SUMMARY:

 

Ü  TAX – FEE – CHARGE

TIME LIMIT FOR PAYMENT OF VAT AMOUNT OF AUGUST 2021
IS EXTENDED FOR FURTHER 3 MONTHS

On April 19, 2021, the Government issues the Decree No. 52/2021/ND-CP on extension of time limits for payment of value-added tax, enterprise income tax, personal income tax and land rental in 2021.

Accordingly, to extend the time limits for payment of the payable value-added tax amount of the tax periods of March, April, May, June, July and August 2021 (in case of making monthly value-added tax declaration) and the tax periods of first and second quarters of 2021 (in case of making quarterly value-added tax declaration) of enterprises and organizations. The extension duration is 05 months for the value-added tax amount of the tax periods of March, April, May and June 2021 and the tax periods of first and second quarters of 2021; 04 months for the value-added tax amount of the tax period of July 2021; and 03 months for the value-added tax amount of the tax period of August 2021.

 

Enterprises and organizations eligible for extension of tax payment time limits shall make and submit monthly or quarterly value-added tax declarations but are not required to pay the payable value-added tax amounts stated in the value-added tax declarations already filled in.

Besides, the time limit for payment of the payable land rental amounts of the first period of 2021 of enterprises, organizations, business households and individuals that fall into the cases as prescribed and are leased land directly by the State under decisions of, or contracts signed with competent state agencies in the form of annual payment of land rental also is extended for further 06 months, from May 31, 2021.

This Decree takes effect on the signing date.

EXEMPTION FROM FEES FOR GRANT OF PASSPORTS
FOR EXPELLED OVERSEAS VIETNAMESE

The Circular No. 25/2021/TT-BTC prescribing the rates of charges and fees related to exit from, entry into, transit through and residence in Vietnam and charge and fee collection, remittance, management and use is issued on April 07, 2021 by the Ministry of Finance.

In accordance with this Circular, exemption from fees for grant of passports for overseas Vietnamese who has an expulsion decision in writing issued by the host country’s competent agency but does not have a passport. Besides, the Circular also stipulates a number of subjects entitled to charge and fee exemption, such as: Guests of the Party, State, Government; Officers and staff members of foreign diplomatic missions and consulates and Vietnam-based representative offices of international organizations and their

 

family members; Foreigners who enter Vietnam to provide relief or humanitarian aid, etc.

Fee for grant of passports (including chip-based e-passports and non-chip passports) is VND 200,000/time for first-time grant, VND 400,000/time in case of re-grant of damaged or lost passports, and VND 100,000/time in case of grant of written certifications of personnel details. Fee for grant of exit permits is VND 200,000/time, fee for issuance of diplomatic notes on visa application is VND 10,000/time; fee for first grant of APEC Business Travel Cards (ABTC) is VND 1.2 million/time, in case of re-grant, such fee is VND 1 million/time; fee for grant of AB stamps is VND 50,000/time.

This Circular takes effect on May 22, 2021.

TO USE NEW LIQUOR OR CIGARETTE E-STAMP SPECIMENS FROM JULY 01, 2022

The Ministry of Finance issues the Circular No. 23/2021/TT-BTC guiding the printing, issuance, management and use of e-stamps for liquor and tobacco products on March 30, 2021.

Accordingly, the cigarette e-stamp specimen or liquor e-stamp specimen must contain the phrase “cigarette e-stamp” or “liquor e-stamp”.

With regard to enterprises and organizations importing liquor products and tobacco products, they shall register for making a plan on use of e-stamps and register it on the Customs e-Data Processing System before April 30 of the year preceding the planning year in accordance with the enterprises’ and organizations’ demands for use of e-stamps.

If the demands for use of e-stamps in the year change compared to the registered plans, organizations and enterprises that import liquor products and tobacco

 

products shall be responsible for making and registering to adjust the plans on use of e-stamps on the Customs e-Data Processing System before August 31 of the implementing year.

The General Department of Vietnam Customs shall announce and update changes of e-stamp price on its e-portal (at https://customs.gov.vn). Organizations and enterprises purchasing e-stamps shall submit an application for purchasing e-stamps according to the Form, receipt or money order to the budget for all e-stamps requested to purchase, produce customs declarations and certified copy or copy enclosed with the original for comparison of a valid license for tobacco product or valid license for liquor distribution, etc.

This Circular takes effect on May 15, 2021.

4 TYPES OF PROPERTIES USED TO SECURE THE PERFORMANCE
OF CIVIL OBLIGATIONS

The Government issues the Decree No. 21/2021/ND-CP detailing the implementation of the Civil Code’s provisions on security for performance of obligations on March 19, 2021.

Specifically, properties used to secure the performance of an obligation include: Existing properties or future properties, unless the sale, purchase, transfer or other transfers of ownership rights of them are prohibited in the Civil Code or other relevant law provisions at the time of the security contract and security measures are established; Properties sold in property sale and purchase contracts with retention of title; Properties which are objects of the breached obligations in the bilateral contract in case of lien on property; Properties belonging to all people, as prescribed by relevant law provisions.

Besides, the description of the collateral shall be agreed upon by the securing party and the securing party as

 

prescribed by law. In cases where the collateral is immovable or movable which, in accordance with law provisions, shall be registered, the agreed description shall be consistent with the information on the certificate. In cases where the collateral is a property right, the agreed description shall include the name and legal grounds in which the property right arises.

The realization of collateral shall be carried out in accordance with the parties' agreements, provisions of this Decree and relevant law provisions. In cases where the collateral is the right to exploit minerals or other natural resources, the realization of the collateral shall comply with the law provisions on minerals and other natural resources, and relevant law provisions.

This Decree takes effect from May 15, 2021.

TO COMPLETE THE NATIONAL ELECTRICITY PLANNING TO 2030

On April 01, 2021, the Government issues the Resolution No. 41/NQ-CP on the Government’s regular meeting in March 2021.

Accordingly, the Government requests the Ministry of Industry and Trade to coordinate with other ministries, agencies and localities to formulate specific solutions, effectively supporting and facilitating the circulation, import, export and consumption of goods; strengthen trade defense measures; and continue to review and complete the national electricity planning to 2030, with a vision to 2045; ensure the adequate supply of materials and equipment for COVID-19 prevention and control, etc.

Besides, the Ministry of Natural Resources and Environment shall focus on strictly controlling waste sources, replicating efficient and sustainable waste treatment

 

models; continue improving the capacity and quality of forecasts and warnings, particularly early forecasts; promptly provide forecasts and warnings of extreme and dangerous weather and hydrological phenomena serving natural disaster prevention, fighting and reduction.

The Ministry of Education and Training, ministries, agencies, and localities shall continue to organize teaching and learning activities depending on the COVID-19 situation. At the same time, the Ministry was requested to enhance and improve e-learning quality, ensuring equal access to education for students; prepare the conditions for implementing the new general education curriculum and textbooks, especially for grades 2 and 6, etc.
