Cases in which no contract for performing civil servant tasks shall be signed from July 1, 2025

Decree No. 173/2025/ND-CP on contracts for performing civil servant tasks, issued on June 30, 2025, specifies cases where no such agreements shall be signed.

Article 7 of Decree No. 173/2025/ND-CP (effective from July 1, 2025) sets out the following cases:

(1) Contracts shall not be signed in the following cases:

  • The person is currently a cadre, civil servant, public employee, or serving in the armed forces or cipher organization;

  • The person is subject to a professional ban, under criminal investigation, or serving a sentence under a decision of a competent authority;

  • The person has family relations with the person competent to sign the contract, including: spouse, biological father or mother; father or mother of the spouse; adoptive father or mother; biological or adopted child; siblings; paternal or maternal uncle, aunt; siblings of the spouse; or spouse of any of the aforementioned persons.

(2) Contracts shall not be signed to perform the following types of tasks:
  • State management tasks of a regular and continuous nature;

  • Tasks not falling under the functions, duties, or powers of the agency, organization, or unit;

  • Tasks where contract performance may give rise to conflicts of interest, or affect objectivity, transparency, or integrity in public service activities;

  • Tasks related to national defense, national security, internal political security, counter-terrorism, counterintelligence, protection of state secrets, or other tasks deemed confidential and critical.

In truly necessary cases where a contract must be signed to perform such tasks, prior agreement must be obtained from the Ministry of Public Security and the Ministry of National Defense before implementation.
