On April 3, 2019, the Ministry of Finance issues the Circular No. 18/2019/TT-BTC on annulling the Ministry of Finance’s Circular No. 134/2014/TT-BTC of September 12, 2014, guiding procedures for extending the payment of, and refunding, value-added tax for machinery and equipment imported to create fixed assets of investment projects. To be specific, to totally annul the Ministry of Finance’s Circular No. 134/2014/TT-BTC of September 12, 2014, guiding procedures for extending the payment of, and refunding, value-added tax for machinery and equipment imported to create fixed assets of investment projects. | Besides, this Circular also regulates that in case enterprises have submitted dossiers of application for extension of payment of value-added tax at the import stage prescribed in the Ministry of Finance’s Circular No. 134/2014/TT-BTC of September 12, 2014, to customs offices before the effective date of this Circular, customs offices shall further perform procedures for tax payment extension under Circular No. 134/2014/TT-BTC. This Circular takes effect on May 20, 2019. |

The Ministry of Finance issues the Circular No. 60/2019/TT-BTC on amending and supplementing a number of articles of the Circular No. 39/2015/TT-BTC dated March 25, 2015 of the Minister of Finance stipulating customs value of exports and imports. Accordingly, to supplement criteria to set up the List of enterprises with customs value risks, to be specific: - At the time of assessment, being assessed by the customs offices as enterprises not complying with law provisions; - At the time of assessment, being classified by the customs offices as high-risk enterprises or very high-risk enterprises or enterprises engaged in commodity export and/or import for less than 365 days; | - Within a period of 730 days (02 years) or earlier before the assessment date, the enterprises handled by the customs offices for the act of incorrect declaration of customs value, resulting in a lack of payable taxes or the increase of exempted, reduced, refunded or non-collected taxes, with the sanctioning levels and fine norms prescribed in the Circular of the Ministry of Finance stipulating risk management in customs operations; or sanctioned or evaded by tax offices. In addition, this Circular also amends the regulation on principals and methods of determining custom value of imports; Method of transaction value of imports; Database of transaction value of imports regulated in the Circular No. 39/2019/TT-BTC. This Circular takes effect on October 15, 2019. |

On April 19, 2019, the Ministry of Industry and Trade issues the Circular No. 07/2019/TT-BCT on prescribing the export of textile and apparel goods to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership, which takes effect on June 20, 2019. Accordingly, to be entitled to preferential tariff treatment under CPTPP, trader must having a certificate of origin form CPTPP granted by a competent agency and having a certificate of eligibility granted by a competent agency. For each specific textile or apparel goods item shall need to satisfy a number of rule of origin prescribed in appendixes attached to this Circular. | The Ministry of Industry and Trade shall grant certificate of eligibility for lots of textile and apparel goods exported, which shall be valid for the year of grant. Certificate of eligibility is granted by the method of backward subtracting tariff quotas on the electronic system on the principle of first filing first grant until no tariff quota is left. Certificate of eligibility shall be granted within 2 (two) working days after the grant of certificate of eligibility is notified. |

On May 7, 2019, the Government issues the Decree No. 37/2019/ND-CP on detailing a number of articles of the Planning Law. Accordingly, the time limit for formulation of the national overall master plan, national marine space master plan, national land use master plan and regional master plans is 30 months after the master plan formulation task is approved. For national sectoral master plans and provincial master plans, the time limit is 24 months. In addition, this Decree also regulates that a master plan shall be publicized in the mass media in the forms: Publishing summarized contents of the master plan at least once on the front page of a print press or on the home page | of an online press for at least 30 days; announcing contents of the master plan a news channel or program of the national radio or television station for national-level or regional master plans or that of the provincial radio or television station for provincial master plans. Besides, a master plan shall be publicized through one of the following forms: Displaying diagrams and maps of the master plan; Organizing conferences and seminars to disseminate contents of the master plan; Distributing publications, including books, pamphlets and videos introducing contents… This Decision takes effect on the signing date.

This is the regulated content in the Decree No. 36/2019/ND-CP of the Government on detailing a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Physical Training and Sports. This Decree regulated that athletes and coaches of national sports teams who have graduated from upper secondary schools and are certified by the Ministry of Culture, Sports and Tourism as having fulfilled their tasks of competing in the Olympic Games, World Championships, World Cup, ASIAD, Asian Championship, Asian Cup, SEA Games, Southeast Asian Championship, Southeast Asia Cup may be given priority in direct enrollment for physical training and sports majors or physical education majors in universities and colleges or appointment for attending in coach training courses… | Athletes who record outstanding achievements in national and international sports tournaments may be considered for exceptional graduation from lower or upper secondary schools in case the period of graduation examination coincides with the period of overseas training or competition in international sports tournaments. Former athletes of national sports teams or provincial- or sector-level sports teams who wish to receive vocational training and are eligible for vocational training support may be provided with vocational training support. In addition, athletes shall receive Salary, financial support for training and competition; social insurance premiums; health insurance premiums; unemployment insurance premiums; occupational accident and disease insurance premiums… in comply with law regulations. This Decree takes effect on June 14, 2019. |
