THE TIME LIMIT FOR INTERNAL APPRAISAL OF ADJUSTMENT | ||
On January 01, 2020, the Government issues the Decree No. 02/2020/ND-CP on amending and supplementing a number of Articles of the Government’s Decree No. 131/2015/ND-CP of December 25, 2015, providing guidance on national important projects. Accordingly, the Government supplements provisions on dossiers for appraisal of adjustment of investment policies submitted by agencies assigned to make investment preparations. A dossier must comprise: A request for appraisal; An adjusted prefeasibility study report or adjusted feasibility study report; A report on supervision and assessment of the investment project’s adjustment; Other relevant documents. The project owner shall send 15 sets of dossier to its/his/her managing agency or agency assigned | to make investment preparations for carrying out internal appraisal. The time limit for internal appraisal is 30 days. In addition, the Government also amends and supplements Article 28 of the Decree No. 131/2015/ND-CP, from provisions on appraisal process to provisions on dossiers submitted for appraisal. To be specific: A dossier submitted by the project owner to its/his/her managing agency comprises: A request for appraisal; A feasibility study report; The National Assembly’s resolution on approval of the investment policy of a national important project; Other relevant documents. A dossier submitted by the managing agency for appraisal is similar with the above dossier. This Decree takes effect on January 01, 2020. | |
TO IMPORT 59,098 TONS OF MATERIAL TOBACCO IN 2020 | ||
On January 14, 2020, the Minister of Industry and Trade promulgates the Circular No. 01/2020/TT-BCT on prescribing the import of material tobacco under the 2020 tariff quota. | Accordingly, the volume of material tobacco to be imported under the 2020 tariff quota is 59,098 tons. This Circular takes effect on February 29, 2020 until December 31, 2020. | |
TO SUSPEND PERMISSION FOR FLIGHTS FROM VIETNAM | ||
The Prime Minister issues the Directive No. 05/CT-TTg on the prevention and control of acute respiratory infections caused by new strains of novel Coronavirus on January 28, 2020. Accordingly, to prevent the epidemic, the Prime Minister requires the Ministry of Transport to suspend permission for flights from Vietnam to epidemic infected areas of China and cease all the flights from epidemic infected areas to Vietnam; implement the recommendations and warning on prevention and control of passengers on transport vehicles; consider implementation of disease prevention on flights and passenger vehicles... | In addition, the Prime Minister also assign to the Ministry of Health to continue to command guide the supervision, thorough isolation and monitoring of cases of contact with people suspected of infection; timely information on epidemic situation, making recommendations on disease prevention measures. Besides, the Ministry of Health also needs to complete a scenario to respond to epidemics before January 30, 2020 and ensure medicines and equipment for epidemic prevention and control as well as coordinating in isolation of workers when infected or suspected of being infected... | |
TO AMEND ON THE REGULATION OF “VALID CERTIFICATE” IN SECURITY REPORT | ||
On December 31, 2019, the Minister of Finance promulgates the Circular No. 91/2019/TT-BTC on amending and supplementing a number of Circulars on the reporting regime and administrative procedures applied with fund management companies, securities investment funds and securities investment companies. The new regulation states that, the reporting regime for fund management companies, securities investment funds, securities investment companies are allow to use valid copy. Valid copy means a copy grant from original book or a copy certified by competent authorities or a collated copy matched the original. The former regulation defines that valid copy is the copy which is authorized in accordance with law provisions. | For personal record, the new regulations requires it to comprise the written provision of information in the form, a valid copy of identity card or citizen identification card or passport or other lawful personal identification. For offshore indirect investment activities of securities trading organizations, securities investment funds, securities investment companies and insurance trading companies, this Circular amends regulations on reporting regime when the certificate is recalled or cease foreign investment. This Circular takes effect on February 15, 2020. | |
TO APPROVE THE TASK OF FORMULATING THE MASTER PLAN | ||
On January 14, 2020, the Prime Minister issues the Decision No. 82/QD-TTg on approving the task of formulating the master plan on railway network for the 2021-2030 period, with a vision toward 2050. In accordance with this Decision, the Prime Minister approves the task of formulating the master plan on railway network for the 2021-2030 period, with a vision toward 2050. The study scope of the master plan is the entire national boundaries under Vietnam's sovereignty, taking into account international connectivity. The master plan is formulated in order to study plans on development of the national railway network until 2050, | putting forth appropriate investment schedules to meet transport demands, ensure sectoral connectivity; to strengthen the integration capacity of the economy on the basis of building a modern railway network with higher marketability, focusing on developing transport routes in close association with urban and rural economic areas. In addition, the master plan is an effective and efficient tool of the State in the operation and development of the railway transport, and at the same time as the basis for formulation of five-year and annual transport development plans. It also contributes to the proposal of major solutions with regard to railway network development mechanisms and policies. This Decision takes effect on the signing date. | |

The Ministry of Education and Training promulgates the Circular No. 27/2019/TT-BGDDT on providing regulations on main contents of a degree of higher education and its appendices on December 30, 2019. Accordingly, there are 10 main contents shown on degree, include: Name of the degree according to level of training (bachelor's degree, master's degree, doctoral degree and equivalent qualifications); Sector of training; Name of Institutions of higher education that grant degrees; Full name and date of birth of degree holder; Classification of graduation (if any); Place and date of issuance of degree... Especially, in accordance with the new provision, in the main content of the degree, there will be no information on the form | of training as "Full time" or one of the forms "Part-time", "Distance learning", "Guide self-learning" as in the previous regulations. This information will be listed in the appendix of degree. Specifically, main contents listed in the appendix of degree include: Information about the degree holder; Information about the degree (training majors, date of admission, training language, training period, mode of training...); Information about the content and result of learning (name of the course or subject, the number of credits of each module or subject, grade for classification of graduation...) This Circular takes effect on March 01, 2020. | |

THE MAXIMUM TIME FOR GRANTING PERMITS, CONSTRUCTION INSPECTION | ||
This is one of solutions provided by the Government in the Resolution No. 02/NQ-CP dated January 01, 2020 on further performance of tasks and implementation of major solutions to improve the business environment and national competitiveness in 2020. In order to achieve the targets of improvement of the business environment and national competitiveness in 2020, the Government requests the Ministry of Construction to revise the order and procedures for construction licensing in order to shorten construction licensing and inspection time to no more than 50 days. With regard to business, the Government requires the Ministry of Finance to | amend provisions on license fee, toward prolongation of time limit for declaring and paying license fee until January 30 of the subsequent year; supervise the implementation of provisions on procedures for ordering printing or self-printing of invoices and notification of invoice distribution within the prescribed time limit of 04 days. The Ministry of Labor, Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment in studying and developing an information system for online declaration of labor to be connected with the national information system on enterprise registration in the quarter IV of 2020. | |
