Official Dispatch No. 397/NHNN-TTGSNH dated January 14, 2010 of the State Bank of Vietnam making plan of charter capital increase in the fiscal year 2010

In order to ensure the implementation of charter capital increase schedule by credit institutions (CI) in accordance with provisions in the Decree No. 141/2006/ND-CP dated 22/11/2006 of the Government on the issuance of List of legal capital levels applicable to CIs (Decree 141), the Governor of the State Bank hereby requires your good unit:

1. To promptly make a plan of capital increase in the fiscal year 2010 and submit to competent levels for approval in accordance with current provisions (which clearly states progress of capital increase and solutions for the case where CIs fail to reach this level of capital).

2. To give written notice to the Governor of the State Bank by 31/3/2010 at the latest (Banking Inspection, Supervision Department) about the increase of charter capital of your unit, which specifically states:

- Result of capital increase performance in 2009

- Plan of charter capital increase in 2010 of your unit as stated in point 1 of this Official Dispatch.

- Recommended solutions for cases where the stipulated capital level is not ensured.

3. It is requested for units which have received this Official Dispatch to seriously implement and make report to the Governor of State Bank in due course.
