THE MINISTRY OF CONSTRUCTION

Official Dispatch No. 182/BXD-KTXD dated October 07, 2011 of the Ministry of Construction guiding the adjustment of the contract form

To: Urban Infrastructure Development Investment Corporation (UDIC)

On answering the Document No. 746/CV/TCT dated September 07, 2011 of the Urban Infrastructure Development Investment Corporation (UDIC) on forms of signing contracts, the Ministry of Construction has opinions as follows:

In accordance with regulations at Article 5 of the Decree No. 48/2010/ND-CP dated May 7, 2010 of the Government on contracts in construction activities, parties to a construction contract shall strictly comply with the contract's provisions on scope of jobs, requirements on quality, quantity, category, deadline and mode, and other agreements in the contract. Therefore, parties involved in the construction contract are not allowed to change forms of contracts,

The contracts which have regulations on adjustment of labors and construction machines in accordance with Corporation’s fixed unit price shall implement due to signed contract’s contents. The Ministry of Construction is now reporting the Prime Minister on adjusting charge of materials in the time of having price fluctuation from January 01, 2011. After receiving directives from the Prime Minister, the Ministry of Construction will have specific guidance.

Basing on above opinions, Urban Infrastructure Development Investment Corporation (UDIC) shall implement in accordance with regulations./.
