On July 15, 2026, the Government issued Decree No. 283/2026/ND-CP prescribing administrative penalties in the fields of labor, social insurance, and Vietnamese guest workers working abroad under contracts.

Decree No. 283/2026/ND-CP comprehensively provides for violations, penalty levels, additional penalties, remedial measures, as well as the authority to prepare records of administrative violations and impose penalties for violations arising in the fields of labor, social insurance, and the sending of Vietnamese guest workers to work abroad under contracts.

Decree 283/2026/ND-CP on administrative penalties

The Decree applies to employers, employees, enterprises, organizations, and individuals committing violations; persons authorized to prepare records of administrative violations and impose administrative penalties; and relevant agencies, organizations, and individuals. Under the Decree, the principal forms of penalties are warnings or monetary fines. Depending on the nature and severity of a violation, additional penalties and remedial measures may also be imposed in accordance with the regulations.

Decree No. 283/2026/ND-CP serves as the new legal basis for handling violations in the fields of labor, social insurance, and the sending of Vietnamese guest workers to work abroad under contracts, thereby contributing to enhancing the effectiveness of state management and safeguarding the lawful rights and interests of parties to labor relations.
