From September 15, 2026, foreign nationals' data to be shared and synchronized in real time

Decree No. 286/2026/ND-CP introduces new provisions on data sharing and electronic data interoperability in the management of the entry, exit, transit, and residence of foreign nationals.

Under Article 7 of Decree No. 286/2026/ND-CP, the Ministry of Foreign Affairs must update data on foreign nationals who are granted visas or temporary residence cards to the National Immigration Database immediately after such documents are issued. Where technical infrastructure is not yet available, the Ministry must transfer the list of eligible foreign nationals to the immigration authority within five working days from the date of issuance.

At the same time, ministries, ministerial-level agencies, and provincial-level People's Committees are required to direct their competent authorities to share and integrate data related to administrative procedures involving foreign nationals. Such data sharing is intended to facilitate the issuance of entry and exit documents or other documents evidencing lawful residence.

In addition, Clause 5, Article 8 of Decree No. 286/2026/ND-CP requires the exchange and provision of information, documents, statistics, and data between the Ministry of Public Security and the Ministry of National Defense to be conducted regularly, continuously, promptly, and in real time, ensuring effective control over the entry, exit, and transit of foreign nationals. Article 9 also introduces a mechanism for exchanging temporary residence declaration data between the two ministries in border areas.

Meanwhile, Decree No. 64/2015/ND-CP only required notification, the transfer of lists, or the exchange of information among competent authorities. It did not provide for updating information to the National Immigration Database, electronic data sharing, interoperability of administrative procedures, or, in particular, real-time data exchange.
