Decree No. 283/2026/ND-CP of the Government prescribing penalties for administrative violations in the fields of labor, social insurance, and Vietnamese employees going to work abroad under contracts, issued on July 15, 2026, introduces several new penalties applicable to employment service enterprises in relation to the National Employment Exchange.

Penalties | Acts of violations |
From VND 1 million to VND 3 million | - Failing to report the employment service activities of the enterprise or its branch to the provincial-level Department of Home Affairs through the National Employment Exchange. |
From VND 3 million to VND 5 million | - Failing to update recruitment results on the National Employment Exchange within 20 working days from the date the employer notifies that an employee has been recruited. |
From VND 5 million to VND 10 million | - Failing to notify the provincial-level Department of Home Affairs through the National Employment Exchange before commencing or terminating employment service activities within the prescribed time limit. |
Currently, Decree No. 12/2022/ND-CP mainly provides for obligations relating to reporting, written notification, and the management of employment service activities. It does not contain provisions on data connectivity and sharing, information updates, or the implementation of procedures through the National Employment Exchange.
