Law No. 22/2026/QH16 Amending and Supplementing a Number of Articles of the Law on Vietnamese Guest Workers was passed on August 24, 2026, by the XVIth National Assembly.
Point b, Clause 6, Article 1 of the 2026 Law Amending and Supplementing a Number of Articles of the Law on Vietnamese Guest Workers, No. 22/2026/QH16, which adds Clause 1a after Clause 1, Article 10 of the 2020 Law on Vietnamese Guest Workers, No. 69/2020/QH14, provides:
1a. If the license of an enterprise has been revoked under Point a, d or dd, Clause 2, Article 16 of this Law, its at-law representative may not, within 5 years from the date of issuance of the license revocation decision, act as the at-law representative of an enterprise granted a license; an enterprise whose license has been revoked under Point a, d or dd, Clause 2, Article 16 of this Law may not, within 5 years from the date of issuance of the license revocation decision, be granted a license.
Accordingly, an enterprise whose license has been revoked in one of the specified cases may not be granted a license within 5 years from the date of issuance of the license revocation decision. At the same time, the at-law representative of an enterprise whose license has been revoked in any of these cases may not act as the at-law representative of an enterprise granted a license for the same period.

The 5-year restriction on the grant of a license applies to an enterprise whose license is revoked under Point a, d or dd, Clause 2, Article 16 of the Law on Vietnamese Guest Workers. Specifically, Clause 2, Article 16 of Law No. 69/2020/QH14 provides for license revocation when an enterprise commits a violation in a case prescribed by law, including:
- Declaring false information in the dossier of application for a license;
- Violating the provisions on prohibited acts in the field of Vietnamese guest workers;
- Failing to fully perform certain obligations of a service enterprise, thus causing serious material or spiritual harm to workers.
In addition, Law No. 22/2026/QH16 amends and supplements the conditions for the grant of licenses for the provision of services of sending Vietnamese workers abroad as guest workers, to strengthen the requirements on the capacity and responsibility of service enterprises.
