A fine of up to VND 10 million for violations related to the National Employment Exchange from September 10, 2026

Decree No. 283/2026/ND-CP of the Government prescribing penalties for administrative violations in the fields of labor, social insurance, and Vietnamese employees going to work abroad under contracts, issued on July 15, 2026, introduces several new penalties applicable to employment service enterprises in relation to the National Employment Exchange.

Under Article 9 of Decree No. 283/2026/ND-CP, from September 10, 2026, employment service enterprises are required to fulfill various obligations relating to the National Employment Exchange. Failure to comply will be subject to penalties depending on the nature and severity of the violation.

Penalties

Acts of violations

From VND 1 million to VND 3 million

- Failing to report the employment service activities of the enterprise or its branch to the provincial-level Department of Home Affairs through the National Employment Exchange.
- Failing to notify the provincial-level Department of Home Affairs in writing or through the National Employment Exchange of the assignment of tasks to a branch or any change in the branch's location within the prescribed time limit.

From VND 3 million to VND 5 million

- Failing to update recruitment results on the National Employment Exchange within 20 working days from the date the employer notifies that an employee has been recruited.
- Failing to establish, update, and manage data on employees and employers, or failing to connect to and share data in accordance with the guidance of the Ministry of Home Affairs.
- Failing to ensure the safety and security of personal data, employee data, employer data, and employment transaction data.
- An enterprise providing employment services via e-commerce failing to connect to, share, and synchronize information and data with the National Employment Exchange after satisfying the prescribed conditions.

From VND 5 million to VND 10 million

- Failing to notify the provincial-level Department of Home Affairs through the National Employment Exchange before commencing or terminating employment service activities within the prescribed time limit.
- Failing to fully disclose information on employment service activities through the mass media as prescribed.

 

Currently, Decree No. 12/2022/ND-CP mainly provides for obligations relating to reporting, written notification, and the management of employment service activities. It does not contain provisions on data connectivity and sharing, information updates, or the implementation of procedures through the National Employment Exchange.
