VIETNAM’S SPECIAL PREFERENTIAL IMPORT TARIFF DURING 2020 – 2022

The Government issues the Decree No. 111/2020/ND-CP on the Preferential Export Tariff and Special Preferential Import Tariff of Vietnam for the implementation of the Free Trade Agreement between the Socialist Republic of Vietnam and European Union in the 2020 - 2022 period on September 18, 2020.

Accordingly, to be eligible for the special preferential import duty rates under the EVFTA, imports must fully satisfy the following conditions: Being specified in the Special Preferential Import Tariff; Being imported into Vietnam from territories of member states of the European Union as prescribed in Appendix III attached to this Decree, United Kingdom of Great Britain and Northern Ireland, the Principality of Andorra; the Republic of San Marino, and the
 

 

Socialist Republic of Vietnam; Meeting all regulations on the origin of goods and having Certificates of origin in accordance with the EVFTA.

Besides, within 01 year from the date of registration of the export declaration, the customs declarant must submit all documents proving that the goods meet the conditions as prescribed and make an additional declaration to enjoy the preferential export duty rate under the EVFTA. Past the prescribed 1-year time limit, the exported goods shall be no longer eligible for the preferential export duty rate under the EVFTA.

This Decree takes effect on the signing date.
 

Ü  EXPORT – IMPORT

2 TYPES OF GOODS NOT ALLOWED TO BE DEPOSITED IN BONDED WAREHOUSES

The Prime Minister issues the Decision No. 27/2020/QD-TTg on the List of imported goods not allowed to be deposited in bonded warehouses on September 21, 2020.

Specifically, the List of imported goods not allowed to be deposited in bonded warehouses includes:

Firstly, cigarettes, of tobacco or, of tobacco substitutes: Cigarettes containing tobacco, with 555 or Esse labels, not originating from Vietnam, HS code: 24.02.20;
 

 

Secondly, Whiskey with a capacity of more than 50 ml, not originating from Vietnam, HS code: 22.08.30.00.

Besides, for shipments brought into bonded warehouses before the effective date of this Decision, the current regulations on the period for storage in bonded warehouses shall be applied. If the period of storage in a bonded warehouse expires but such goods could not be exported, it shall be forced to re-export at the initial import checkpoint.

This Decision takes effect on November 15, 2020.

GUIDANCE ON COVID-19 PANDEMIC PREVENTION AND CONTROL
IN COMMUNITY IN THE NEW NORMAL

The Ministry of Health issues the Decision No. 3888/QD-BYT on promulgating the “Handbook on prevention and control of COVID-19 pandemic in community in the new normal” on September 08, 2020.

Accordingly, persons in a household must carry out personal preventive measures, include: Wearing face masks when leaving the house; Washing hands regularly with soap or hand sanitizer; Cleaning up house, surfaces, floors, objects with common detergents; Collecting household waste every day and put it in the right place; Installing and turning on contact tracing and health declaration applications if having smart mobile devices; etc.

 

 

Besides, for persons who live in a condominium, measures to be carried out include: Wearing face masks when leaving their apartment or family room; Keeping a minimum distance of 01 meter at public spaces and community areas; Avoiding talking in elevators and stairs, etc.

In addition, parents are not allowed go to the preschool and sending children to school if the they are under self-quarantine at home or show symptoms of fever, cough, and shortness of breath; they should wear face masks for themselves and their children when taking them to schools and when dropping them of, and prepare personal items for children when they go to school, etc.

This Decision takes effect on the signing date.

TO PROHIBIT UNMANNED AIRCRAFT IN AREAS
SERVING NATIONAL DEFENSE AND SECURITY PURPOSES

This content is defined by the Prime Minister in the Decision No. 18/2020/QD-TTg dated June 10, 2020, on establishment of prohibited areas and restricted areas for unmanned aircraft and ultra-light instruments.

Accordingly, the Prime Minister promulgates the regulations on establishment of prohibited areas and restricted areas for unmanned aircraft and ultra-light instruments in Vietnam’s airspace as follows:

Firstly, prohibited areas include: National defense works and particularly important military zones of which the management and protection are directed by the Ministry of National Defense as authorized by the Government; Working
 

 

offices; Areas serving national defense and security purposes; Airports and aerodromes where civil and military aircraft are operating; Areas within the limits of licensed airways, tracks and air corridors in Vietnam’s airspace; etc.

Secondly, restricted areas include: Airspace areas at the altitude exceeding 120 meters above the terrain; Crowded areas; Border areas; Areas adjacent to prohibited areas in airports and aerodromes where civil aircraft and military aircraft are operating.

This Decision takes effect on June 10, 2020.
 

Ü  POLICY

TO ENFORCE THE DEVELOPMENT OF BIG AND SUPER-BIG CITIES
IN KEY ECONOMIC REGIONS

On September 11, 2020, the Government promulgates the Resolution No. 128/NQ-CP on the tasks and solutions to step up the development of key economic regions.

Accordingly, in order to redress the above limitations, to quickly restore and create impetus for economic growth, the Government requests localities in the key economic regions to endeavor with the highest determination to surmount difficulties, promoting to the utmost potentials and comparative advantages, innovations in order to create impetus for the common development of the regions, thoroughly studying the following viewpoints and scrupulously implementing the following tasks and solutions:

Firstly, the Ministry of Construction shall propose solutions to the planning, construction and development of big and super-big cities in key economic regions to be modern and worth-living cities of regional magnitude, including solutions to the management of “city-in- city” models, “smart cities”, “green cities”, etc. in association with solutions to the mobilization of non-state budget resources for development investment.
 

 

Besides, the People’s Committees of provinces and cities in the key economic regions shall allocate resources and closely coordinate with ministries, ministerial-level agencies in formulating and submitting for approval the provincial- level planning in the 2021-2030 period, with the vision towards 2050 under the current provisions of law on planning. To scrutinize and propose supplements to the planning on development of industrial parks of a number of localities in the key economic regions with the full occupation of hi-tech parks, efficient land use, being capable of attracting investment, and submit them to competent authorities for consideration.

In addition, the Government also assigns the Ministry of Labor, War Invalids and Social Affairs to expeditiously organize training and retraining programs for laborers with qualifications and skills suitable to orientations for attraction of investment in branches and fields having demands and being the advantages of the key economic regions, etc.

PLAN ON IMPLEMENTATION OF THE AGREEMENT ON PORT STATE MEASURES

On June 04, 2020, the Prime Minister issues the Decision No. 757/QD-TTg on approving the Plan on implementation of the Food and Agriculture Organization of the United Nations Agreement on Port State Measures (PSMA) to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing through 2025.

Specifically, in the 2020 – 2021 period, the Ministry of Agriculture and Rural Development shall assume the prime responsibility for collecting, summing up, editing, compiling and printing documents disseminating and guiding the PSMA, legal frameworks and relevant international and regional legal frameworks and

 

instruments; establishing mechanisms for coordination among related ministries, sectors and agencies in organizing the implementation of the PSMA.

Besides, the Ministry of Transport shall review, formulate and improve legal frameworks, policies, and regulations on port entry, organization of inspection, authorization for or denial of port entry and use of ports in conformity with the PSMA for implementation at designated ports relating to fisheries activities.

This Decision takes effect on the signing date.
