NOT TO INVEST MORE THAN 30%
OF THE MEMBER FUND’S TOTAL ASSET VALUE IN PUBLIC FUND CERTIFICATES

The Ministry of Finance issues the Circular No. 98/2020/TT-BTC providing guidelines on operation and management of securities investment funds on November 16, 2020.

According to the Circular, in the management of a member fund, the fund management company shall ensure: The fund's capital and assets shall not be used to invest in the fund itself; The fund's capital and assets shall not be lent or used to guarantee any loan, not be used to underwrite securities issuance.

The member fund shall be invest only in public fund certificates or shares of public securities investment companies managed by other fund management companies, in which the following restrictions shall be ensured:

 

Firstly, not to invest in more than 10% of total outstanding fund certificates of a public fund, or outstanding securities of a public securities investment company;

Secondly, not to invest more than 20% of the total asset value of the fund in fund certificates of a public fund, or shares of a public securities investment company;

Thirdly, not to invest more than 30% of the total asset value of the fund in public fund certificates, or shares of a public securities investment company.

This Circular takes effect on January 01, 2021.

MASTERS ON BOARD NEAR-COASTAL SHIPS OF LESS THAN 50 GT
MUST HAVE A LOWER SECONDARY EDUCATION COMPLETION CERTIFICATE

On February 21, 2020, the Ministry of Transport issues the Circular No. 03/2020/TT-BGTVT prescribing standards of competence, professional certificates, training for seafarers, and minimum safety complement requirements for Vietnamese seagoing ships.

Accordingly, requirements for issuance of certificates of competency to masters on board near-coastal ships of less than 50 GT include: Holding a lower secondary education completion certificate; Completing a short-term training course in control engineering and pass the exam as prescribed by the Minister of Transport. Any candidate

 

acquiring a certificate in elementary control engineering shall only be required to pass the exam.

Besides, the Ministry of Transport also stipulates that the approved period of seagoing service for issuance of certificates of competency of masters on board near-coastal ships of less than 50 GT; deck officers on board ships of less than 500 GT on near-coastal voyages and ratings forming part of a navigational watch shall be at least 12 months; 36 months and 18 months, respectively, etc.

This Circular takes effect on April 15, 2020.

CREWMEN SHALL LEAVE VESSELS
ONLY WHEN OBTAINING THE HIGHEST COMMANDER’S PERMISSIONS

The Ministry of Transport issues the Circular No. 39/2019/TT-BGTVT providing regulations on responsibilities of inland waterway vessel owners, crewmen, steersmen, holding titles of crewmen and minimum safety complement of inland waterway vessels on October 15, 2019.

Accordingly, crewmen and steersmen of an inland waterway vessel shall have the following responsibility: Only leaving the vessel when obtaining permissions of the highest commander on the vessel or the vessel owner; Instructing passengers on how to use fire-fighting equipment, life-saving devices and escape equipment; Strictly obeying the orders of the captain and the direct commander, and fully carrying

 

out the procedures for handing over work shifts, keeping a full and clear diary, etc.

The Circular also prescribes that the vessel owners and organizations and individuals hiring vessels shall take responsibility for making a seafarer register book, a vessel log book for cargo vessels with a gross tonnage of 250 tons or more each or passenger vessels with capacity of 50 passengers or more. Besides, the vessel owners and organizations and individuals hiring vessels shall be responsible for operation conditions of vessels and carrying out maintenance and repair of vessels, etc.

This Circular takes effect on January 01, 2020.

CONDITIONS FOR PARTICIPATING IN AUCTIONS
OF TELECOMMUNICATIONS CODES AND NUMBERS

The Prime Minister issues the Decision No. 16/2021/QD-TTg prescribing the auction and transfer of the right to use the telecommunications number storage and Internet domain names on March 30, 2021.

Accordingly, conditions for participating in an auction of telecommunications codes and numbers include: Enterprises and organizations established under Vietnamese laws must satisfy financial and technical requirements appropriate for each type of telecommunications code and number to be put on auction in accordance with the master plan and regulations on management of telecommunications number storage; Having a commitment to put telecommunications codes and

 

numbers into use and exploitation for at least 06 months after winning the auction; Relevant financial obligations must be fulfilled before participating in the auction; etc.

Besides, the property auction organization or property auction council shall not organize an auction and refund the advance payment to the auction participants in the following cases: The competent State agency issues a written request for suspending the auction before the date of auction; There is only one person registering for participating in the auction, or there are many people registering but only one of them participating in the auction.

This Decision takes effect on June 01, 2021.

PROGRAM ON DEVELOPMENT OF NATIONAL PRODUCTS TOWARDS 2030

The Decision No. 157/QD-TTg promulgating the Program on development of national products towards 2030 is issued on February 01, 2021 by the Prime Minister.

Specifically, the Program sets the target of researching and applying advanced technologies, the achievements of the fourth industrial revolution, to the production and development of national products for higher productivity, quality and competitiveness of national products on domestic and international markets. By 2030, to form and develop at least 10 new national products.

 

In which, the selected national products concentrate on the following specific sectors and domains: Processing and manufacturing industries; Energy; Information, telecommunications and electronic industries as well as supporting industry; National leading agriculture; Defense and security; Pharmacy, healthcare and environmental protection; Products of competitive edges, efficiently serving Vietnam’s process of economic restructuring; Other priority products as requested by the Government, the Prime Minister.

This Decision takes effect on the signing date.
