GUIDANCE ON CONCERNING THE ASSESSMENT OF THE DESIGNS OF PROJECTS WITH FOREIGN INVESTMENT CAPITAL IN VIETNAM

In order to implement the assessment of the designs of projects with foreign investment capital in Vietnam in accordance with the Circular "Instruction on the management of construction of projects with foreign investment capital in Vietnam" number 02BXD/QLXD of 26 January 1993 by the Ministry of Construction and to simplify the procedures of foreign investment, the Ministry of Construction hereby stipulates the following:

1/ The division of levels of responsibility to assess the design shall be carried out in accordance with the provisions of Circular 02/BXD-QLXD of 26 January 1993 and Document number 894/BXD-GD of 21 July 1993 by the Ministry of Construction.

2/ The levels of responsibility to assess the design shall establish the councils for design assessment consisting of agencies in charge of management of planning, architecture and environment, agencies in charge of management of the quality of the construction project and agencies in charge of fire prevention and extinguishment. The Council shall select a permanent organ to receive files, organize assessment and draft the document of conclusion for the chairman of the Council.

3/ The file submitted to the agency in charge of assessment of design of the Vietnamese State shall have three sets, each set comprises:

- Certificate of the legal personality of the designing organ (including the registrations of business operation and insurance issued and certified by the local authorities.

- Dossier of technical design comprise:

+ Drawing of design: Architecture, technology, platform, foundation, structure, water supply, water sewage, electricity supply, environment, ecology, fire prevention, fire extinguishment, explosion prevention.

+ Technical Explanation and specific calculation of the above-mentioned issues (the list of applicable criteria of design, methods of calculation and results of calculation).

+ Report on the geological surveys of the project site, hydrological geology, data of trans.-criteria or trans.-static's (if the piling foundation is used).

+ Conditions and technical solutions to ensure the stability of the surrounding project and to guarantee the safety in the construction.

- License of investment granted by the State Committee for Cooperation and Investment.

- Document certifying the right to land use (the Decision to allocate land or certificate of the right to land use attached by the excerpted map of the allocated land area in the rate of 1 to 2000).

- Document of approval regarding the planning and architecture by the Chief Architect of City directly under the central administration or the direction of the provincial construction department.

4/ The content and duration of assessment shall be implemented in conformity with Circular number 02/BXD-QLXD.

5/ The project shall be granted permit license of construction and begin the construction only after the dossier of technical design has been assessed.

6/ The expenses of assessment shall be carried out in accordance with the instruction of the finance- Construction Inter - Ministerial Circular.

This document shall replace document number 68/BXD-GD of 13 January 1994 by the Ministry of Construction.
