Guidelines on weekly minimum wage levels

On June 17, 2022, the Ministry of Labor, Invalid and Social Affairs and the General Confederation of Labor issued the Official Dispatch No. 2086/BLDTBXH-TLDLDVN on the implementation of the Decree No. 38/2022/ND-CP on minimum wages.

On the implementation of the Official Dispatch No. 38/2022, the Official Dispatch 2086 prescribes that:

For workers who are paid on a daily or weekly basis, or who are paid based on piece work or products turned out, their salary, when converted into the monthly or hourly rate, must not be lower than the monthly or hourly minimum wage level prescribed by laws.

The conversion of monthly or hourly wage levels is chosen by employers. At the same time, the Decree does not require payment methods between employers and employees to be changed.

Besides, the Official Dispatch 2086 requires the employers to investigate all the agreements in the contracts, collective labor agreement,s and regulations, and principles of employers to have suitable adjustment and supplementation.

Do not remove or reduce wage when employees work overtime, work at night, or perquisites, or other benefits in accordance with law provisions.

For agreed contents or commitments in labor contracts, labor agreements or other legal agreements, that bring more benefits for employees compared to provisions provided the Decree 38/2022, shall continue to be implemented, unless otherwise agreed by both parties.
