Foreign organizations and individuals recruiting Vietnamese workers must post recruitment information on the National Job Trading Exchange

This is a notable provision of Decree No. 371/2026/ND-CP, issued on September 25, 2026, detailing the recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam.

Specifically, Article 6 of Decree No. 371/2026/ND-CP provides:

Article 6. Recruitment of Vietnamese workers working for foreign organizations and individuals in Vietnam

1. When wishing to recruit Vietnamese workers, foreign organizations and individuals shall notify the agencies or organizations managing Vietnamese workers specified in Article 5 of this Decree in writing, directly, by postal service, or online via the official email addresses of such agencies or organizations. The notice shall clearly state the job positions and the number of workers to be recruited. At the same time, foreign organizations and individuals shall publicly post information on the recruitment of Vietnamese workers on the National Job Trading Exchange (at https://www.vieclam.gov.vn), another lawful employment portal, or the organization’s official website.

2. Foreign organizations and individuals may recruit Vietnamese workers by themselves or request the agencies or organizations managing Vietnamese workers specified in Article 5 of this Decree to assist in recruiting Vietnamese workers.

3. Upon receiving a request from a foreign organization or individual, the agency or organization managing Vietnamese workers specified in Article 5 of this Decree shall select and recommend candidates based on the job description provided.

Accordingly, when wishing to recruit Vietnamese workers, foreign organizations and individuals must send a written notice of their recruitment needs to the agency or organization managing Vietnamese workers as prescribed by law.

The notice may be delivered directly, by postal service, or online via the agency’s or organization’s official email address. It must clearly state the job positions and the number of workers to be recruited.

Notably, in addition to giving notice of their recruitment needs, foreign organizations and individuals must publicly post information on the recruitment of Vietnamese workers on the National Job Trading Exchange at https://www.vieclam.gov.vn, another lawful employment portal, or the organization’s official website.

Thus, when recruiting Vietnamese workers, foreign organizations and individuals must both notify the competent agency or organization managing Vietnamese workers of their recruitment needs and publicly post recruitment information on the National Job Trading Exchange or one of the other lawful channels permitted by the Decree.

In addition, Clause 2, Article 6 of Decree No. 371/2026/ND-CP provides that foreign organizations and individuals may recruit Vietnamese workers by themselves or request the agency or organization managing Vietnamese workers specified in Article 5 of the Decree to assist in recruitment.

Upon receiving such a request, the agency or organization managing Vietnamese workers shall select and recommend candidates based on the job description provided by the foreign organization or individual.

Decree No. 371/2026/ND-CP takes effect on November 15, 2026.
