3 METHODS OF SENDING REPORTS BY MAKERS OF THE DEBT INSTRUMENT MARKET

On September 03, 2020, the Ministry of Finance issues the Circular No. 80/2020/TT-BTC on guiding methods of sending reports by credit rating enterprises or makers of the market of the Government’s debt instruments specified in the Government’s Decree No. 88/2014/ND-CP of September 26, 2014, on credit rating services, and the Government’s Decree No. 95/2018/ND-CP of June 30, 2018, prescribing the issuance, registration, depositing, listing and trading of the Government’s debt instruments on the securities market.

Specifically, credit rating enterprises shall send reports to the Ministry of Finance by one of the following methods:

Sending paper reports directly or by post; Sending reports to the email: [email protected]; Other methods as prescribed by law.

Besides, makers of the market of the Government’s debt instruments shall send reports to the Ministry of Finance by one of the following methods: Sending paper reports directly or by post; Sending reports to the email: [email protected]; Other methods as prescribed by law.

This Circular takes effect on October 19, 2020.

TO EXTEND EXCISE TAX PAYMENT TIME LIMITS
FOR DOMESTICALLY MANUFACTURED, ASSEMBLED AUTOMOBILES

This new content is prescribed by the Government in the Decree No. 109/2020/ND-CP dated September 15, 2020, on extension of time limits for payment of excise tax for domestically manufactured or assembled automobiles.

Accordingly, to extend the time limits for payment of the payable excise tax amount incurred in the tax periods of March, April, May, June, July, August, September and October 2020 for domestically manufactured or assembled automobiles. The extension duration starting from the deadline for excise tax payment as prescribed by the law on tax administration. To be specific:

Firstly, the deadline for payment of the payable excise tax amount incurred in the tax period of March 2020 is September 20, 2020.

Secondly, the deadline for payment of the payable excise tax amount incurred in the tax period of April 2020 is October 20, 2020.

Thirdly, the deadline for payment of the payable excise tax amount incurred in the tax period of May 2020 is November 20, 2020.

Fourthly, the deadline for payment of the payable excise tax amount incurred in the tax period of June, July, August, September and October 2020 is December 20, 2020.

This Decree takes effect on the signing date.

FROM 2020-2022, THE IMPORT TARIFF QUOTA
FOR UNMANUFACTURED TOBACCO IS 500 TONS/YEAR

On August 28, 2020, the Ministry of Industry and Trade issues the Circular No. 20/2020/TT-BCT on prescribing the application of import tariff quotas for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union in 2020, 2021 and 2022.

Accordingly, to apply the import tariff quota for unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union under the Vietnam - Eurasian Economic Union Free Trade Agreement.

To be specific: The import tariff quota for poultry eggs in 2020, 2021 and 2022 is 9,724 dozens, 10,210 dozens and 10,721 dozens, respectively; The import tariff quota for unmanufactured tobacco in 03 years (2020, 2021 and 2022) is 500 tons/year.

Noticeably, imports must have certificates of origin (C/O form EAV) provided by competent agencies of state members of the Eurasian Economic Union in accordance with current regulations.

This Circular takes effect from October 15, 2020, to the end of December 31, 2022.

FROM SEPTEMBER 04, ONE MORE GROUP OF CADRES AND CIVIL SERVANTS
APPLIED THE INCREASE OF RETIREMENT AGE

On September 04, 2020, the Government promulgates the Decree No. 104/2020/ND-CP on amending and supplementing the Government’s Decree No. 53/2015/ND-CP of May 29, 2015, on the increase of retirement age for cadres and civil servants.

Specifically, the regulation on increase of retirement age for cadres and civil servants prescribed in Clause 3, Article 187 of the Labor Code shall be applied to one more subject: female cadres and civil servants being members of Standing Boards of provincial-level Party Committees who are ethnic minority people.

Besides, according to the new regulations, female cadres and civil servants holding the positions deputy heads of Steering Committees of the Northwest, the Central Highlands and the Southwest shall not be applied the regulation on increase of retirement age for cadres and civil servants prescribed in Clause 3, Article 187 of the Labor Code.

This Decree takes effect on September 04, 2020.

NATIONAL CLIMATE CHANGE ADAPTATION PLAN FOR THE 2021 - 2030 PERIOD

On July 20, 2020, the Prime Minister issues the Decision No. 1055/QD-TTg on promulgating the National Climate Change Adaptation Plan for the 2021 - 2030 period, with a vision toward 2050.

Accordingly, the specific objectives include: Improving climate change adaptation effectiveness through enhancing the state management on climate change; Enhancing the resilience and improve the adaptive capacity of the community; Reducing natural disaster risks and damages, ready to respond to natural disasters and extreme climate increased due to climate change.

Besides, the Prime Minister defines tasks and solutions for the Plan, including: Building and perfecting the national legal framework on climate change; Reviewing, updating

and formulating new planning on socio-economic development; Renovating infrastructure to enhance the resilience to climate change; Improving the adaptation of the natural ecosystem and biodiversity; Managing the forest protection and improving the forest quality; Preventing riverbank and coastal erosion, responding to the increasing drought, etc.

In additions, after the first 02 year of implementation, the Plan shall be reviewed and updated. After the next 03 years, the Plan shall be reviewed and updated for the second time, on the basis of the implementation results in the 2021 - 2025 period.

This Decision takes effect on the signing date.

GUIDANCE ON GRANT OF CFS FOR EXPORTED GOODS

On September 07, 2020, the Ministry of Information and Communications promulgates the Circular No. 21/2020/TT-BTTTT on providing regulations on the grant of certificates of free sale for goods in the field of information and communications.

Specifically, a trader shall submit 01 dossier of application for grant of certificate of free sale (CFS) for exported goods directly or by post to the address: No. 18, Nguyen Du, Hai Ba Trung District, Hanoi or online on the national public service portal or on the public service portal of the Ministry of Information and Communications.

Besides, agencies handling dossiers of application for CFS are the Press Authority for journalistic products; the Publishing, Printing and Distribution Authority for publications; the Post Department for postal and delivery products; the Information Technology Department for information technology and electronic products; the Vietnam Telecommunications Authority for telecommunications equipment, radio telecommunications equipment.

This Circular takes effect on October 26, 2020.
