Notice No. 141/TB-VPCP: Continuing to suspend the implementation of Decree No. 46/2026/ND-CP on food safety

On March 20, 2026, the Office of the Government issued Notice No. 141/TB-VPCP stating the conclusions of the Permanent Government members on addressing difficulties and inadequacies of Decree No. 46/2026/ND-CP and Resolution No. 66.13/2026/NQ-CP on food safety.

 

Accordingly, Notice No. 141/TB-VPCP clearly states that the Permanent Government members reached the conclusions of extending the period of suspension of the effect of Decree No. 46 and Resolution No. 66.13 as prescribed in the Government’s Resolution No. 09/2026/NQ-CP dated February 04, 2026.

The extension period is until the Law on Food Safety (revised) and the Decree detailing the Law on Food Safety (revised) take effect.

Also in this Notice, the Ministry of Health shall assume primary responsibility for and coordinate with relevant ministries and agencies to urgently complete the Draft Law on Food Safety (revised), ensuring quality and timely submission to the National Assembly at the 2nd session of the 16th National Assembly.

At the same time, it is required to develop and finalize the Draft Decree detailing the Law on Food Safety (revised) and adequately prepare conditions for implementation concurrently with the formulation and submission of the Draft Law.

In addition, the Ministry of Health needs to strengthen the implementation of directing and governing measures to enhance the responsibility of regulatory authorities, improve the capacity, effectiveness, and efficiency of food safety management, and, in particular, strengthen inspection, post-inspection, and supervision to ensure food safety.

The Ministry of Health shall preside over and coordinate with the Ministries of Agriculture and Environment, Industry and Trade, Justice, and relevant ministries and agencies to urgently study and receive comments at the meeting, review, report, and submit to the Government before March 28, 2026, for consideration and promulgation of a Government Resolution.
