The Official Dispatch No. 1104/BXD-KTXD dated June 27, 2011 of the Ministry of Construction adjusting price unit in the contract when price of materials and fuel have great fluctuation
To: Ninh Thuan Department of Construction
On answering the Official Dispatch No. 978/SXD-QLXD dated June 07, 2011 of Ninh Thuan Department of Construction adjusting price unit in the contract when price of materials and fuel have great fluctuation, the Ministry of Construction has opinion as following:
The Circular No. 104/2008/TT-BTC dated November 13, 2008 of the Ministry of Finance guiding the implementation of price valorization regulates the “abnormal fluctuations” for list of goods and services under state management, and some major materials and fuel in construction sector are included. Therefore, investors and contractors must base on guidance on the Circular No. 104/2008/TT-BTC to report to the authorized person to consider, decide in the case that price of materials and fuel have great valorizations (abnormal fluctuations) in adjusting contract price in accordance with regulations.
The Ministry of Construction has answer as above, Ninh Thuan Department of Construction can apply basing on above guidance./.
