RESOLUTION
On policies in the Law on legal documents
THE GOVERNMENT
Pursuant to the February 18, 2025 Law on Organisation of the Government;
Pursuant to the February 19, 2025 Law on Promulgation of Legal Documents; and the June 25, 2025 Law Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents;
Pursuant to the National Assembly Standing Committee’s Resolution No. 02/2026/UBTVQH16 of May 25, 2026, on adjustments to the 2026 law-making programme;
Pursuant to the Government’s Decree No. 78/2025/ND-CP of April 1, 2025, detailing a number of articles, and providing measures to organise and guide the implementation, of the Law on Promulgation of Legal Documents (which is amended and supplemented under Decree No. 187/2025/ND-CP of July 1, 2025);
Pursuant to the Government’s Decree No. 191/2026/ND-CP of May 29, 2026, promulgating the Government’s working regulations;
At the proposal of the Ministry of Justice in Document No. 130/TTr-BTP of July 24, 2026, on policies in the Law on legal documents and enclosed dossiers; Report No. 672/BC-BTP of August 7, 2026 and Report No. 684/BC-BTP of August 11, 2026, on assimiliation and explanation of opinions of the Government members on dossiers and policies in the Law on legal documents.
On the basis of the Government members’ votes,
RESOLVES:
Article 1. To adopt 5 policies in the Law on legal documents stated in the Ministry of Justice’s Document No. 130/TTr-BTP of July 24, 2026, of which opinions of the Government members were assimilated and explained under Report No. 672/BC-BTP of August 7, 2026 and Report No. 684/BC-BTP of August 11, 2026, specifically as follows:
- Policy 1: Streamlining the system of legal documents.
- Policy 2: Continuing to clearly define the competence regarding the content on promulgation of legal documents for each entity, the scope of content between laws and other legal documents, and the contents that need to be provided in legal documents.
- Policy 3: Continuing to innovate the procedures for compilation and promulgation of legal documents in a flexible, timely, effective and controlled manner, accelerating the institutionalisation of the Party’s guidelines and directions into laws.
- Policy 4: Closely linking the making and organisation of implementation of laws, improving the mechanism for interpreting the Constitution and laws, guiding the application of legal documents, and formulating a mechanism for evaluating legal documents after they are promulgated.
- Policy 5: Developing a mechanism to improve the quality of personnel involved in policy and law making advisory work; enhancing professionalism in drafting legal documents and organising the implementation thereon.
Article 2. The Ministry of Justice shall assume the prime responsibility for, and coordinate with related ministries and agencies in, continuing reviewing and thoroughly assessing the impact of policies to ensure the feasibility, consistency and synchronism of the legal system and improve the content of policies, in which focus shall be placed on researching and reforming the law-making process toward enhancing the actual quality of policies and draft documents, ensuring interconnection between the policy making and drafting process, avoiding the creation of additional hierarchies, procedures and duplicate dossiers; better clarifying the responsibilities of the heads of agencies in charge of policy quality; accelerating the digitalisation and efficiently applying artificial intelligence in the policy making and document drafting process; and researching for development of a unified electronic legislative dossier.
The Ministry of Justice shall promptly compile the draft Law on legal documents under regulations, and submit it to the Government in August 2026 to ensure the schedule for the Government’s report to the National Assembly Standing Committee.
Article 3. To assign Deputy Prime Minister Le Tien Chau to direct the compilation and completion of the draft Law on legal documents.
Article 4. This Resolution takes effect on the date of signing.
Article 5. The Minister of Justice and heads of related agencies shall implement this Resolution.
