From January 1, 2026, workers’ social insurance information registered by enterprises

According to the Law on Employment 2025, enterprises and workers must register information on the national database, including social insurance information from January 1, 2026.

Rights of workers upon labor registration

The Law on Employment 2025 of the National Assembly, No. 74/2025/QH15, was adopted and shall officially take effect on January 1, 2026.

Accordingly, the rights and obligations of workers regarding employment are prescribed as follows:

Rights of workers:

  • To have their labor registration information protected in accordance with the law on personal data protection and other relevant law regulations;

  • To access their own information within the labor database;

  • To have their labor registration information in the labor database adjusted and updated by competent agencies;

  • To use their own information in the labor database for transactions, accessing, and enjoying employment creation support policies; assessment and grant of certificates of national occupational skills; job counseling and recommendation; and unemployment insurance in accordance with this Law.

Obligations of workers:

  • To carry out labor registration in accordance with this Law;

  • To provide timely their complete, accurate and truthful labor registration information to competent state agencies and employers, and to take the responsibility for the information provided;

  • To promptly adjust information in the labor database upon changes to the information specified at Point c, Clause 1, Article 17 of this Law.

Workers’ social insurance participation information to be registered by enterprises

Pursuant to Article 17 of the Law on Employment 2025 on labor registration information and the labor database:

“Employers and workers shall carry out the registration and adjustment of labor registration information when registering or adjusting social insurance participation information.”

Accordingly, from 2026, in addition to workers’ self-registration of labor information related to social insurance, employers shall also register and adjust labor information upon employment participation. This includes workers’ social insurance participation information to be registered by enterprises.

In addition, the Law on Employment 2025 also stipulates that immediately after the effective date, employers must register workers’ information on the labor database system.

Accordingly, the labor registration information of workers to be registered by enterprises shall include:

  • Basic information group: full name, personal identification number, date of birth, gender, ethnicity, and current residence;

  • Information on general education, vocational education, higher education, certificates of occupational skills, and other certificates;

  • Information on employment status and employment demand;

  • Information on social insurance and unemployment insurance;

  • Other information on the characteristics and particularities of the worker.

The above is the new regulation effective from January 1, 2026, on workers’ social insurance participation information to be registered by enterprises.
