From February 08, 2019, the import of goods to serve the State Bank of Vietnam’s banknote printing and coin minting shall be applied in accordance with the Circular No. 38/2018/TT-NHNN. The State Bank of Vietnam shall issue documents designating and permitting banknote printing and coin minting facilities to import the goods to serve the State Bank of Vietnam’s banknote printing and coin minting. When carrying out import procedures, banknote printing and coin minting facilities shall send customs offices 01 original written certification issued by the State Bank, enclosed with import dossiers as prescribed by customs offices. | Goods to serve the printing and coin minting include: - Metal casts made of alloy steel, stainless steel, iron, non-alloy steel for casting and stamping coins; - Money printing paper: Cotton printing paper; Pre-polymer printing paper from polymer polymers, sheets and plates... - Black printing ink is dried by ultraviolet rays... This Circular is issued on December 25, 2018. | |

On December 25, 2018, the State Bank of Vietnam issues the Circular No. 36/2018/TT-NHNN on lending by credit institutions and foreign branch banks for outward investment. This Circular regulates about eligibility requirements for a loan, includes: - If that customer is a juridical person, it must have legal personality; if that customer is an individual aged 18 or older, he/she must have full legal capacity; - The customer has not incurred any bad debts for 02 consecutive years by the time of applying for loans; | - The customer has been issued with the outward investment registration certificate and has its/his/her investment permitted or approved by a competent authority of the host country; There is an outward investment project or plan appraised to be feasible by the credit institution and the customer is capable of repaying the credit institution. Lending rates are agreed by credit institutions and customers; but must not exceed 70% of the customer’s outward investment. This Circular takes effect on February 15, 2019. | |

This is a new requirement of the State Bank of Vietnam in the Circular No. 35/2018/TT-NHNN on amending and supplementing a number of articles of the Governor of the State Bank of Vietnam’s Circular No. 35/2016/TT-NHNN of December 29, 2016, prescribing safety and confidentiality in provision of banking services on the Internet. To be specific, internet banking application software must have the feature requiring a customer to change the password immediately upon the first login and locking out the account in case the customer enters incorrect passwords for several times in a row exceeding the number of times set by the unit. | The unit shall unlock the account only when the customer request and conduct the authentication before unlocking in order to prevent frauds. Specially, application software must authenticate users upon access and does not have the feature to store passwords. In case a user enters incorrect authentication data for several times in a row, which exceeds the number of times set by the unit, the application software shall be automatically and temporarily locked out to prevent further use. This Circular is issues on December 24, 2018 and takes effect on July 01, 2019. | |

Circular No. 21/2018/TT-BLDTBXH on prescribing criteria for determination of high-quality education programs at the intermediate diploma and associate degree level is issued on November 30, 2018 by the Ministry of Labor, War Invalids and Social Affairs. In accordance with this Circular, high-quality education programs at the intermediate diploma and associate degree level are determined due to these criteria: High-quality training and education programs; Teacher; Physical facilities and teaching equipment used in high-quality training and education programs and students. Within that, students of high-quality training and education programs must meet the following requirements: - Attain at least good learning results at the lower and upper secondary education level; - Attain 2/6 of the foreign language level as minimum enrolment requirements with respect to disciplines and specialties relating to languages and foreign culture; attain 1/6 of the foreign language level with respect to other | disciplines and specialties according to the 6-grade Foreign Language Proficiency Framework; - If students taking high-quality education and training programs are foreign nationals, they must hold graduation diplomas which are equal to lower secondary or upper secondary graduation diplomas in Vietnam, must obtain the Vietnamese language proficiency level meeting requirements of these training and education programs regulated by presidents of educational establishments providing these programs; - Voluntarily apply for enrolment in these programs and make commitments on payment of tuition fees in accordance with regulations of educational establishments. Noticeably, this Circular also states that graduation diplomas or degrees of high-quality intermediate and associate degree education programs must show the title: "High-quality education". This Circular takes effect on January 15, 2019. | |

On January 01, 2019, the Government issues the Resolution No. 02/NQ-CP on continuing implementation of major tasks and solutions for improving the business environment and the national competitiveness in 2019 and orientation towards 2021. Accordingly, specific targets regarding improving the business environment and the national competitiveness in 2019 and orientation towards 20219 are: Regarding improving the business environment according to EoDB Index: - Raising ranking of the Starting a Business index (A1) by 20-25 steps; in 2019 improving by at least 5 steps. - Raising ranking of the Paying Taxes and Social Insurance index (A2) by 30-40 steps; in 2019 improving by 7-10 steps. - Raising ranking of the Dealing with Construction Permits index (A3) by 2-3 steps; in 2019 improving by at least 1 step. - Raising ranking of the Getting Credit index (A4) by 3-5 steps; in 2019 improving by at least 1 step. | - Raising ranking of the Protecting Minority Investors index (A5) by 14-19 steps; in 2019 improving by at least 5 steps. - Raising ranking of the Getting Electricity index (A6) by 5 - 7 steps; in 2019 improving by 3-5 steps. - Raising ranking of the Registering Property index (A7) by 20-30 steps; in 2019 improving by 5-8 steps. - Raising ranking of the Trading across Borders index (A8) by 10-15 steps; in 2019 improving by 3-5 steps… Regarding improving the competitiveness according to GCI 4.0 Index: - Raising ranking of the Burden of government regulation index (B1) by 5 - 10 steps; in 2019 improving by at least 2 steps. - Raising ranking of the Incidence of corruption index (B2) by 5 - 10 steps; in 2019 improving by 2 - 5 steps… This Resolution takes effect on January 01, 2019. | |

This is one of the core contents in the Resolution No. 74/2018/QH14 of the National Assembly on the 14th National Assembly, 6th Meeting. To be specifics, the National Assembly unified agree to lengthen the duration of pilot issuance of electronic visa to foreigners entering Vietnam under the National Assembly’s Resolution No. 30/2016/QH14 for up to 02 more years from February 01, 2019. The Government has the responsibility to report the implementation of the Law on Entry, Exit, Transit and Residence of foreigners in Vietnam and propose | amendments to the Law to the National Assembly by February 01, 2021. In addition, the National Assembly also request that The Government has the responsibility to develop the national strategy for land use by 2045; the duty of the State Audit switch over from audit the use of revenue from land of equitized state-owned enterprises during 2011-2017 to audit the management and use of land during and after equitization of state-owned enterprise during 2011-2017. This Resolution is approved on November 20, 2018. | |

Takes effect on July 01, 2019, Law No. 37/2018/QH14 on the People’s Public Security Force regulates that the maximum age for consideration to promotion from colonel major general shall be 57. For limits of non-commissioned officers and officers of the People's Public Security Force shall be subject to the following regulations: Non-commissioned officers: 45; Lieutenant-grade officer: 53; Major and Lieutenant-Colonel: Male: 55; Female: 53; Senior Lieutenant Colonel: Male: 58; Female: 55; Colonel: Male: 60; Female: 55; General-grade officers: 60. People's Public Security officers, who are professors, associate professors, doctors and senior experts, may be | granted an extension of service age to more than 60 years of age for men and over 55 years of age for women. Also regulated in this Law, annually, the People’s Public Security Force may recruit citizens within age for service into the People’s Public Security Force for a period of 24 months. In case of serving the purpose of being ready to fight, performing natural disaster or epidemic prevention and control or rescue tasks, the period of service may be extended but not exceeds 06 months. This Law is approved by the National Assembly on November 20, 2018. | |
