Plan.

III. ORGANIZATION OF IMPLEMENTATION

1. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, the Chairperson of the People’s Committee of Khanh Hoa province shall, within the ambit of their functions and tasks, arrange adequate financial and human resources for the performance of the tasks assigned to them in this Plan; regularly urge and supervise the implementation to ensure timely and high-quality achievement of the Plan’s objectives and tasks; and periodically report implementation results to the Ministry of Industry and Trade (before May 31 and November 30 every year) for summarization and reporting to the Government and the Steering Committee for the construction of the nuclear power plant.

2. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with ministries, sectors and the People’s Committee of Khanh Hoa province in, monitoring and urging the implementation of this Plan; and promptly report and propose to the Prime Minister necessary measures to ensure the coordinated and effective implementation of this Plan.

3. In the course of implementation, if it is necessary to amend or supplement specific contents of this Plan to meet practical conditions, ministries, sectors and local authorities shall proactively submit proposals to the Ministry of Industry and Trade for summarization and reporting to the Prime Minister for consideration and decision.-
