Urgent assurance of benefits for beneficiaries under Decree No. 178

This matter is stated in Official Dispatch No. 13921/BTC-NSNN regarding difficulties and obstacles in implementing the payment of benefits and policies under Decree No. 178/2024/ND-CP and Decree No. 67/2025/ND-CP.

Official Dispatch No. 13921/BTC-NSNN of the Ministry of Finance points out difficulties and obstacles in implementing the payment of benefits and policies for officials, public employees, and workers taking early retirement under the above-mentioned decrees.

If these obstacles are not resolved in a timely manner, they will directly affect the lawful rights and interests of officials, public employees, and workers.

Assurance of benefits for beneficiaries under Decree No. 178

Three major groups of issues were identified in the Official Dispatch:

Firstly, beneficiaries who received retirement or resignation decisions before August 31, 2025, and whose employing units were already allocated budget estimates for benefit payments. However, their payment dossiers were submitted to the State Treasury after September 1, 2025, leaving no legal basis for disbursement.

Secondly, beneficiaries who received retirement or resignation decisions before August 31, 2025, but due to delays in the allocation of budget estimates, by the time sufficient grounds for payment were available, the statutory deadline had already passed, preventing the State Treasury from making disbursements.

Thirdly, beneficiaries who received retirement or resignation decisions before August 31, 2025, but whose effective retirement/resignation dates extend until December 31, 2025.

This raises the question of when the State Treasury should make payment: on August 31, 2025, or on the official date of retirement/resignation. If payment is made on the official retirement date, does it violate the statutory deadline? If payment is made within the statutory deadline, is it consistent with the prescribed benefits, and how should the management of officials and employees be handled during the period until their official retirement?

Some of these issues were already mentioned in Official Dispatch No. 12888/BTC-KBNN dated August 21, 2025, of the Ministry of Finance and responded to in Official Dispatch No. 7212/BNV-TCBC dated August 28, 2025, of the Ministry of Home Affairs. However, these responses have not thoroughly resolved the arising problems.

In this context, the Ministry of Finance has requested the Ministry of Home Affairs to:

  • Urgently consolidate and report to the competent authorities for consideration and decision on appropriate handling measures to ensure benefits for beneficiaries in accordance with the law and to avoid complaints and lawsuits;

  • At the same time, based on the conclusions of the competent authorities, issue additional guidance to ensure uniform implementation.
