The Employment Law 2025 (No. 74/2025/QH15), effective from January 1, 2026, retains the method of calculating unemployment allowance but introduces a maximum cap and revises the benefit duration.
According to Clauses 1 and 2, Article 39 of the 2025 Employment Law:
The monthly unemployment allowance is equal to 60% of the average monthly wage on which unemployment insurance premiums were based for the six most recent months prior to unemployment.
The allowance amount shall not exceed five times the region-based minimum wage applicable in the month preceding the unemployment month.

The benefit duration is determined as follows:
12 full months to under 36 months of unemployment insurance contribution: 03 months of allowance;
For every additional 12 months of contribution, 01 additional month of allowance;
Maximum duration: 12 months.
The allowance shall commence from the 11th working day after the date of submission of a complete application dossier (Clause 3, Article 39).
