Cases eligible for streamlined contractor selection from August 4, 2025

Decree No. 214/2025/ND-CP detailing a number of Articles and implementation measures of the Law on Bidding regarding contractor selection, which takes effect on August 4, 2025, sets out specific cases eligible for streamlined contractor selection.

According to Decree No. 214/2025/ND-CP, streamlined contractor selection (streamlined direct contracting) may be applied in the following cases and procedures:

(1) Special and urgent cases:

For bidding packages as prescribed in Clause 1, Article 78 of Decree No. 214/2025/ND-CP — such as those requiring immediate implementation to remedy consequences of natural disasters or epidemics, ensure state secrecy, or for reasons of national defense and security — it is not required to meet the conditions specified in Article 79 of the Decree.

(2) Other common cases, including bidding packages under:

  • Clauses 2, 3, and 4, and Points a and b, Clause 5, Article 78, such as:

    • Only one contractor is capable of meeting the requirements;

    • Procurement of goods or services of a specific nature;

    • Procurement from a contractor who has previously performed a similar contract effectively;

Cases eligible for streamlined contractor selection

In these cases, the conditions specified in Clause 2, Article 79 must be satisfied, including:
  • A valid proposal dossier;

  • Compliance with technical requirements;

  • Proposed bid price not exceeding the approved package price.

According to Article 80 of Decree No. 214/2025/ND-CP, the procedure for streamlined contractor selection includes:

  • Preparing and sending the draft contract:
    The project owner shall prepare and send a draft contract to the proposed contractor, clearly stating the work requirements, timeline, quality, value, etc.

  • Contractor’s preparation of the proposal dossier:
    The contractor must meet the requirements under the Law on Bidding concerning capacity, experience, and legal status.

  • Evaluation, negotiation, and proposal for award:
    If the proposal dossier is valid, meets the requirements, and the price is appropriate, the contractor shall be proposed for contract award.

  • Approval and disclosure of the results:
    Appraisal may be waived if not required, but public disclosure must comply with regulations.

  • Finalization, signing, and management of the contract:
    The contract must conform to the approved decision, proposal dossier, and related documents.
