On June 30, 2022, the Ministry of Transport issues Circular No. 12/2022/TT-BGTVT providing the List of potentially unsafe products and goods subject to state management.
Accordingly, the Circular issues the List of potentially unsafe products and goods subject to certification before customs clearance (regarding import), or marketing (regarding manufacture and assembly), including:
- Tanker semi-trailers;
- Container trailers;
- Container semi-trailers;
- Crane lorries;
- Fire fighting vehicles;
- Concrete-mixer lorries;
- Spraying lorries;
- Motorcycles (including those with side-cars);
- Mopeds;
- Electric bicycles;
- Motorized bicycles, etc.
Besides, the Circular also prescribes also provides the List of products and goods subject to certification or announcement of technical regulation conformity as follows:
- Tractor-trailers;
- Shuttle buses used in airports;
- Limousine buses (for the transport of 10 or more persons, including the driver);
- Prison vans;
- Hearses;
- Motorcycles,
- Mopeds,
- Electric bicycles
- Motorized bicycles for disabled persons.
Such products and goods must be registered for the state inspection in terms of quality.
In case HS codes specified in these Lists are different from those specified in Vietnam’s nomenclature of exports and imports promulgated by the Ministry of Finance, the HS codes promulgated by the Ministry of Finance shall prevail.
For imported products and goods of which the date of arriving ports or border gates, or the date of opening the import declaration as prescribed by the Customs Law; and assembled products and goods of which the date of manufacture is before August 15, 2022, the list of potentially unsafe commodities under the management of the Ministry of Transport in the Circular No. 41/2018/TT-BGTVT shall be applied.
Circular 12 takes effect on August 15, 2022.
