What are the new legal policies applicable on October 2022? Please review the significant regulations in the bulletin as follows:

Hot policies take effect on OctoberThis is one of the important contents prescribed in Decree No. 59/2022/ND-CP which takes effect on October 20, 2022.

In accordance with Article 12, Decree 59/2022/ND-CP, electronic identification accounts are classified into 02 levels with different information and usage values.

* Level-1 electronic identification accounts:

- Include the information as follows:

+ Personal information: Personal identification number, Full name; Date of birth; Sex.

+ Biometrics information: Portrait photo;

- The use of level-1 electronic identification accounts is the confirmation of personal information in the activities and transactions that required personal information.

* Level-2 electronic identification accounts:

- Include the information as follows:

+ Personal information: Personal identification number, Full name; Date of birth; Sex.

+ Biometrics information; Portrait picture;

The use of a level-2 electronic identification account created by the electronic identification and authentication system for a Vietnamese electronic identity owner is as valid as the use of a citizen’s identity card in performing transactions requiring the presentation of citizen’s identity cards.

Therefore, a level-2 electronic identification account can replace the citizen identification cards and some other documents which have been integrated into the electronic identification account in order to simplify procedures.

On August 15, 2022, the Government issues Decree No. 53/2022/ND-CP detailing a number of articles of the Law on Cyber Security. Accordingly, Article 19 of this Decree prescribes the cases of deleting Internet information that is illegal or wrong in cyberspace as follows:

Information in cyberspace is determined by competent authorities as containing contents infringing upon national security or propaganda contents opposing the State of the Socialist Republic of Vietnam; instigating riots or disrupting security or public order in accordance with law provisions;

- When having the legal basis for the information on humiliating or slandering; or infringing upon economic management order; fabricated or false information in cyberspace causing public anxiety damaging socio-economic activities so that authorized agencies must request the removal of unlawful or false information.

- Distorting history, denying revolutionary achievements, sabotaging the national great solidarity bloc, offending religions, or committing gender or racial discrimination;

- Prostitution or other social evils, trafficking in humans; posting obscene, debauched, or cruel information; undermining fine traditions and customs of the nation, social ethics, and community well-being;

Instigating, inducing, or provoking other people to commit crimes.

This Decree takes effect on October 01, 2022.

On September 23, 2019, the Government issues Decree No. 69/2022/ND-CP on amending and supplementing a number of regulations in the marine business.

Accordingly, Decree 69/2022 amends a number of administrative procedures in the marine business, including:  

- Vessel navigation route procedure (In accordance with Article 19, Decree No. 70/2016/ND-CP);

- Procedures for grant of certificates of eligibility for commercial operation of seaports (In accordance with Article 10, Decree No. 37/2017/ND-CP);

- Procedures for re-grant of certificates of eligibility for commercial operation of seaports (In accordance with Article 11, Decree No. 37/2017/ND-CP);

- Procedure for issuing the certificate for recruiting and supplying seafarers (In accordance with Article 13, Decree No. 29/2017/ND-CP);

- Procedure for issuing the conformity certificate for recruiting and supplying seafarers (In accordance with Article 14, Decree No. 29/2017/ND-CP);

All the regulations are amended and supplemented in Decree No. 69/2022 with the purpose to cut down and simplify the business conditions and regulations on the administrative procedures in order to strengthen the application of information technology and supply the online public services at level 4.

These new regulations not only create favorable conditions for enterprises but also cut down fees and charges for making administrative procedures.

This Decree takes effect on October 30, 2022.


Hot policies take effect on October

This is the new content prescribed in Circular No. 50/2022/TT-BTC dated August 11, 2022, of the Ministry of Finance on compulsory insurance in construction investment activities.

In particulars, Article 5 of this Circular prescribes that an insurance enterprise is not liable to indemnify for the following losses:

- Loss caused by war, riots, strikes and acts of hostile forces, rebellion, malicious acts on behalf of or in connection with political organizations, confiscation, expropriation, requisition, confiscation, or destruction or damage caused by order of competent state agencies.

- Loss caused by terrorism.

- Loss caused by nuclear reaction, nuclear radiation, or radioactive contamination.

- Loss from intentional violations committed by the insurance buyer or the insured (not apply to compulsory insurance for workers on construction sites in case such workers take any self-defense act or save people or assets or use stimulants under doctor’s prescriptions).

- Loss in case an insurance buyer has no insurable interests as prescribed in Clause 9, Article 3 of the Law on Insurance Business.

- Loss from the cessation of construction work or consequential loss of construction work.

- Loss to data, software, and computer programs.

This Circular takes effect on October 01, 2022. Compulsory insurance contracts in construction investment activities and civil liability insurance contracts for third parties signed before the effective date of this Circular shall continue to be performed in accordance with the law at the time of entering into insurance contracts.

Hot policies take effect on OctoberTakes effect on October 08, 2022, Circular No. 55/2022/TT-BTC amends and supplements a number of Articles of the Circular No. 238/2016/TT-BTC on the service price for technical safety and environmental protection inspection of currently circulating motor vehicles, equipment, and heavy-duty vehicles; assessment and calibration of equipment inspecting heavy-duty vehicles shall formally increase the register service price by more VND 10,000/time/vehicle compared with previous regulations.

Accordingly, the register service price is as follows:

- Passenger cars with less than 10 seats, ambulances: The register service price is increased from VND 240,000/car to VND 250,000/car.

- Passenger cars with more than 40 seats, buses: The register service price is increased from VND 350,000/car to VND 360,000/car.

- Trucks loads with a carrying volume of more than 20 tons, tractor cars with a towing mass of more than 20 tons and specialized cars: The register service price is increased from VND 560,000 to VND 570,000.

- Tractors, four-wheeled cargo vehicles with engines; trailers; semi-trailers: The register service price is increased from VND 180,000/car to VND 190,000/car.
