LuatVietnam has published the full text of Government Decree No. 371/2026/ND-CP, detailing the recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam. The Decree takes effect on November 15, 2026.
According to Article 2 of Decree No. 371/2026/ND-CP, the Decree applies to:
- Vietnamese workers working for foreign organizations and individuals in Vietnam;
- Foreign organizations and individuals in Vietnam;
- Organizations competent to recruit and manage Vietnamese workers;
- Labor leasing enterprises supplying workers to foreign organizations and individuals.
Article 6 of Decree No. 371/2026/ND-CP specifies the recruitment of Vietnamese workers working for foreign organizations and individuals in Vietnam.
When wishing to recruit workers, foreign organizations and individuals must send a written notice of their recruitment needs directly, by postal service, or online via the official email address of the agency or organization managing Vietnamese workers, as prescribed. The notice must clearly state the job positions and the number of workers to be recruited.
Foreign organizations and individuals must also publicly post information on the recruitment of Vietnamese workers on the National Employment Exchange (https://www.vieclam.gov.vn), another lawful employment portal, or the organization’s official website.
Foreign organizations and individuals may recruit Vietnamese workers by themselves or request the managing agency or organization to assist in selecting and recommending Vietnamese workers. Upon receiving such a request, the managing agency or organization selects and recommends candidates who meet the requirements for the job positions.
In addition to recruitment, Article 7 of the Decree provides for responsibilities in managing workers. Within 10 working days after signing a labor contract, the Vietnamese worker and the foreign organization or individual must notify the managing agency or organization in writing, as prescribed. When the labor contract is terminated, they must also give notice within 10 working days after its termination.
Decree No. 371/2026/ND-CP was issued on September 25, 2026, and takes effect on November 15, 2026. From that date, the provisions on the recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam in Decree No. 152/2020/ND-CP, as amended and supplemented by Decree No. 70/2023/ND-CP, cease to be effective.
