Resolution No. 115/NQ-CP dated August 31, 2018 of the Government on implementation of a number of special policies on provision of assistance for Ninh Thuan province in socio-economic development, settlement of business and people’s life during 2018 – 2023

Pursuant to the Law on the Government Organization dated June 19, 2015;

Pursuant to Resolution No.31/2016/QH14 dated November 22, 2016 of the fourteenth National Assembly on termination of application of investment guidelines of the nuclear power project in Ninh Thuan;

Pursuant to Conclusion of the Politburo provided in Document No.956-CV/VPTW dated May 16, 2017 of the Office of Central Committee of the Communist Party of Vietnam on formulation of policies for provision of assistance for provinces with poor and seriously poor conditions;

At the request of Minister of Planning and Investment,

DECIDES:

Article 1.ThisResolution provides for implementation of certain special policies on provision of assistance for Ninh Thuan province in socio-economic development, settlement of business and people’s life during 2018 – 2023 with the following contents:

1. Policy on attracting investment

a) The Government accepts the proposal for development of Ninh Thuan province into a renewable energy centre of the whole country (wind power and solar power); make investment in Bac Ai pumped storage hydropower project; conduct a study on Ca Na combination of power and liquefied natural gas (LNG) in an appropriate scale and prioritize the synchronic construction of transmission grids, and integrate wind power and solar power projects into the national power grid. The Ministry of Industry and Trade shall take charge and cooperate with the Vietnam Electricity and People s Committee of Ninh Thuan province in implementation.

b) Suspension of titan extraction projects. To be specific:

- Areas with titan ores which are ineligible for extraction and may create an impact on the environment as specified in the Project on zoning, exploration, extraction, processing and use of titan ores up to 2020, with visions towards 2030 approved by the Prime Minister in the Decision No.1546/QD-TTg dated September 03, 2013 but are not licensed for exploration and extraction shall be considered the national reserve areas for the purpose of launching wind power and solar power projects, important fact mistake. The Ministry of Industry and Trade shall take charge and cooperate with relevant ministries and People s Committee of Ninh Thuan province in implementation.

- As for projects licensed for extraction, the People’s Committee of Ninh Thuan province shall reach an agreement with the investor on appropriate implementation methods in order not to exert any effect on the investment environment.

c) The Government accepts the proposal for seeking internal and external partners with the aim of making investment in Bac Ai pumped storage hydropower project. The Ministry of Industry and Trade shall take charge and cooperate with relevant ministries and People s Committee of Ninh Thuan province in implementation.

d) The Government concurs with the proposal to add Binh Tien - Vinh Hy and Ca Na – Mui Dinh tourist villages to the list of national tourist villages included in the general planning for development of Vietnam tourism up to 2020, with visions to 2030 according to Decision No.201/QD-TTg dated January 22, 2013 and Decision No.2350/QD-TTg dated December 24, 2014 of the Prime Minister. The Ministry of Culture, Sport and Tourism shall appraise the aforesaid proposal and send reports to the Prime Minister for ratification

dd) The Government concurs with the proposal to include Vinh Hai commune, Ninh Hai district into the list of communes with seriously poor conditions during 2018 – 2020 which is issued together with Decision No.131/QD-TTg dated January 25, 2017 of the Prime Minister. The Ministry of Labor, War Invalids and Social Affairs shall submit such proposal to the Prime Minister for ratification.

e) The Government concurs with the proposal that Ninh Thuan province may enjoy the feed-in tariffs as specified in Decision No.11/2017/QD-TTg dated April 11, 2017 of the Prime Minister until the end of 2020 as for projects on solar power and connection infrastructure with design capacity of 2,000MW approved by the Prime Minister. The Ministry of Industry and Trade shall preside over cooperate with the Vietnam Electricity and People s Committee of Ninh Thuan province in implementation.

2. Policy on provision of assistance in infrastructure investment for the purpose of climate change adaption

a) The Government concurs with the proposal for applying legally-accepted policy on provision of assistance for provinces of Central Highlands in infrastructure investment in industrial zones and clusters. The Ministry of Planning and Investment shall preside over and cooperate with the Ministry of Planning and Investment in implementation.

b) The Government concurs with the proposal to apply the on-lending rate of 10% to a number of important and high-priority new investment projects funded by ODA loans in Ninh Thuan province which are included in programs or projects on investment in infrastructure and social welfare or other fields that are incapable for recovering of a full amount of invested capital. The Ministry of Finance shall preside over and cooperate with relevant agencies in implementation as regulated.

c) The Government concurs with the proposal that the central government budget will allocate 100% reciprocal capital for ODA-funded development projects launched in Ninh Thuan provinces.

d) With regard to use of provision for midterm public investment plans during 2016 - 2020 to assist Ninh Thuan province in implementing some important and high-priority projects such as project on improving and extending national highway 27 (12-km section), payment of invested capital of the coastal road project (VND 225 billion) and investment made in Tan Giang - Song Bieu inter-reservoirs project, the Ministry of Planning and Investment shall preside over and cooperate with the Ministry of Finance in consolidating plans for use of provision for midterm public investment plans during 2016 – 2020 and submit them to the Prime Minister before sending such plan to the Standing Committee of National Assembly as regulated.

dd) The Ministry of Transport shall preside over and reach an agreement with People’s Committee of Ninh Thuan province on the size of Ca Na general port included in the national port system planning up to 2020, with visions to 2030 with the aim of satisfying the socio-economic development requirement of Ninh Thuan province.

e) The Government concurs with the proposal for allocation of partial funding provided for six important and high-priority projects suggested by the government authority of Ninh Thuan province included in midterm public investment plans during 2021 – 2025. According to rules, criteria and restrictions regarding the allocation of investment capital and funding from state budget during 2021 - 2025 approved and issued by the National Assembly and the Government, and capacity of funding balance, assign the Ministry of Planning and Investment to preside over and cooperate with the Ministry of Finance in sending consolidated reports to the Prime Minister for consideration and ratification purpose impossible failure revoke.

g) The Government accepts the proposal to prioritize investment in facility and equipment for Nong Lam University – Ninh Thuan Campus in Ho Chi Minh City.

3. Social security policy

a) The Government consents to create favorable conditions and offer jobs to student studying nuclear technology overseas after they graduate and return to Vietnam which are included in the scheme on training and development of nuclear power manpower specified in Decision No.1558/QD-TTg dated August 18, 2010 of the Prime Minister. The Ministry of Education and Training shall preside over and cooperate with the Ministry of Science and Technology, Vietnam Electricity and People’s Committee of Ninh Thuan province in implementation.

b) The Ministry of Agriculture and Rural Development shall:

- preside over and cooperate with relevant agencies in submitting the proposal to the Prime Minister for including additional high-tech industrial zones and clusters of Ninh Thuan province in the nationwide general planning up to 2020, with visions towards 2030 when making adjustment to Decision No.2020, 575/QD-TTg dated May 04, 2015 of the Prime Minister.

- immediately make investment in construction of works included in Tan My irrigation system project and apply guidelines from the Prime Minister provided in Document No.1998/TTg-NN dated December 28, 2017 on transferring the project on Quan The economic zone for industrial salt and salt for export to People s Committee of Ninh Thuan province for management purpose.

c) The Ministry of Science and Technology shall preside over and cooperate with the Ministry of Agriculture and Rural Development in studying, applying and renovating technology to develop key products of Ninh Thuan province in agriculture - forestry - fishery and processing industry into high-qualified, large-scale and competitive products in the market for the purpose of meeting domestic consumption and export requirements.

d) The People s Committee of Ninh Thuan province shall:

- prepare Ninh Chu national tourist village planning which identifies Ninh Chu as the central tourist village and adds Binh Tien – Vinh Hy and Ca Na – Mui Dinh tourist villages to the list of the national tourist village and prepare a scheme on proposal of addition of Binh Tien - Vinh Hy and Ca Na - Mui Dinh tourist villages sent to the Ministry of Culture, Sport and Tourism for appraisal purpose then send such scheme to competent authorities for approval as regulated;

- cooperate with relevant agencies in making investment in the Project on Tan Giang and Song Bieu inter-reservoirs in accordance with provisions of the soft law in force;

- submit the plan for settlement of business and people s life and development of residential areas suitable for locations of previous planning for construction of Ninh Thuan 1 and 2 nuclear power plants;

- proactively cooperate with relevant ministries in implementing policies herein.

Article 2. Effect

1. This Resolution takes effect on the signing date.

2. Ministers, Directors of ministerial agencies, Governmental agencies, Director of Vietnam Electricity and Chairman of People s Committee of Ninh Thuan province shall implement this Resolution./.
