TO PROMULGATE THE ACTION PROGRAM TO | ||
On November 9, 2018, the Government Resolution No. 139/NQ-CP on promulgating the Action Program to reduce costs for enterprise. According to this Resolution, the General objective toward 2020 is to thoroughly reduce unreasonable costs of complying with the law on business, repel and prevent acts that give rise to informal costs for enterprises; to create a low-cost, stable business environment; to encourage investment, market entry and competition. To be specific:- To reduce and simplify unnecessary business conditions; | - To reduce and simplify regulations on investment, land, construction, tax; - To publicize 100% of inspection and examination activities and handling results on the websites of competent agencies; - To reduce the tax and social insurance costs of enterprises under the Business Environment Index to the average level of ASEAN 4. This Resolution takes effect on November 9, 2018. |

On September 26, 2018, the Standing Committee of The National Assembly issues the Resolution No. 579/2018/UBTVQH14 on Environmental Taxes. Accordingly, the tax rate for 08 groups of goods include Petrol, oil, and grease; Coal; HCFC solutions, including those of HCFC-containing mixtures; Taxable plastic bags; Restricted-use herbicides; Restricted-use termiticides; Restricted-use forest product preservatives; Restricted-use storehouse disinfectants are provided as follow: | | - Petrol, except ethanol: VND 4,000/liter; - Diesel oil: VND 2,000/liter; - Lignite: VND 15,000/ton; - Taxable plastic bags: VND 50,000/kg… This Resolution takes effect on January 01, 2019. |

This is one of the remarkable contents stated by the Ministry of Industry and Trade in the Circular No. 39/2018/TT-BCT dated October 30, 2018, on prescribing inspection and verification of origin of exported goods. The inspection and verification of the origin of goods at the manufacturing facility shall be implemented in the following cases: - The importing country's authorized body shall request the inspection and verification at the manufacturing facility if the result of inspection of documents certifying the origin of goods as prescribed in Article 8, Article 9 and Article 10 in this Circular does not give sufficient grounds for determination of the origin of goods or in case of any suspicion of fraud in the origin of goods; | | - The domestic body or organization is authorized to carry out the inspection and management of risks and prevention of fraud in the origin of goods in the following cases: + Prior to issuance of C/O; + Prior to issuance of the written approval of self-certification of the origin of goods or grant of origin certification code; + After issuance or release of documents certifying the origin of goods. - Other domestic authorized body requests cooperation if there are sufficient grounds for any suspicion or a sign of fraud in the origin of goods is detected. This Circular takes effect on December 14, 2018. |
07 HIV/AIDS-RELATED MEDICAL SERVICES ARE COVERED |
This is the content prescribed in the Circular No. 27/2018/TT-BYT dated October 26, 2018 of the Ministry of Health providing guidance on health insurance and provision of covered medical services for people with HIV/AIDS. Accordingly, when using HIV/AIDS-related medical services, HIV-infected patients participating in health insurance shall have the costs of the following covered by the health insurance fund: - Antiretroviral drugs; - HIV testing for women who are in pregnant or childbirth performed at the professional request in case costs of such tests are not covered by any other sources of finance; - Abortion on HIV-infected women; | | - HIV diagnosis and testing, ARV and other HIV/AIDS-related medical services for children of HIV-infected women; - HIV testing required in medical examination and treatment; - HIV testing and treatment with ARV for HIV-exposed people, people accidentally infected with HIV; - Preventive treatment for opportunistic infections. Noticeably, this Circular prescribes that: A policyholder who has been receiving treatment for HIV/AIDS with using ARV at a provincial- or central-level health facility before January 01, 2019 is allowed to continue receiving HIV/AIDS treatment from that provincial- or central-level health facility until December 31, 2019 inclusively. This Circular takes effect on January 01, 2019. |

This is one of the remarkable contents in the Decree No. 127/2018/ND-CP dated September 21, 2018 of the Government on prescribing state management responsibilities for education. To be specific, the Government assigns for the provincial-level and district-level People’s Committees to ensure adequate payrolls of education administrators with sufficient numbers of people working under approved working position schemes, meeting conditions to guarantee educational quality, proceeding to organize two learning sessions/day for general education. The Government also emphasizes that the commune-level People’s Committee chairpersons shall be authorized | | to permit the establishment, decide on the merger, division and separation, and suspend education activities of, and to dissolve, independent child care groups and kindergartens. The commune-level People’s Committee chairpersons shall also direct education institutions in their localities to register and mobilize to the utmost people in school-age groups to go to school in order to achieve the universalization of education and eradication of illiteracy, creating conditions for all people to have lifetime education. This Decree takes effect on November 15, 2018. |

From December 01, 2018, the maximum postage rates of universal postal services shall be applied in accordance with the Circular No. 12/2018/TT-BTTTT of the Ministry of Information and Communications. Accordingly, the maximum postage rates (including postcard) of the domestic mail service for the weight range equal to 20g or less; from greater than 20g to 100g; from greater than 100g to 250g is VND 4,000; VND 6,000; VND 8,000, respectively. For each additional weight range from 250g to 2,000g, the maximum rate is VND 2,000. The maximum postage rates of the outbound mail service from Vietnam to other overseas countries from VND 15,000 to VND 23,000 (for the weight range equal to 20g or less), depends on each country and area… | The Ministry of Information and Communications assigns the Vietnam Post Corporation to: - Decide on the postage rates of universal postal services and ensure these rates are not higher than the above maximum rates; - Report to the Ministry of Information and Communications on the postage on universal postal services 30 days prior to official implementation; - Publicly inform and disclose the postage on universal postal services in accordance with law. This Circular is issued on October 15, 2018. |

On October 15, 2018, the Ministry of Information and Communications promulgates the Circular No. 13/2018/TT-BTTTT on the List of cyber information security products imported under license, and procedures and application for issuance of the license for import of cyber information security products. Accordingly, automatic data processing machines and units thereof; magnetic or optical readers, machines for transcribing data onto data media in coded form and machines for processing such data, not elsewhere specified or included must be imported under license. | Also prescribed in the Circular, enterprises have to submit a dossier for issuance of the import license to the Authority of Information Security; within 02 working days from the receipt of the application the Authority of Information Security shall inspect it; within 07 working days from the receipt of the satisfactory application, the Authority of Information Security shall appraise, complete and submit the application for issuance of the import license. This Circular takes effect on December 01, 2018. |
TO SIMPLIFY THE CRITERIA OF | ||
On November 07, 2018, the Government issues the Decree No. 150/2018/ND-CP on amending certain Decrees on investment and business requirements, and administrative procedures in the information and communications sector. This new Decree has abrogated a number of criteria of online games service. To be specific: A dossier of application for a G1 online games service license does not require: A written certification of the use of a lawful domain name for an international domain name; The plan to use Internet resources as before. | This Decree also shortens the time for issuance, re-issuance, and extension of permits for the establishment of representative offices in Vietnam of foreign publishers and issuers of foreign publications to 20 days instead of 30 days. Within 03 working days, since an application submitted through the Internet or postal service is found incomplete or contains incorrect forms of documents, the Ministry of Information and Communications shall inform and instruct the applicant to modify the application either by telephone, email or fax. This Decree takes effect on December 24, 2018. |

AUCTIONEER SHALL NOT BE ENTITLED TO DISCLOSE | ||
On October 16, 2018, the Ministry of Justice issues the Circular No. 14/2018/TT-BTP on issuing professional ethics of auctioneers. Accordingly, the auctioneer shall not be allowed to collude or intrigue with both the owner of the property sold at auction and the auction participants. He/she shall be banned from giving or receiving any monetary amount, property or benefits from an owner of the property sold at auction to create fraudulent auction results. An auctioneer shall not be entitled to disclose information about auction participants and bids that they have submitted. An auctioneer also shall be prohibited from discriminations between auction participants. | This Circular also states that auctioneers shall be obliged to participate in the task of guiding auctioneer trainees or interns and shall not ask for any material or spiritual benefit from them. Absolute prohibited the personally discriminate against trainees or interns or make use of an instructor’s position to force them to perform duties in order to obtain personal gains. This Circular takes effect on December 12, 2018. |
