On June 21, 2022, Ho Chi Minh Social Insurance Agency issues the Official Dispatch No. 3288/BHXH-QLT prescribing guidelines on implementation of contributions to social insurance, health insurance, unemployment insurance, occupational accident and disease insurance from July 01, 2022.
Accordingly, the Official Dispatch 3288 requires the employers to investigate all the agreements in the contracts, collective labor agreement and regulations and principles of employers to have suitable adjustment and supplementation.
Employers review and make adjustments to minimum wage levels in wage scales, payrolls in the principle of not lower than the minimum wage levels prescribed at Decree No. 38/2022/ND-CP.
On such basis, they shall adjust salaries, wages stated in labor contracts as the basis for making contributions to social insurance, health insurance, unemployment insurance and occupational accident and disease insurance for each laborer in accordance with the set scales, payrolls.
By July 25, 2022 at the latest, employers have to submit the applications for adjustments to salaries as the basis for paying social insurance, health insurance, unemployment insurance and occupational accident and disease insurance according to the new minimum wage levels (if any).
If the employers fail to make adjustments after the deadline, social insurance agencies will temporarily adjust the salaries as the basis for paying social insurance, health insurance, unemployment insurance and occupational accident and disease insurance equaling to the minimum wage levels until the employers submit the applications for adjustments as prescribed.
