On September 23, 2026, the Government issued Decree No. 365/2026/ND-CP on rice export and import business. This Decree takes effect on October 1, 2026.
According to Article 3 of Decree No. 365/2026/ND-CP, Vietnamese traders of all economic sectors may engage in rice export business if they satisfy the prescribed conditions and are granted a Certificate of Eligibility for Rice Export Business.
For foreign direct investment enterprises, enterprises may engage in rice export business upon being granted the Certificate and must comply with this Decree, relevant Vietnamese laws, and Vietnam's commitments under treaties to which Vietnam is a contracting party.
Traders exporting organic rice, parboiled rice, or rice fortified with micronutrients are not required to satisfy the business conditions specified in Clause 1, Article 4, obtain a Certificate of Eligibility for Rice Export Business, maintain circulating reserves, or fulfill the reporting requirements as prescribed.
Regarding business conditions, Article 4 provides that traders established and registered for business in accordance with law may engage in rice export business if they have at least one specialized warehouse for storing paddy and rice and one rice milling facility that satisfy regulations on food safety, standards, and technical regulations.
The warehouse and rice milling facility may be owned by the trader or leased from another organization or individual. In the case of leasing, the trader must have a written lease agreement in accordance with law and ensure that the lease term covers the validity period of the Certificate.
In addition, a trader that has been granted a Certificate may not lease out to another trader the specialized warehouses for storing paddy and rice and rice milling facilities specified in the Certificate issued by the Ministry of Industry and Trade for such other trader to use as a basis for applying for a Certificate.
Regarding import activities, traders engaged in rice import business must notify the Ministry of Industry and Trade of their rice import plans.
