LAW
ON HOUSING
(LawNo.56/2005/QH11)
Pursuanttothe1992ConstitutionoftheSocialistRepublicofVietnam,whichwasamendedandsupplementedunderResolutionNo.51/2001/QH10ofDecember25,2001,oftheXthNationalAssembly,the10thsession;
ThisLawprovides forhousing.
Chapter I
GENERAL PROVISIONS
Article1.-Scopeofregulation
ThisLawprovidesforhouseownership,housingdevelopment,managementofuseofhousesandhouse-related transactions,andstatemanagementofhouses.
Housesprescribedby thisLawmeans constructionsfordwellingandinserviceofdaily-lifeneeds
ofhouseholds,individuals.
Article2.-Subjectsofapplication
ThisLawappliestoorganizationsandindividualsrelatedtohouseownership,housingdevelopment,managementofuseofhouses,house-relatedtransactionsandstatemanagementofhouses.
Article3.-Lawapplication
1.IncaseswherethereappeardifferencesbetweenthisLawandthelawrelatedtohouseownership,housingdevelopment,managementofuseofhousesandstatemanagementofhouses,theprovisionsofthisLawshallapply.
2.WheretreatiestowhichtheSocialistRepublicofVietnamisacontractingparty contain provisionsdifferentfrom thoseofthisLaw,theprovisionsofsuch treatiesshallapply.
Article4.-Therighttohaveplacestoliveand therighttoownhouses
Citizenshavetherighttohaveplacestolivethroughthelawfulestablishmentofhousesorthroughbuying,borrowinghousesortemporarilystayingatothers’undertheprovisionsoflaw.Personswholawfullyestablish theirhousesshallhavethe righttoownsuchhouses.
Article5.-Protectionofthe righttoownhouses
1.TheState recognizesandprotectsthehouseownershiprightsofhouseowners.
2.Housesunder theownershipoforganizationsorindividualsshallnotbenationalized.In caseof realnecessityfordefenseand/orsecurity reasonsandnationalinterestsandtheStatedecides tocompulsorarilypurchaseor requisitionhouses,theStateshallpay compensationstohouseownersatmarketpricesatthetimeofpaymentandcreateconditionsforthemtoestablishotherhouses.
Article6.-Housingdevelopmentpolicies
1.TheStateadoptspoliciesonplanning,land,finance,credit;onresearchintoandapplicationof technologiesandnewbuildingmaterials;onthehousingrealestatemarketandmakepublicandtransparentadministrativeproceduresinordertocreateconditionsfororganizationsand individualstoparticipateinhousingdevelopmentundertheprovisionsoflaw.
2.TheStateencouragesorganizationsandindividualsofalleconomicsectorstoparticipateininvestmentindevelopmentofhousesforsale,lease,rent-purchase,satisfyingthehousing demandsoflow-incomeearnersandpeopleofdifferentsocialstrata.
3.TheStateactivelyinvestsindevelopingthefundofstate-ownedhousesforlease,rent-purchase,serviceoftransferand rotationofpublicservants;adoptspoliciesondirectsupportsfor anumberofsocialpolicybeneficiariestoimprovetheirhousing conditions.
Article7.-ResponsibilitiesofVietnam FatherlandFrontanditsmemberorganizations
VietnamFatherlandFrontanditsmemberorganizationsshall,withintheambitoftheirrespectivetasksandpowers,havetheresponsibilitytopropagateandmobilizepeopletoobservethe housinglawandsupervise theobservance thereof.
Article8.-Prohibitedactsin thehousingdomain
1.Infringingupon,obstructing theexerciseoforganizations’andindividuals’rightsandobligations regardinghouseownershipanduse.
2.Violating theprovisionsofthisLawand thelawon constructioninhousingdevelopment.
3.Forging,falsifyingpapers,distortingdossiersin thegrantofhouseownership rightcertificates.
4.Usinghousesforactivitiesbannedbylaw.
5.Illegallyappropriatingandusinghousingspaces,encroachinguponthespaceandfacilitiesunder commonownershiporofotherownersinanyform.
6.Abusingpositions,powers,actingultraviresorirresponsiblyintheimplementationoftheprovisionsofhousinglaw.
7.Otheractsbannedin thehousingdomainunder theprovisionsoflaw.
Chapter II
HOUSE OWNERSHIP
Article9.-Houseownersandsubjectsentitled toownhouses
1.Houseownersareorganizationsorindividualsthatestablishtheirhouses;wherehouseownersrequestthegrantofhouseownershiprightcertificates,competentstatebodiesshalldosoforthem.
2.Subjectsentitled toownhousesinVietnaminclude:
a/Domesticorganizationsandindividualsregardlessoftheirplacesofbusinessregistrationorplacesofpermanentresidence;
b/OverseasVietnamesedefinedinArticle126ofthisLaw;
c/ForeignorganizationsandindividualsdefinedinClause1,Article125ofthisLaw.
Article10.-Conditionsforbeinggrantedhouseownershiprightcertificates
Organizationsandindividualsthatsatisfythefollowingconditionsshallbegrantedahouseownership rightcertificate:
1.TheyaresubjectsdefinedinClause2,Article 9ofthisLaw;
2.Theyhavehouseslawfullyestablishedthroughconstructioninvestment,saleandpurchase,donation,inheritance,houseexchangeandotherformsprescribedbylaw.
Article11.-Houseownership rightcertificates
1.Houseownershiprightcertificatesshallbegrantedtohouseownersunder thefollowingprovisions:
a/Incaseswherehouseownersareconcurrentlyresidential-landusersorcondominiumapartmentowners,asinglehouseownershiprightandresidential-landuserightcertificateshallbegranted;
b/Incaseswherehouseownersarenotconcurrentlyresidential-landusers,ahouseownershiprightcertificateshallbegranted.
Thehouseownership rightand residential-landuse rightcertificateandthehouseownership right certificate,whicharedefinedinthisClause,shallbereferredtocollectivelyashouseownershiprightcertificates.
2.TheGovernmentshallprovidethe contentsandformofhouseownership rightcertificate.
Article12.-Writingofowners’namesinhouseownershiprightcertificates
1.Forhousesundertheownershipoforganizations,thenamesofsuchorganizationsshallbewritten.
2.Forhousesunder theownershipofindividuals,suchindividuals’namesshallbewritten.
3.Forahouseundercommonownershipbyintegration,thenameofthepersonagreeduponbyalltheowners tobenamedin the certificateshallbewritten;ifwithoutanyagreement,thenamesofallownersofsuchhouseshallbewritten;incaseswhereahouseisunderthecommon ownershipofthehusbandandthewife,thenamesofboththehusbandandthewifeshallbewritten;whereeitherthehusbandorthewifeisnotentitledtoownhousesinVietnamunderthe provisionsoflaw,onlythenameofthepersonentitledtoownhousesinVietnamshallbewritten.
4.Forahouseundercommonownershipbyshares,thenameofeachownerofhis/herownshareshallbewrittenand the certificateofsuchhouseshallbegranted toeveryowner.
Article13.-Validityofhouseownership rightcertificates
1.HouseownershiprightcertificatesprovidedinthisLawshallserveasalegalbasisforhouseownerstoexercisetheirrightsandperformtheirobligationstowardssuchhousesunderthe provisionsoflaw.
2.Houseownership rightcertificatesshallnolongerbelegallyvalidinthefollowing cases:
a/Thehousesaredestroyedordemolished;
b/Thehousesareconfiscatedorcompulsorilypurchasedunderdecisionsofcompetentstate bodies;
c/Thehousesarebuiltonleasedlandandthelandleasetermhasexpiredandnotbeenextendedorthelandusersarenotallowedtochangetotheformoflandassignmentforlong-termstableuse;
d/Thehouseswerealreadygrantedthehouseownershiprightcertificateswhichare,however,withdrawnunderdecisionsofcompetentstatebodiesbecausetheyweregrantedultravires,thecertificategranteesarenoteligiblesubjects,thehousesdescribedinthecertificatesarenottruetotheirconditionswhenthecertificatesweregrantedorthehouseswereconstructedinareasbannedfromhouse construction;
e/Thehouseswerealreadygrantedthehouseownershiprightcertificateswhich,however,havebeenre-grantedorchangedforotherhouseownershiprightcertificatesundertheprovisionsofthisLaw.
Article14.-Competence togranthouseownership rightcertificates
1.People’sCommitteesofprovincesorcentrally-runcities(hereinafterreferredtocollectivelyasprovincial-levelPeople’sCommittees)shallgranthouseownershiprightcertificatesto organizations.Wherethejointownersareorganizationsandindividuals,provincial-levelPeople’sCommitteesshallgranthouseownership rightcertificates.
2.People’sCommitteesofruraldistricts,urbandistricts,provincialcapitalsortowns(hereinafter referredtocollectivelyasdistrict-levelPeople’sCommittees)shallgranthouseownershiprightcertificatestoindividuals.
Article15.-Dossiersofapplicationforhouseownership rightcertificates
1.Adossierofapplicationforhouseownership rightcertificatesshallcomprise:
a/Applicationforhouseownership rightcertificate;
b/Copyofoneofthefollowingpapers:constructionpermit;decisionapprovingthehousingdevelopmentproject;investmentcertificate;landuse rightcertificateoroneofthevalidpaperson landuserightsasprovidedforbythelandlaw;houseownershiprightpapersissuedbycompetentagenciesindifferentperiods;writtenagreementofthelanduser,forcasesthehouseownersarenotresidential-landusersandthehouseswerebuiltinareaswhereconstructionpermitsarenotrequired;papersonhousepurchaseandsale,donation,exchange,liquidation,valuation;contractonsocial-houserent-purchase;decisiononpresentationofgratitudehouse,charityhouse;papersonhouseinheritance;courtjudgmentorruling,orlegallyeffectivedecision ofacompetentagencyonhouseownership;writtencertificationofPeople’sCommitteesof communes,wards,townships(hereinafterreferredtocollectivelyascommune-levelPeople’sCommittees)forothercases,excludinghousesinareasbannedfromconstructionunderthe provisionsoflawon construction;
c/Planofthehouse,residentialland.
2.TheGovernmentshallspecifytypesofpapersonestablishmentofhouses,definedinthisArticletosuiteach case,eachperiod,eachtypeofhouseinurbanand ruralareas.
Article16.-Houseownership rightcertificate-grantingorder
1.Inurbancenters,thesubmissionofdossiersofapplicationforhouseownershipright certificatesisprovidedforasfollows:
a/Organizationssubmitdossiersatprovincial-levelhousemanagementoffices;
b/Individualssubmitdossiersatdistrict-levelhousemanagementoffices.
2.In ruralareas,thesubmissionofdossiersofapplicationforhouseownership rightcertificatesisprovidedforasfollows:
a/Organizationssubmitdossiersatprovincial-levelhousemanagementoffices;
b/Individualssubmitdossiersatcommune-levelPeople’sCommitteesordirectlyatdistrict-level housemanagementoffices.
Whereindividualssubmitdossiersatcommune-levelPeople’sCommittees,withinfiveworking daysafterthefullreceiptofvaliddossiers,commune-levelPeople’sCommitteesshallhavetotransferthedossierstodistrict-levelhousemanagementoffices.
3.Withinthirtydaysafterthefullreceiptofvaliddossiers,competentstatebodiesmustgranthouseownership rightcertificatestohouseowners.
Houseownersshallreceivehouseownership rightcertificatesatdossier-receivingoffices;in case otherpersonsreceivethecertificatesforthem,theremustbeletterofauthorizationofhouse owners,certifiedbycommune-levelPeople’sCommittees.
4.Uponreceivinghouseownershiprightcertificates,houseownersmustsubmittheoriginalsof thepapersin thedossiersofapplication,specifiedinArticle15ofthisLaw,excluding thedecision approvingthehousingdevelopmentprojects;investmentcertificate;landuserightcertificateforcasesofbeinggrantedhouseownership rightcertificatesspecifiedatPointb,Clause1,Article11 ofthisLaw.
Inruralareas,commune-levelPeople’sCommitteesshallhavetorecovertheoriginalpapersdefinedinthisClauseifhouseownersreceivehouseownershiprightcertificatesatcommune-levelPeople’sCommittees.Withintenworkingdays,commune-levelPeople’sCommitteesmustsubmittheoriginalpapers todistrict-levelhousemanagementofficesforinclusioninthearchiveddossiers.
Article17.-Re-grantofhouseownership rightcertificates
1.Houseownerswhohavelosttheirhouseownershiprightcertificatesmustcompiledossiersofapplicationforre-grantthereofandsubmitthematthehousemanagementofficescompetenttograntthe certificates.Adossierofapplicationforregrantofa certificateshallcomprise:
a/Applicationforre-grantofcertificate,clearlystatingthereasonforlossofcertificateandcommitmenttobear responsibilityforthedeclared content;
b/Papercertifyingthelossofcertificate,issuedbythecommune-levelpoliceofficeofthelocalitywherethecertificatewaslost,whichisenclosedwithpapersevidencingthattheinformationonthelosswascarriedonthemassmediaonce,forurbanareas,orthenoticethereonwaspostedupatthecommune-levelPeople’sCommitteefortenworkingdays,forruralareas,exceptforcaseswhere thereare cleargroundsthatthe certificatesweredestroyeddue tonaturalcalamitiesorfires.
2.Ifwithinthirtydaysafterthefullreceiptofvaliddossiers,houseownerscannotfindtheircertificates,competentstatebodiesmustre-granthouseownership certificatestohouseowners.
Article18.-Changeofhouseownership rightcertificates
1.Forhouseownershiprightcertificateswhichweredamaged,tornorfullywrittenwithchangesin theirchange-certifyingpages,thehouseownersshallbegrantednewcertificates.
2.Houseownersshallfiletheirapplicationsforchangeofcertificates,enclosedwiththeoldhouseownershiprightcertificates,andsubmitthemtohousemanagementofficescompetentto grantthe certificates.
3.Withinfifteendaysafterthefullreceiptofvaliddossiers,competentstatebodiesmustgrantnewhouseownership rightcertificatestohouseowners.
Article19.-Certificationofchangesaftergrantofhouseownership rightcertificates
1.Certificationofchangesaftergrantofhouseownershiprightcertificatesshallbeeffecteduponthechangesinareas,height,mainstructuresofhouses;separationormergeroflandplots,for casesofgrantofhouseownershiprightcertificatesdefindatPointa,Clause1,Article11ofthisLawascompared to thecontentsalreadywritteninthecertificates.
2.Houseownersmustenclosetheirdeclarationsofthechangecontentswiththeirhouseownership rightcertificatesandsubmitthem tohousemanagementofficescompetenttograntthecertificates.
3.Within thirtydaysafter thefullreceiptofvaliddossiers,competentstatebodiesmustcertify thechange contentsinhouseownership rightcertificatesand return them tohouseowners.
Article20.-Responsibilitiesofrelevantagenciesin thegrantofhouseownership rightcertificates
1.Agencies receivingthedossiersofapplicationforgrant,changeorre-grantofcertificatesor for certificationonthecertificatesofthechangesspecifiedin Articles16,17,18and19ofthisLawmustnotrequesttheapplicants toadditionallysubmitanyotherpapers thantheprescribedones;incaseswherethedossierslacksomepapers,thedossier-receivingagenciesshallhaveto providedetailedguidancefortheapplicantstosupplementthedossiers.Thetimefor supplementationofdossiersshallnotbe countedintothe timeforgrantofcertificates.
Thedossier-receivingagenciesmustissuereceiptsofthefullsubmissionofdossiersbyorganizationsorindividuals,clearlyindicatingthedateofgrantofthehouseownershiprightcertificates.
2.Statebodies competenttogrant,change,re-grantofcertificates,makecertificationofchangesoncertificateswithinthetimespecifiedinArticles16,17,18and19ofthisLawmustgrantthecertificates,certifychangesoncertificatesforhouseowners;incaseswheretheydonotgrant certificatesornotcertifychangesonthecertificates,theymustissuewrittenrepliesclearlynotifyingthe reasonsthereforand returnthedossiersto theapplicants.
3.Housemanagementofficescompetenttograntcertificatesmustopenandmanagehouse-monitoringbooks.Thecontentsofhouse-monitoringbooksmustsatisfytherequirementsofmonitoringthegrant,changeandre-grantofcertificatesandcertificationofchangesafterthe grantofcertificates.
Article21.-Houseowners’rights
1.Topossesstheirhouses.
2.Touse theirhouses.
3.Tosell,lease,purchase-lease,donate,exchange,bequeath,lend,letotherpeoplestaytemporarilyin,authorizeotherstomanageormortgagehousesundertheirownershipaccordingto theprovisionsoflaw.
4.Tomaintain,renovate,demolishorreconstructtheirhousesandusethehousingspaces compatiblewith constructionplanning,architectureand relevantprovisionsoflaw.
5.To complainabout,denounceactsofinfringingupontheirlawfulhouseownership rights.
6.Torequestcompetentstatebodiestogrant,change,re-granthouseownershipright certificates,tocertifychangesafterthegrantofcertificatesaccordingtotheprovisionsofthisLaw.
7.Toexerciseother rightsasprovidedforbylaw.
Article22.-Houseowners’obligations
1.Tofully complywith theorderandprocedureswhenrequesting thegrant,changeor re-grantofhouseownershiprightcertificatesorthecertificationofchangesafterthegrantofcertificatesaccording totheprovisionsofthisLaw.
2.Tomanage,use,maintain,renovate,demolishorreconstructtheirhousesaccordingtotheprovisionsoflawbutnottoaffectorharmtheinterestsoftheState,publicinterests,legitimateinterestsofotherpeople.
3.Tofullycarryoutproceduresprescribedbylawwhenselling,leasing,donating,exchanging,bequeathing,lending,lettingotherstotemporarilystayin,authorizingotherstomanage,ormortgaging theirhouses.
4.TofulfillthefinancialobligationsasprovidedforbylawwhentheStategrants,changesorre- grantshouseownershiprightcertificatesforthem,orcertifieschangesafterthegrantofcertificatesandinthe courseofusing theirhouses.
5.Toabideby competentstatebodies’decisionsonhandlingofviolations,settlementofdisputes,complaints,denunciationsabouthouses,ground clearance, compensations,support, resettlement,demolitionofhouseswhentheStaterequisitions,compulsorilypurchasesorprior-purchasestheirhouses.
6.Toperformotherobligationsasprovidedforbylaw.
Chapter III
HOUSING DEVELOPMENT
Section1.GENERALPROVISIONSONHOUSINGDEVELOPMENT
Article23.-Housingdevelopmentobjectives
1.Housingdevelopmentmeansinvestmentintheconstruction,reconstructionorrenovationofhousestoincrease thehousing space.
2.Housingdevelopmentmustensurethatcitizenshavehousingplacessuitabletotheir respectiveincomecapabilities,thenationalandlocalsocio-economicconditions;stepbystepimprovehousingconditionsofpeopleofallstrata,acceleratingtheformulationanddevelopmentofthehousingestatemarket;contributetourbanandruraldevelopmenttowardcivilization,modernityandsuitabilitytonationalculturalidentity.
3.Housingdevelopmentmustreflectthepoliciesofabolishingsubsidies,implementingthesocializationofhousingbasedon themechanismoffacilitationby theStatewithlong-termcreditsatappropriateinterestrates;identifytheresponsibilitiesofpersonswhowishtoestablishtheirhouses,ofthePeople’sCommitteesofdifferentlevels,andofpopulationcommunitiesincaringforandimprovinghousing conditions.
Article24.-Requirementsonhousingdevelopmentinurban centers
1.Compliancewiththesocio-economicdevelopmentplannings,urbanconstructionplannings,ensuringthepopulationarrangementandre-arrangement,urbanembellishment,architecture,landscapes,environment,constructionspecificationsandstandardsaswellaslandusein accordancewith theprovisionsoflaw.
2.Newlyconstructedhousesinhousingdevelopmentprojectsmustmeetthefollowingrequirements:
a/Inurban centersofspecialgrade,tohaveatleast60%ofthefloorareaforcondominium;
b/Inurbancentersofgrade1andgrade2,tohaveatleast40%ofthefloorareaforcondominiums;
c/Inurban centersofgrade3,tohaveatleast20%ofthefloorareafor condominiums.
3.Housesinurbancentersmustbedevelopedmainlyunderprojects.Housingdevelopmentprojectsmustincludetheconstructionofsynchronoustechnicalinfrastructuresandsocial infrastructurestomeetthepopulation’sdemandsforimprovementoflivingconditionsunderthe urbanstandards.
4.Forhousingdevelopmentprojects,apartfromtest,hand-overandputtingtouseundertheprovisionsoflawonconstruction,thesystemsofpowersupply,watersupplyanddrainage,firepreventionandfightingandenvironmentalsanitationmustalsobetestedbeforetheyareputtouse.
Article25.-Requirementsonhousingdevelopmentinruralareas
1.Compliancewithplanningsonconstructionofresidentialareas,architecture,constructionspecificationsandstandardsaswellaslanduseinaccordancewithprovisionsoflaw,ensuringthesustainable ruralformationanddevelopment.
2.Ruralhousingdevelopmentmustbeassociatedwithtechnicalinfrastructureandsocial infrastructuredevelopment,ensuringenvironmentalsanitationandimprovementofpeople’slivingconditions.
Article26.-Requirementsonhousingdevelopmentinmountainousareas
1.Housingdevelopmentmustbe conductedin concentrated residentialareassuitable to customsandpracticesofeachethnicgroup,geographicalcharacteristics,naturalconditionsofeach zone,each region,limitingnomadism.
2.Inhousingdevelopmentimportancemustbeattachedtoinvestmentintechnicalinfrastructure andsocialinfrastructuredevelopment,ensuringenvironmentalsafetyandsanitation,improvingthesocio-culturallivingconditionsofpeopleinmountainousregions.
Article27.-Policiesonhousingdevelopmentinruralandmountainousareas
1.TheStateadoptspoliciesonresidentiallandthroughplanningruralandmountainous residentialareastoensure thathouseholds,individualshavelandfor constructionofhouses.
2.TheStateimplementspoliciesonlong-termcreditsatpreferentialinterestratessothatpoorruralandmountainoushouseholdsandindividualshaveconditionstoimprovetheirhousingconditions.
3.TheStateencouragesthedevelopmentofmulti-storeyhousesinruralareasinordertosaveresidentialland.
4.TheStateencouragescooperationandmutualassistancein constructionofhouses.
5.TheStateinvestsinresearchinto,applicationandtransferof,scientificandtechnologicaladvanceinserviceofhousingdevelopmentsuitabletocustomsandpracticesofeachethnicgroup,naturalconditionsofeach zone,region.
Article28.-Formsofhousingdevelopment
1.Housingdevelopmentunderprojects.
2.Developmentofseparatehousesofhouseholds,individuals.
Article29.-Housingdevelopmentunderprojects
1.Housingdevelopmentprojectmeansacombinationofproposalsevidencingtheefficiencyofinvestmentinhousingdevelopmentatagivenlocationorarea.
2.Housingdevelopmentunderprojectsshallcoverthefollowing cases:
a/Developmentofhousesforsale,lease,lease-purchasebyorganizations,individualsofall economicsectors;
b/Renovationtoincreasethehousingspace,reconstructionofcondominiumsorinvestmentinreconstructionofoldhousingquarters;
c/Developmentofstate-ownedhousefunds;
d/Developmentofhousesinserviceofresettlement.
Article30.-Requirementsofhousingdevelopmentprojects
Housingdevelopmentprojectsmustbeformulatedandapprovedaccordingtotheprovisionsof thisLaw,thelawon constructionandmustsatisfy thefollowing requirements:
1.Housingdevelopmentprojectsmustbeinlinewithconstructionplannings,housingdevelopmentprogramineachperiodoflocalities;
2.Housingdevelopmentprojectsmustsatisfytherequirementofinvestmentinconstructionsynchronismbetweenhousesandtechnicalaswellassocialinfrastructuresystems.Social infrastructuresmustbecalculatedanddeterminedinaccordancewithstandards,normsandincompatibilitywiththepopulationsizesofprojects,takingintoaccountaffectingelementsinthecourseofuse;
3.Inhousingdevelopmentprojects,housearchitecturesmustreflectspecifictypesofhouse;
4.Housingdevelopmentprojectsmustbeappraisedinaccordancewiththeprovisionsoflawonconstructioninordertobeapprovedandmustbequalitativelyexaminedbeforetheyareputtouse.Theapprovingdecisionsandexaminationresultsmustbearchivedatprovincial-levelhousemanagementofficesformonitoringandinspection;
5.Investorsmustaccomplishallcontentsoftheapprovedprojects.Incaseofanychangesincontents,progressofprojects,investorsmustreportthemtoandobtaintheapprovalof competentagencies.
TheGovernmentshallspecifythecontentsandmanagementofoperationofhousing developmentprojects.
Article31.-Housingdevelopmentplannings
1.Planningson constructionofurban centers,ruralresidentialareasandprojectson construction ofeconomiczones,industrialparks,exportprocessingzones,hi-techparks,universities, colleges,intermediateprofessionalschools,intermediatevocationalschools,highschoolsinmountainousregionsmustidentifythedemandsforhousesandlandforconstructionofhousesandinfrastructuresystemsinserviceofsuchdemands.
2.WhenapprovingtheplanningsdefinedinClause1ofthisArticle,competentagenciesmustsimultaneouslyapprovehousingdevelopmentplannings.
3.Provincial-levelPeople’sCommitteesmustpublicizehousingdevelopmentplannings,mechanismsandpolicies,createspecificconditionsforeachhousingdevelopmentproject.
Article32.-Housingarchitecture
1.Housingarchitecturemustharmonouslycombinemodernarchitecturewithtraditional architecture,suitthenaturalconditions,socio-culturalcustomsandpracticesofvariousethnicgroupsindifferentregions,zones.
2.Housingarchitecturemustdiversifytypesofhouse,typesofapartmentsuitabletosocio- economicconditions,incomesofpeopleofdifferentsocialstratainlocalities;efficientlyusethe landfundsreservedforhousingdevelopment.
3.Housesbuiltalongroadsides,main thoroughfaresmustcomplywith theconstructionmarkers,ensureharmonyinheight,space,architecture,aesthetics,compliancewithgeneralplanningsandurbandesignalongeach road,street.
4.TheStateinvestsindevelopmentandpromulgationofmodeldesigns,typicaldesignsofhousesinordertosatisfythehousingdevelopmentdemandsofpeople,whicharesuitableto each zone,region.
Article33.-Modesofhousingdevelopment
1.Housesdevelopedwithinvestmentbyorganizationsorindividualsforsaleorleaseaccordingtomarketdemands(hereinafterreferredtoascommercialhouses).
2.Housesbuiltbyhouseholds,individuals(hereinafterreferredtoasseparatehouses)
3.Houses constructedwithinvestmentby theState,organizationsorindividualsforleaseorhire- purchasebysubjectsdefinedinArticles53and54ofthisLaw(hereinafterreferredtoassocialhouses).
4.HousesconstructedwiththeState’sinvestmentinserviceofthetransferandrotationofpublicservantsaccordingtoworking requirements(hereinafter referredtoasofficial-dutyhouses).
Section2.DEVELOPMENTOFCOMMERCIALHOUSES
Article34.-Participantsand conditionsforparticipationinthedevelopmentofcommercialhouses
1.Domesticandforeignorganizationsandindividualsofalleconomicsectorsareentitledtoparticipateinthedevelopmentofcommercialhouses.
2.Domesticorganizationsandindividualsinvestinginthedevelopmentofcommercialhousesmusthavehousingbusinessregistration;andforforeignorganizationsandindividuals,investmentcertificatesare requiredasprovidedforbythelawoninvestment.
Article35.-Subjectsentitled tobuy,rentcommercialhouses
1.Domesticorganizationsandindividuals,regardlessoftheirplacesofbusinessregistrationorplacesofpermanentresidence registration.
2.OverseasVietnameseentitled toownhouses,torenthousesinVietnam,asdefinedinArticles126and131ofthisLaw.
3.Foreignorganizationsandindividualsentitledtoownhouses,torenthousesinVietnam,asdefinedinClause 1ofArticle125andArticle131ofthisLaw.
Article36.-Responsibilitiesofcommercialhouse-developingorganizationsandindividuals
1.To complywithregulationsonhousingdevelopmentunderprojects.
2.Toensure the completionaccordingtoprogressandqualityofapprovedprojects.
3.Topublicizeattheprojectmanagementunits’offices,projectlocationsandonmassmediathe projects’detailedplannings,thenumberofhousesforsaleorlease;thenumberofhousesalreadysoldorleased;theremainingnumberofhouses;thesaleprices,leaseprices;modeofpayment;proceduresforpurchaseorlease registration,the conditionsforeligibilitytopurchaseorrenthouses.
4.Tocarryoutproceduresforcompetentstatebodiestogranthouseownershiprightcertificatestohousepurchasersandhandovertohousepurchasersthedocumentsrelatedtosuchhouses.
Incaseofleasinghouses,commercialhouse-developingorganizationsorindividualsshallhavethe responsibility tocompileandarchivehousingdossiersaccording to theprovisionsofArticle66 ofthisLaw.
5.Toreportonresultsofprojectimplementationperiodicallyanduponprojectcompletiontoagenciescompetenttoapprovetheprojectsandtheprovincial-levelPeople’sCommitteesofthelocalitieswhereexisttheprojects.
Article37.-Landfor commercialhousedevelopment
1.Organizationsandindividualsmayuselandassignedorleasedby theStateor transferredwithlanduserightsfromotherorganizationsorindividualsinaccordancewiththeprovisionsoflandlawforinvestmentindevelopmentofcommercialhouses.
2.Acommercialhousedevelopmentprojectinvolvingtwoormoreorganizationsorindividualsregisteredasinvestorsmustbesubjecttobiddingforselectionofinvestor.Thetransferofland userightsinhousingdevelopmentprojectsornewurbancenterprojectswhereinvestmentininfrastructure constructionhasbeenmademustbepublicizedandeffectedthroughauction.
3.Biddingforselectionofinvestorsandauctionoflanduse rightsshallcomplywith theprovisionsoflaw.
Article38.-Capitalsourcesfor commercialhousedevelopment
1.Investors’capital.
2.Capitalofjointventures,associationswithotherorganizationsand/orindividuals.
3.Capitalborrowedfrom creditinstitutions.
4.Advance capitalofpartieswishing topurchaseor renthouses.
5.Capitalmobilizedfromothersourcesaccording to theprovisionsoflaw.
Article39.-Saleandpurchase,leaseofcommercialhouses
1.Themodesofselling,purchasingorleasingcommercialhousesshallcomplywiththeformoflump-sumpayment,deferredpaymentorinstallmentpayment.
Whereinvestorsmobilizecapitalfromadvancemoneyofhousepurchasersorlessees,suchmodeshallonlyapplywhenthehousedesignshavebeenapprovedandtheconstructionofhousefoundationshasbeencompleted.Thetotalmoneyamountmobilizedbeforehand-overofhousestopurchasersmustnotexceed70%ofthehousevaluestatedin contracts.
2.Thecommercialhouse-sellingandpurchasingor-leasingorderandproceduresshallcomplywith theprovisionsofChapterVofthisLaw.
3.Commercialhouse-sellingor-leasingpricesaswellaspaymentmodesshallbeagreeduponin contractsbytheparties.
Article40.-Commercialhouse-designingstandards
Commercialhousesmustbedesignedundergeneralstandardsprescribedbythelawonconstructionand thefollowingstandards:
1.Condominiumsmustbedesignedwithenclosedapartmentshaving afloorareaofnotlessthan45m2each;
2.Separatehousesconstructedadjacently toeachotherunderprojectsmusthave a construction areaofnotlessthan50m2eachand thefrontageofnotsmallerthan 5mwide;
3.Villahousesmustnotbebuiltwithmore thanthreestoreysandtheconstructionareamustnotexceed50%ofthelandpremise.
Section3.DEVELOPMENTOFSEPARATEHOUSESOFHOUSEHOLDS,INDIVIDUALS
Article41.-Formsofdevelopingseparatehousesofhouseholds,individuals
1.Developmentofseparatehousesmeansthathouseholdsorindividualsinvestby themselvesinconstructionofhousesin thelandpremisesunder theiruse rights.
2.Constructionofseparatehousesofhouseholdsorindividualsshallbeinoneofthefollowingforms:
a/Self-constructionofhouses;
b/Hiringotherorganizationsorindividualstobuildhouses;
c/Cooperatingwithandassistingoneanotherinhouse constructionin ruralareas.
Article42.-Requirementsondevelopmentofseparatehousesofhouseholds,individuals
1.Households,individualsmusthavelawfullanduserights,havehousesnotbannedfrommodificationorreconstructionaccording totheprovisionsoflawon construction.
2.Developmentofseparatehousesofhouseholds,individualsinurbancenters,ruralresidentialareasmustbeinlinewiththeplanningsapprovedbycompetentauthorities;haveconstructionpermits,exceptforcaseswhereconstructionpermitsarenotrequiredundertheprovisionsoflawon construction.
3.Constructionofseparatehousesinurbancenters mustensureconnectionwithcommonurbantechnicalinfrastructuresystems.
Article43.-Responsibilitiesofhouseholds,individualsindevelopmentofseparatehouses
1.Tocomplywiththeconstructionplanning,architecture,orderandproceduresinconstructioninvestment.
2.Tobear responsibilityforthehousequality.
3.Tocontributelaborandfundtotheconstructionofcommontechnicalinfrastructuresunderregulationsofprovincial-levelPeople’sCouncils.
Article44.-Ruralhouseholds,individuals cooperatewithandassistoneanotherinhouseconstruction
1.Householdsandindividualsinruralareasmayvoluntarilycooperatewithoneanotherinconstructionofhouseswith thefinancialcapability,labor,materialsofthegroupmembers.
2.Groupmembersmustreachagreementonwaysofcontributingcapital,labor,materials,on implementationduration,rightsandobligationsofmembersandcommittorealizethegroup’sagreement.
3.TheStateadoptspreferentialpoliciesonloan termsandinterestratesandsupplymodelhousedesignsformemberhouseholds,individualstobuildhouses.
Section4.DEVELOPMENTOFSOCIALHOUSES
Article45.-Social-housefunds
1.TheStateworksoutmechanismsandpoliciesfordevelopmentofsocial-housefundsfor rentor rent-purchaseby thesubjectsdefinedinArticles53and54ofthisLaw.
2.TheStateencouragesdomesticandforeignorganizationsandindividualsofalleconomic sectorstoinvestinthedevelopmentofsocial-housefunds.
3.Socialhousefund-developingorganizationsandindividualsshallbeexemptfromlanduse levies,landrentsforthelandusedforconstructionofsocialhouses;beentitledtoexemptionfromand/orreductionofrelevanttaxesaccordingtotheprovisionsoflaw.
Article46.-Requirementsonsocial-housedevelopment
1.Toensure the constructionqualityundertheprovisionsoflawon construction.
2.Tosuitlow-incomeearners’capabilitiesofrentpaymentor rent-purchasepayment.
3.Tostrictlymanagetheprocessofinvestment,construction,considerationandapprovalofsubjectsentitledto rent,rent-purchaseanduse thesocial-housefunds.
Article47.-Socialhouse-designingstandards
1.Socialhousesinurbanareasmustbecondominiumsdesignedtomeetgeneralstandardsprescribedby thelawon constructionand tohavethefollowingnumberofstoreys:
a/Inurban centersofspecialgrade,theymustbefive-storeyorsix-storeyhouses;
b/Inurban centersofgrade1,grade2,grade3,grade 4orgrade5,theymustbehouseswithnomorethansixstoreys.
2.Thefloorareaofeachapartmentshallnotexceed60m2andbe completedaccordingtohousegrades,andmustnotbesmaller than30m2.
3.Socialhousesmustsatisfythetechnicalandsocialinfrastructurestandardsprescribedforeachtypeofurban center.
4.Apartfrom theareasspecifiedinClause 1ofthisArticle,inotherareasendowedwithfavorablelandconditions,condominiumswithlessstoreysorseparatehousesmaybebuilt,providedthat the constructionqualitymustcorrespond to thatofhousesofgrade 3orhigherand theprovisionsofClauses2and 3ofthisArticlemustbecompliedwith.
Article48.-Social-housedevelopmentplanning
1.Planningsonconstructionofurbancenters,ruralresidentialareas,economiczones,industrialparks,exportprocessingzones,hi-techparksmustclearlyidentifytheplanningonsocial-houseconstruction.
2.Formulation,approvalandpublicizationofsocialhouseconstructionplanningsshallcomplywith theprovisionsofArticle31ofthisLaw.
Article49.-Landfordevelopmentofsocialhouses
1.Basedontheapproved constructionplannings,landuseplanningsandplansandsocial-housedevelopmentprojects,competentPeople’sCommitteesshallassignorleaselandforinvestmentin theconstructionofsocialhouses.
2.TheStateshallexemptlanduseleviesorlandrentsuponlandassignmentorlandleasefor social-housedevelopmentprojects.
Article50.-Social-housedevelopmentprojectinvestors
1.Provincial-levelPeople’sCommitteesshallselectinvestorsfordevelopmentofsocialhousesunderstateownershipforlease,rent-purchasein theirrespectivelocalities.
2.Organizationsandindividualsdevelopingsocialhousesforthesubjectsdefinedin Articles53and54ofthisLawtorentorrent-purchaseshallbeinvestorsofhousingdevelopmentprojectstheyhaveinvestedin.
3.Investorsshallhavethefollowing responsibilities:
a/Toensurethehouseconstructionprogressandqualitystrictlyaccordingto therequirementsof theapprovedprojects;
b/Tomakepublicandtransparentintheirhead-officesandonthemassmediatheprojects’detailedplannings,thenumberofhouses,thenumberofhousesalreadyleasedorrent-purchased,theremainingnumberofhouses,theleasingprices,thecontentsofregistrationforhouse rent,rent-purchaseandproceduresforsigningcontractsonhouse rent,rent-purchase;
c/Toreporttoprovincial-levelPeople’sCommitteesontheresultsofattainingthetargetssetintheprojectsuponprojectcompletion;
d/Tokeepdocumentsrelatedtoprojectsonconstructionofsocialhousesandtransferthemto unitsmanagingtheoperationofthishousefund.
Article51.-Constructionandmanagementofoperationofsocialhouses
1.Selectionofconsultancyunits,socialhouse-buildingenterprisesmustbeconductedthroughbiddingunder theprovisionsoflaw.
2.Provincial-levelPeople’sCommitteesshalldecideontheselectionofunitsmanagingthe operationofsocialhousefundsaccording tothefollowingprinciples:
a/Incaseswheretwoormoreunits register forbidding,theselectionshallbeconductedthrough biddingasprovidedforbylaw;
b/Incaseswhereonlyoneunitregistersforbidding,suchunitshallbeassignedtoperformthemanagementifitisfully capableandqualifiedforthemanagementofhouseoperation;
c/Incaseswherenounitregistersforbidding,theorganizationsfunctioningtomanagestate- ownedhousesshallbeassigned toperform thejob.
3.Unitsmanagingtheoperationofsocial-housefundsshallenjoytheregimesapplicabletopublic-utilityenterprisesandpreferencesinpublic-serviceactivitiesaccordingtotheprovisionsoflaw.
Article52.-Investmentcapitalsources
1.Investmentcapitalforconstructionofsocialhouses shallbe raisedfrom thefollowingsources:
a/Proceedsfrom thesale,lease,rent-purchaseofstate-ownedhouses;
b/30% to50%oflanduseleviesinhousingdevelopmentprojectsinlocalities;
c/Statebudgetinvestment;
d/Supportmoney,voluntary contributionsofdomesticandforeignorganizationsandindividuals;
e/Moneymobilizedfromotherlawfulcapitalsourcesunder theprovisionsoflaw.
2.TheGovernmentshallspecifysourcesofinvestmentcapitalforconstructionofsocialhouses,unitsmanagingsocial-housefundsand contentsofusemanagementofthesefunds,ensuring the principleofcapitalpreservation.
Article53.-Subjectsentitled toand conditionsforsocialhouse rent
1.Subjectsentitledtorentsocialhousesarepublicservants,officersandprofessionalarmymenofthepeople’sarmedforces,workersineconomiczones,industrialparks,exportprocessingzones,hi-techparksandothersubjectsdefinedby theGovernment.
2.PersonsspecifiedinClause1ofthisArticlewhohavelowincomesandfallinoneofthefollowing casesshallbeentitled torentsocialhouses:
a/Theyhavenohousesunder theirownershipandhavenotyetrentedorpurchasedstate-ownedhouses;
b/Theyhavehousesundertheirownershipbuttheaverageareainthehouseholdisunder5m2offloorarea/person;
c/Theyhavehousesundertheirownership,whichare,however,makeshifts,damagedordilapidated.
Article54.-Subjectsentitled to,and conditionsfor,rent-purchaseofsocialhouses
Thesubjectsentitledto,andtheconditionsfor,rent-purchaseofsocialhousesshallcomplywiththeprovisionsofArticle53ofthisLaw.Social-house rent-purchasersmustmake thefirstpaymentequalto20%ofthevalueoftherent-purchasedhouses.
Article55.-Proceduresforconsiderationandapprovaloflessees,rent-purchasersofsocialhouses
1.Subjectsentitledtorent,rent-purchasesocialhousesmustfiletheirapplicationstoagencies,organizationsorunitswhere theyareworking.
2.Basedon theprovisionsofArticles53and54ofthisLaw,agencies,organizationsorunitsshallgivecertificationofthesubjectsentitledto,andtheconditionsfor,rentorrent-purchaseofsocialhousestotheapplicants.Aftergettingthecertificationoftheiragencies,organizationsorunits, thepersonswishingtorentor rent-purchasesocialhousesshallsendtheirapplicationstoprovincial-level People’sCommitteesfor considerationanddecision.
3.Provincial-levelPeople’sCommitteesshallbaseonthesocial-housefundsandcomparetheprovisionsofthisSection todecideon thelessees,therent-purchasers,tostipulate theorderandproceduresforsocial-houserent,rent-purchase.Wherethesocial-housefundsfailtomeetthedemand,the rent,rent-purchasemustbe conductedinthepriorityorder.
Article56.-Determinationofleasingprices,rent-purchasepricesofsocialhouses
1.Socialhouse-leasingor rent-purchasingpricesmustensure theprinciples:
a/Preserving capitalforfurtherinvestmentinthedevelopmentofsocialhousefunds;
b/Fullycoveringthecostsofmanagement,maintenance,repairduringtheleasingorrent-purchase term.
2.TheGovernmentshallprovidethepricebracketforuseas abasisforprovincial-levelPeople’sCommitteestopromulgatehouse-leasingor rent-purchasepricesin theirlocalities.
Article57.-Principlesforlease,rent-purchaseofsocialhouses
1.Lease,rent-purchaseofsocialhousesmustbecarriedoutfortherightsubjects;lesseesorrent-purchasersmustnotassignhousesinanyformduringtheleaseorrent-purchaseterm,excludingthe caseofhouseinheritancedefinedinClause2,Article106ofthisLaw;iftheyviolatethisprovision,theunitsmanagingthesocial-housefundsshallbeentitledtorecoversuch houses.
2.Withinthesameperiod,eachsubjectspecifiedinArticles53and54ofthisLawmayonlyrentor rent-purchase agivenareaunder thesocial-housenorms.
3.Ifsubjectsentitledtorent-purchasesocialhouses,afterbeinggrantedthehouseownershiprightcertificates,sellsuchhouses,thesocialhousefund-managingunitsshallhavethepre- emptiverightforthepurchase;wherethesocialhouse-managingunitsdonotpurchase,thehouseownersmaysellsuchhousestootherpersons.
Socialhouse-resellingpricesmust,inallcircumstances,notexceedthepricesofnewly constructedhousesofthesametypesetbyprovincial-levelPeople’sCommitteesatthetimeofpayment.
Section5.DEVELOPMENTOFOFFICIAL-DUTYHOUSES
Article58.-Official-dutyhousefund
1.TheStateinvestsbudgetcapitalforconstructionofofficial-dutyhouses.
2.Official-dutyhousesarethoseunderstateownership,whichareconstructedforthesubjectsdefinedinArticle60ofthisLawto rentwhileperformingtheirwork.
Article59.-Responsibilitiestodevelopofficial-dutyhouses
1.Agencieshavingofficialsandemployeesentitledtostayinofficial-dutyhousesmustidentify theirdemandsforofficial-dutyhousesandsendthemtoprovincial-levelPeople’sCommitteesforsum-up.
2.Basedontheresultsofsummingupthedemandsforofficial-dutyhouses,provincial-levelPeople’sCommitteesshalldirecttheelaborationofplannings,plans,projectsforinvestmentinconstructionofofficial-dutyhousesandapprovethemorsubmitthemtothePrimeMinisterforapproval.
3.Provincial-levelPeople’sCommitteesshallorganizetheinvestmentandconstructionandthemanagementofoperationofofficial-dutyhousesin theirlocalities.
Article60.-Subjectsentitled torentofficial-dutyhouses
1.OfficialsandemployeesofPartyandStateagencies,socio-politicalorganizationswhoaretransferredorrotatedaccordingtoworkingrequirementsandhavenoownhousesinlocalitieswhere they cometowork.
2.Professionalofficersofthepeople’sarmedforceswhoaretransferredinserviceofdefenseorsecurity requirements.
3.PartyandStateleaderswhoareentitledtostayinofficial-dutyhouseswhileholdingtheirpositions.
Article61.-Principlesformanagementofofficial-dutyhouses
1.Official-dutyhousesmustbeusedfortherightpurposesand the rightsubjects.
2.Whentheofficial-dutyhouselesseesarenolongerentitledtorentofficial-dutyhousesortransferredtoworkinotherplacesorretirefromtheirwork,theyshallhavetoreturntheofficial-dutyhouses.
3.Incaseswherethelesseesreturntheofficial-dutyhousesandmeetwithhousingdifficulties, theagenciesororganizationswheresuchpersonswork shallworkwiththeprovincial-levelPeople’sCommitteesofthelocalitieswheretheyliveinbasingonthespecificsituationtopermit them torentorrent-purchase theofficial-dutyhouses.
4.The Governmentshallspecify thesubjects,constructioninvestment,managementandleaseofofficial-dutyhouses.
Section6.SUPPORTFOR,FACILITATIONOFHOUSINGIMPROVEMENT
Article62.-Socialpolicybeneficiariesentitledtobeprovidedwithsupportandconditionsforhousingimprovement
1.Personswithmeritoriousservicestothe revolution.
2.Poorhouseholdsinmountainousregionsorareasfrequentlyaffectedbynaturaldisasters.
3.Particularlydisadvantagedhouseholds.
Provincial-levelPeople’sCommitteesshallspecifypoorhouseholds,particularlydisadvantaged householdsdefinedinClauses2and 3ofthisArticleassuitable tothelocalsituation.
Article63.-Conditionsforbeingprovidedwithsupports,conditionsforhousingimprovement
Socialpolicybeneficiariesentitledtobeprovidedwithsupports,conditionsforhousing improvementdefinedinClauses2and3ofArticle62ofthisLawmustfallinoneofthecasesmeetingwithhousingdifficultiesdefinedinClause2,Article53ofthisLaw.
Article64.-Formsofhousingimprovementsupports,conditions
TheState,economicorganizations,socialorganizations,populationcommunitiesshallprovidesupportsandconditionsforsocialpolicybeneficiariestoimprovetheirhousingconditionsinoneofthefollowingforms:
1.Fundingsupportforpurchaseofhouseswithdeferredpaymentorinstallmentpaymentorrentofhouses;
2.Exemptionfromor reductionoflanduselevieswhentheypurchasestate-ownedhousesorareassignedlandby theStateforhouse construction;
3.Provisionofsupportsinfunding,materials,laborforrepair,renovationorconstructionofhouses;
4.Donationofgratitudehouses,charityhouses.

MANAGEMENT OF USE OF HOUSES
Section1.GENERALPROVISIONSONMANAGEMENTOFUSEOFHOUSES
Article65.-Contentsofmanagementofuseofhouses
1.Compilingandarchivinghousingdossiers.
2.Providingwarranty,maintenanceof,renovatingordemolishinghouses.
Article66.-Compilationandarchiveofhousingdossiers
1.Dossiersare requiredforalltypesofhousesandmustbearchived.
2.Houseowners,organizationsassigned tomanagestate-ownedhousefundsor currentusersofhousesofwhichtheownersarenotyetidentifiedshallhavetocompileandarchivehousedossiersandsubmitonecopythereoftoagencieswhichgranthouseownershiprightcertificatesforarchivalinserviceofhousemanagement.
3.Housedossierssubmittedtohouseownershiprightcertificate-grantingagenciesshallbe providedasfollows:

b/ForruralhousesestablishedfromtheeffectivedateofthisLaw,ahousedossiershallcoverthefollowingcontents:thenameandaddressofthehouseowner;oneofthepapersspecifiedinArticle15ofthisLaw;thedesigndrawingorthedrawingoftheplanofthehouse,residentialland(ifany);
c/ForhousesestablishedbeforetheeffectivedateofthisLaw,ahousedossiershallcoverthefollowingcontents:thenameandaddressofthehouseowner;oneofthepapersspecifiedinArticle15ofthisLaw.
Article67.-Houseinsurance
1.TheStateencourageshouseownerstobuyhouseinsurance.
2.Thehouseinsurancecontentsandproceduresshallcomplywiththeprovisionsoflawon insurancebusiness.
Article68.-Houseowners’responsibilitiesin theuseofhouses
1.TocompileandarchivehousedossersaccordingtotheprovisionsofClause2,Article66of thisLaw.
2.Toimplementregulationsonhouseuse;tokeepandpreservehouses,toensurefirepreventionandfighting,environmentalsanitation,securityandorder;toperformfinancial obligationsinthe courseofusinghousesasprovidedforbylaw.
3.Whencausingdamagetohousesectionsundercommonownershiporhousesofotherowners,torestoretheoriginalstatethereoforpaycompensationsaccordingtotheprovisionsoflaw.
4.Toconductmaintenanceofsectionsundertheirprivateownershipaccordingtoregulations;tocontributefullyandontimefundingamountspayableunderregulationsonmanagement,operation,maintenanceofthesystemofequipment,systemoftechnicalinfrastructure,housesectionsunder commonownership.
5.Tocreateconditionsforrelatedpartiesandresponsiblepersonstoconductinspection,supervisionandmaintenanceofequipmentsystem,technicalinfrastructuresystem,housesectionsunder commonownership.
Article69.-Responsibilitiesofhouseuserswhoarenothouseowners
Personswhorent,borrowortemporarilystayin,orareauthorizedtomanageotherpeople’shousesshallhavetousesuchhousesundercontractssignedwiththehouseownersandstrictly complywith thisLaw’sprovisionsonhouseuse.
Section2.MANAGEMENTOFUSEOFCONDOMINIUMS
Article70.-Sectionsunderprivateownershipandsectionsundercommonownershipincondominiums
1.Condominiumsarehouseswithtwoormorestoreys,whichhavepassages,staircasesand infrastructuresystemscommonlyusedbymanyhouseholds,individuals.Condominiumscomprisesectionsprivatelyownedbyfamiliesorindividualsandsectionsunderthecommonownershipofallhouseholdsandindividualsusingsuchcondominiums.
2.Sectionsunderprivateownershipin condominiumsinclude:
a/Areasinsideapartments,includingbalconyareas,loggiasattached tosuchapartments;
b/Otherareasincondominiums,recognizedtobeunderprivateownershipundertheprovisionsoflaw;
c/Systemsofexclusive-usetechnicalequipmentattachedtoapartments,theareasunderprivate ownership.
3.Sectionsunder commonownershipincondominiumsinclude:
a/AreasofcondominiumsotherthantheareasunderprivateownershipdefinedinClause2of thisArticle;
b/Spaceandsystemsofforce-bearingstructures,technicalequipmentundercommonuseincondominiums,includinghouse frames,pillars,force-bearingwalls,wallssurrounding thehouses,apartmentpartitionwalls,floors,roofs,tops,corridors,steps,lifts,exits,garbagedischargepipes,technicalboxes,carparks,systemsofpower,waterorgassupply,communications,radioandtelevision,waterdrainage,decomposttanks,lightningarresters,firefightingandothersectionsnotunderprivateownershipofanyapartment;
c/Systemsofoutsidetechnicalinfrastructuresconnected to condominiums.
Article71.-Organizationofuseofcondominiums
1.Foreachcondominium,amanagementboardmustbeformedtoactasrepresentativeofownersandusersinprotectingtheirrightsandlegitimateinterestsinthecourseofusingthecondominium.
Withintwelvemonthsaftercondominiumsareputtouse,investorsshallhavetoorganizemeetingsofcondominiumownersandusers(hereinaftercalledthecondominiummeetings)to electmanagementboards.Investorsshallhavetopreparerelevantcontentsforconsiderationanddecisionatthe condominiummeetings.
Pendingtheestablishmentofamanagementboard,investorsshallhavetoperformthetasksofthemanagementboard.
2.Acondominiummanagementboardshallcompriserepresentativesofownersandusersofsuch condominium.
3.Themembershipofamanagementboardshallbedecidedbythecondominiummeeting.Thetermofamanagementboardshallbethree yearsatmost.Themanagementboardsshalloperateon theprincipleofcollectivenessanddecisionbymajority.
Article72.-Rightsand responsibilitiesofmanagementboards
The condominiummanagementboardshallhavethefollowingrightsand responsibilities:
1.Toelaborateinternalrulesontheuseofthecondominium,suitable to thespecific conditionsofthecondominiumandinaccordancewiththeprovisionsoflawandsubmitthemtothecondominiummeetingsforconsiderationandadoption;
2.Toselectandsigncontractswithcondominiumoperation-managingenterprises;tocancelcontractsincaseswheresuchenterprisesfailtocomplywiththeircommitments;tosupervisethe operationsofcondominium-managingenterprisesaccording tothe contentsofsigned contracts;
3.Togatherandsumupusers’opinionsandproposals relating to the condominiummanagementanduseandthecondominiumserviceprovision,andworkwithfunctionalbodies,relevantorganizationsandindividualsinconsiderationandsettlementthereof;
4.Toinspectandsupervisetheuse,warrantyandmaintenanceofthecondominiumaccordingtoregulations;
5.Tocoordinatewithlocaladministration,populationgroupsinbuildingupcivilizedlifestyle,maintainingsocialorderandsafetyinthe condominiumassigned to themformanagement;
6.Tocollectpayableamountsfromhouseownersandusersaswellaschargesfortheuseofsectionsunder commonownershipofthe condominium (ifany);
7.Tomakepaymentstocondominiumoperation-managingenterprisesundersignedcontractsandpayresponsibilityallowancestomembersofthemanagementboardsandotherexpensesaccording toregulationsofthe condominiummeetings;
8.Toperformothertasksassignedby condominiummeetings.
Thecentralagencyperformingthestatemanagementofhousesshallissueregulationsoncondominiummanagement,guideandinspectthemanagementanduseofcondominiumsthroughoutthe country.
Article73.-Condominiumoperation-managingenterprises
1.Managementofcondominiumoperationmustbeperformedbyenterpriseshavingprofessionalcapabilitiesinmanagementofcondominiumoperation.
Condominiumoperation-managingenterprisesshallmanageandoperatetechnicalsystems,equipmentandfacilities,provideservicesfor condominiums,maintain condominiumsandperformothertasksunder contractssignedwith the condominiummanagementboards.
2.Condominiumoperation-managingenterprisesareorganizedtomanagecondominiumsin differentgeographicalareas.
Incasesalocalityhasnocondominiumoperation-managingenterpriseyet,thecondominiummanagementboardsmaysigncontractswithcondominiumoperation-managingenterprisesinotherlocalitiesformanagementofthecondominiumsorinvestorsshallhavetomanageand provideservicesfor condominiums.
3.Condominiumoperationmanagementservicesshallenjoyregimesapplicabletopublic services.
Section3.HOUSEWARRANTY,MAINTENANCE,RENOVATION
Article74.-Housewarranty
1.Housesshallbeprovidedwithwarrantyafter theyare completelyconstructedandputtouse.
2.Organizationsorindividualsbuildinghousesshallhavetoprovidewarrantyforhouses;organizationsandindividualssupplyinghouseequipmentshallhavetoprovidewarrantyforthe equipmenttheyhavesupplied.
Wherehousesareconstructedwithinvestmentforsale,thehousesellersshallhavetoprovidewarrantyforadurationspecifiedinClause4ofthisArticle.Thehousesellersmayrequestorganizationsorindividualsthathaveconstructedthehousesorsuppliedequipmenttoperform thewarranty responsibilityforsuchhouses.
3.Thewarranty contentsshallcovertherepair,replacementofhousestructures,damaged equipment,defectsorabnormaloperation,forwhich theusersarenotatfault.
4.Thehousewarrantyperiodshallbecountedfromthedatetheinvestorssigntheminutesonacceptanceofhousesforputting touseandbespecifiedasfollows:
a/Atleastsixtymonthsforcondominiumsofnineormorestoreysandhousesofothertypeswhichare constructedwith thestatebudgetinvestment;
b/Atleastthirtysixmonthsforcondominiumsofbetweenfourandeightstoreys;
c/AtleasttwentyfourmonthsforhousesotherthanthosespecifiedatPointsaandbofthisClause.
Article75.-Housemaintenance
1.Housemaintenancemeansperiodicalmaintenanceofhousesandrepairupondamagein order tomaintainthehousequality.
2.HouseownersshallhavetomaintaintheirhousesundertheprovisionsofthisLawandtheprovisionsoflawon construction.
Article76.-House renovation
1.House renovationmeansupgradingorexpansionoftheexistinghouses.
2.Houseownersmayrenovatetheirhouses;personswhoarenothouseownersmayrenovatehousesincaseswherethehouseownerssoagreeinwriting.Renovationofhousesmustcomplywith theprovisionsofthisLawand theprovisionsoflawon construction.
Article77.-Housemaintenance,renovationrequirements
1.Toensuresafetyforhumansandproperty,environmentalsanitationundertheprovisionsoflaw.
2.Tocarryoutrenovationinstrictaccordancewithconstructionpermits,forcaseswhererenovation requiresconstructionpermits.
Article78.-Rightsandobligationsofhouseownersinmaintenanceand renovationofhouses
1.Houseownersshallhavethefollowing rightsinhousemaintenanceand renovation:
a/Toconductmaintenance,renovationofhousesbythemselvesorhireorganizationsorindividualshavingfullcapabilityforpracticingconstructiontoperformthejob.Incaseofhouseoverhaulor renovationwhich,underregulations,requires constructionpermits,thehouseownersmayonlyperform thejobbythemselvesiftheyarefullycapableofpracticing construction;
b/Torequestfunctionalagenciestograntpermitsandcreateconditionsforhouserenovationwhen the conditionsprescribedby thelawon constructionarefullymet;
c/Toauthorizeotherpersonstocarryouttheproceduresandperformthemaintenance,renovationoftheirhouses.
2.Houseownersshallhavethefollowingobligationsinhousemaintenanceand renovation:
a/Tofullycomplywiththeprovisionsoflawonhousemaintenanceandrenovation;tocreateconditionsforotherhouseownerstoperform themaintenanceand renovationoftheirhouses;
b/To compensatefordamage causedby themaintenance,renovationoftheirhouses;
c/Afterrepairorrenovation,ifthecurrentstatusofthehouseschangesascomparedwiththecontentsin thegrantedhouseownership rightcertificates,thehouseownersmustgotoagencies competenttogranthouseownershiprightcertificatesforcertificationofsuchchangesinthecertificates.
Article79.-Maintenance,renovationofhousescurrentlyonlease
1.Thehouselessorsshallperform themaintenanceor renovationofhousesonlease.Thehouse lesseesmustcreateconditionsforthehouselessorstoperform thehousemaintenanceor renovation.
2.Thehouselessorsmayrenovatethehousesuponthelessees’consent,exceptforforcemajeurereasons.Thehouselessorsmayadjusttherentsreasonablyafterthecompletionofrenovationifthe remaininglease termrepresentsone-thirdorlessofthecontractualterm.In casethelesseesdisagreewiththerentadjustment,theymayunilaterallyterminatethehouse-leasingcontractsandgetcompensationsfordamageasprovidedforbylaw.
3.Wherethelesseeshavetomovetootherplacesforhousemaintenanceorrenovation,thepartiesshallreachagreementontemporarydwellingplacesandhouserentsinthemaintenance orrenovationperiod.Wherethelesseesarrangethelodgingsbythemselvesandhavealreadypaidtherentsfor thewholemaintenanceorrenovationperiod,thehouselessorspaythelessees thepaid rentamountsforthemaintenanceor renovationduration.Themaintenanceor renovationdurationshallnotbecountedintothetermofthehouseleasecontracts.Thelesseesmay continue renting thehousesupon completionofhousemaintenanceor renovation.
4.Thehouselesseesmayrequestthelessorstomaintainthehouses,exceptforcaseswherethehousessufferdamagecausedbythelessees.Wherethelessorsdonotrepairthehouses,thelesseesmayrepairthembutmustnotifysuchtothelessorsatleastthirtydaysinadvance.Thewrittennoticemustclearlystate the repairextentand cost.Thelessorsmustrepaythe repair costto thelesseesorgraduallydeductitfrom thehouse rents.
Article80.-Maintenance,renovationofhousesundercommonownership.
1.Ownersofhousesundercommonownershipshallhavetherightandobligationtomaintain andrenovatehousesundercommonownershipcorrespondingtotheirrespectiveownershiprights;incaseswheretheownershiprightsofeachownerofthehousesundercommon ownershipcannotbeidentified,themaintenanceorrenovationresponsibilityshallbeequallydividedtoallownersofthehousesundercommonownership.Therenovationofhousesundercommonownershipmustbeagreeduponinwritingbytheowners.
2.Shareofcostsofmaintenance,renovationofsectionsundercommonownershipshallbeagreeduponbyownersofhousesundercommonownershipandmadeinwritingwithsignaturesoftheparties.
Article81.-Condominiummaintenance,renovation
1.Condominiumownersshallhavetheresponsibilitytomaintainthesectionsundertheirrespectiveprivateownership,andfulfilltheobligationinmaintenanceofthesectionsundercommonownership.
TheGovernmentshallspecifyfundingamountsforthemaintenanceofcondominiumsectionsunder commonownership.
2.Renovationofmulti-storeycondominiumsmustbecarriedoutwithdesignsandcostestimatesapprovedby competentauthorities;in caseofareaexpansion,itmustbeagreeduponbyatleasttwo-thirdsofthe totalnumberofcondominiumowners.
Article82.-Maintenanceand renovationofhousesunderstateownership
1.Maintenanceofstate-ownedhousesshallbeperformedbyagenciesorenterprisesassignedby theStatetomanagesuchhouses.
Renovationofstate-ownedhousesmustbecarriedoutaccordingtodesignsandcostestimatesalreadyapprovedbycompetentstatebodies.
2.State-ownedhousesleasedorusedasofficial-dutyhousesshallberenovatedundertheprovisionsofArticle79ofthisLaw;in caseswherehousemanagingagenciespermitinwritingthe official-dutyhouselesseestocarryouttherenovationwiththeirownmoney,therenovatedsectionsofthehousesstillbelongtostateownershipandtheorganizationsassignedtomanagesuchhousesshallhavetorefundthemoneyamountstothehouselesseesorgraduallydeduct themfrom rentspayableby thelessees.
Section4.HOUSEDEMOLITION
Article83.-Housessubjecttodemolition
1.Houseswhicharedamaged,degradedandindangerofcollapseasconcludedbycompetentconstructionqualityinspectionbodies.
2.Housessubjecttoclearanceforland recoveryunderdecisionsofcompetentstatebodies.
3.Multi-storey condominiumswithexpireduseduration.
4.Housessubjecttodemolitionundertheprovisionsoflawon construction.
Article84.-Responsibilitiestodemolishhouses
1.Houseownersshallhavetheresponsibilitytodemolishhouses.Incaseswherehousesmustbeclearedforconstructionofotherworks,theworkinvestorsshallhavetheresponsibilityto demolish thehouses.
2.Houseownersshallthemselvesdemolish thehousesiftheyarefully capable thereofunder the provisionsoflawonconstructionorhirecapableconstructionorganizationsorindividualstodemolish thehouses.
3.Demolitionofcondominiumsoftwoormorestoreysandotherhousesoffourormorestoreysmustbeperformedbycapableconstructionenterprisesunderspecificdemolitionschemesapprovedby competentstatebodies,exceptforemergency cases.
4.Commune-levelPeople’sCommitteesshallhavetomonitorandurgethedemolitionofhousesin theirrespectivelocalities.
Article85.-Housedemolition requirements
1.To removepeopleandpropertiesfromareasunderdemolition.
2.Toputupsignboardsandtakemeasuresforisolationwithsurroundingareas.
3.Toensuresafetyforpeople,properties,adjacentworks,technicalinfrastructuresnotsubjectto demolitionandensureenvironmentalsanitationaccording to theprovisionsoflaw.
4.Nottodemolishhouseslocatedinresidentialareasbetween12.00hrsand13.00hrsandbetween22.00hrsand05.00hrs,exceptforemergency cases.
Article86.-Coercivedemolitionofhouses
1.Wherehousesmustbedemolishedunder theprovisionsofArticle83ofthisLawbutthehouseowners,projectinvestorsor currentmanager-usersdonotvoluntarilydemolishthehouses,competentstatebodiesshallissuedecisionsto coercethedemolition.
2.Competence toissuedecisionson coercivedemolitionofhousesisprovidedasfollows:
a/Provincial-levelPeople’sCommitteesshallissuedecisionsoncoercivedemolitionofmulti-storey condominiumsandstate-ownedhouses;
b/District-levelPeople’sCommitteesshallissuedecisionson coercivedemolitionofhousesotherthan thosespecifiedatPointaofthisClause.
3.Fundingforcoercivedemolitionofhousesisprovidedforasfollows:
a/Houseownersorprojectinvestorsshallhavetobearthecostsofcoercionandexpenses related tothedemolition;
b/Wherehouseownersorprojectinvestorsrefusetopay,competentstatebodiesshallissuedecisionsonapplicationofcoerciveproperty-relatedmeasuresto recoverthedemolitioncosts.
Article87.-Lodgingsforhouseholds,individualsupondemolitionoftheirhouses
1.Houseownersmustfindlodgingsforthemselveswhen theirhousesaresubjecttodemolition.
2.Wherethehousessubjecttogroundclearancearedemolished,thelodgingsofhouseholdsorindividualsshallbesettledinaccordancewiththepoliciesoncompensation,supportandresettlementuponlandrecoverybytheStatebuttheprinciplethatthenewlodgingsofhouseholdsandindividualsmustbeequal toorbetterthan theirformerlodgingsisguaranteed.
Article88.-Demolitionofhousescurrentlyonlease
1.Thehouselessorsmustnotifyinwritingthehouselesseesofthetimefordemolition,theirrightsandobligationsduringthedemolitionprocessatleastthreemonthsbeforecarryingoutthe demolition,exceptforurgentcases.
2.Incaseswheredemolitioniscarriedoutforreconstructionofhousesduringtheleasingterm,thelessorsshallhavetheresponsibilitytoarrangenewlodgingsforthelesseesduringthereconstructionofhouses,exceptwherethelesseesagreetofindlodgingsbythemselves.Whenthehousereconstructionis completed,thehouselesseesshallbeentitled tocontinuerentingthehousesuntiltheexpirationofcontracts.Wherethelesseesfindthelodgingsbythemselves,theymustnotpayrentsfortheperiodofhousedemolitionandreconstruction;thedemolitionandreconstructionperiodshallnotbe countedintothehouse-leasing term.
Article89.-Demolitionofhousesathouseowners’demands
1.Demolitionofhousesathouseowners’demandsmustcomplywith theprovisionsofArticles84and85ofthisLaw.
2.Demolitionofcondominiumsofmanyownersatdemandmustbeagreeduponbytwo-thirdsof thetotalnumberofcondominiumownersandmustcomplywiththeprovisionsofArticles84and85ofthisLaw.
3.Wherecondominiumsaredemolishedforreconstruction,theremustbeprojectsapprovedby competentstatebodies,ensuringtherightstoresettlementandthelegitimateinterestsofcondominiumownersaccording totheprovisionsoflaw.
Chapter V
HOUSE-RELATED TRANSACTIONS
Section1.GENERALPROVISIONSONHOUSE-RELATEDTRANSACTIONS
Article90.-Formsofhouse-relatedtransactions
House-relatedtransactionscoverformsofsaleandpurchase,lease,rent-purchase,donation,exchange,inheritance,mortgage,lending,permittedtemporarystaybyothersandauthorizedmanagementofhouses.
Article91.-Conditionsforhousestobe transacted
1.Inthetransactionsofsaleandpurchase,donation,exchange,inheritance,mortgage,lending,permittedtemporarystaybyothers,authorizedmanagementofhouses,thehousesmustsatisfy thefollowing conditions:
a/Havinghouseownership rightcertificatesasprovidedforbylaw;
b/Beingfreefromdisputesoverownership rights;
c/Notbeingdistrainedforexecutionofjudgmentsorexecutionofadministrativedecisionsof competentstatebodies.
2.Forleasedhouses,apartfromtheconditionsstatedinClause1ofthisArticle,theymustensurethequality,safetyforhouselessees,thepowerandwatersupply,environmentalsanitationandsatisfyotheressentialconditions.
3.Forrent-purchasedhouses,thestandardsprovidedforinSection4,ChapterIIIofthisLawmustbeensured.
Article92.-Conditionsonparticipantsinhouse-relatedtransactions
1.Housesellers,lessors,lease-sellers,donors,exchangers,mortgagors,lenders,temporarystaypermittersandmanagementauthorizersmustsatisfythefollowing conditions:
a/Beinghouseownersor representativesunder theprovisionsofcivillaw;
b/Havingcivilactcapacity,forindividuals;havinghousingbusinessfunction,fororganizations sellingorleasinghouses,exceptforcaseswhereorganizationssellhousesnotforbusinesspurposes.
2.Housepurchasers,lessees,rent-purchasers,exchangees,donees,borrowers,temporarystayers,managementauthorizedareorganizationsorindividuals;ifbeingdomesticindividuals, theymusthavecivilactcapacity regardlessoftheirplacesofpermanentresidenceregistration;ifbeingoverseasVietnamese,theymustbesubjectsentitledtoownorleasehousesinVietnamundertheprovisionsofthisLaw;ifbeingorganizations,theyshallnotdependontheirplacesofbusinessregistration.
Article93.-Orderandproceduresforhouse-related transactions
1.Thepartiesshalldirectlyorthroughtheirrepresentativesreachagreementonthesaleandpurchase,rent-purchase,donation,exchange,mortgage,lending,permittedtemporarystay,authorizedmanagementofhouses (hereinafterreferredcollectivelytohousecontracts).Incaseswherelegalpersonsdonatehouses,theremustbehouse-donationdocuments.
2.House contracts,house-donationdocumentsmusthavethefollowing contents:
a/Namesandaddressesoftheparties;
b/Descriptionofcharacteristicsofthehouses;
c/Priceandpaymentmode,ifthecontractcontainstheagreementonprice;
d/Timeforhand-overandreceiptofthehouse;thewarrantyduration(ifany);thedurationofhouseleasing,lending,permitted temporarystay,authorizedmanagement;
e/Rightsandobligationsoftheparties;
f/Commitmentsoftheparties;
g/Other commitments;
h/Day,month,yearofsigningthe contractordocument;
i/Signaturesoftheparties(thesealsand thepositionsofthesignees,fororganizations).
3.Housecontractsmustbecertifiedbypublicnotariesorauthenticatedbydistrict-levelPeople’sCommitteesforurbanhouses,authenticatedbycommune-levelPeople’sCommitteesforrural houses,excluding thefollowing cases:
a/Individualslease theirhousesforlessthansixmonths;
b/Thehousesellers,lessorsareorganizationshavingthefunction todealinhouses;
c/Rent-purchaseofsocialhouses;
d/Thehousedonorsareorganizations.
4.Eitherofthepartiesshall,accordingtotheirmutualagreement,paytaxesandfeesaccordingtoprovisionsoflaw.
5.Housepurchasers,donees,exchangees,heirsshallhavetosubmitdossiersforbeinggranted houseownershiprightcertificatesaccordingtotheprocessprovidedforinArticle16ofthisLaw,exceptthecaseswherethehousesellersareorganizationshavingthe functiontodealinhousesorwherethepartiesotherwiseagree.Thehouseownershiprightsshallbetransferredtothe purchasers,donees,rent-purchasers,exchangeesasfromthetimethecontractsarenotarized,forhouse-relatedtransactionsbetweenindividualsorthehouseshavebeenhandedoverandreceivedasagreedincontracts,forhouse-relatedtransactionstowhichapartyisahouse- dealingorganizationorfrom thetimeofopeningtheinheritance,for casesofinheritinghouses.
6.Forcasesofleasing,lending,permittingtemporarystayin,authorizingthemanagementof,housesforsixmonthsormore,thelessors,lenders,temporarystaypermitters,managementauthorizersmustsubmittothecommune-levelPeople’sCommitteesofthelocalitieswherethehousesexistthecopiesofcontractsregardingtheprovisionsin thisClause.
7.Theorderofmortgaginghousesshallcomplywiththeprovisionsofcivillaw.Mortgageesmay keepthehouseownershiprightcertificatesinthemortgageduration,exceptotherwiseagreeduponby theparties.
Section2.HOUSETRADING
Article94.-House tradingprices
Housetradingpricesshallbeagreeduponbytheparties.Incasethehousepricebracketisprovidedforbylaw,thetradingpricesmustnotexceedsuchbracket.
Article95.-House tradingwithdeferredpayment,installmentpayment
1.Housetradingwithdeferredpaymentorinstallmentpaymentshallbeagreeduponbythepartiesandstatedinhouse-tradingcontracts.Intheperiodofdeferredpaymentorinstallmentpayment,thehousepurchasersareentitledtousethehousesandhavetheresponsibilitytomaintainsuchhouses,exceptthecaseswherethehousesremaininthewarrantyperiodundertheprovisionsoflawon constructionorotherwiseagreeuponby theparties.
2.After thehousepurchasershavefullypaid thehousesellersand carriedouttheproceduresforgrantofhouseownershiprightcertificates,theyshallbegrantedhouseownershipright certificatesby competentstatebodies.
3.Thehousepurchasersmaysell,donateorexchangehousestootherpersonsonlyaftertheyhavemadefullpaymentto thehousesellers,exceptthe caseswhere thepartiesotherwiseagreeupon.
4.Where thehousepurchaserswish to return thepurchasedhouseswithin theperiodofdeferredpaymentorinstallmentpaymentandobtain the consentsofthesellers,the twopartiesshallreach agreementonmodesofreturningthehousesand refunding themoneypaidforthehouses.
Article96.-Tradinghousesunder commonownership
1.Saleofhousesunder commonownershipbyintegrationmustbe consentedinwritingbyalltheowners
In caseswhereanownerofahouseunder commonownershipdoesnotagree tosellit,theotherownersofsuchhousemayfiletheirapplicationrequestingthecourttosettlethecaseaccordingtotheprovisionsoflaw.Ownersofthehousesundercommonownershipshallhavethe preemptive righttobuy thehouses;iftheownersofhousesunder commonownershipdonotbuythehouses,suchhousescanbesold tootherpersons.
In caseswhereanownerofahouseunder commonownershipisabsent,whohasbeendeclaredmissingby thecourt,theremainingownersofsuchhousemaysellthehouse;thehouseownershiprightvalueofthemissingpersonshallbehandledaccordingtotheprovisionsofcivillaw.
2.Incaseswhereanownerofahouseundercommonownershipsellshis/herownershipright, theotherhouseowners shallhave thepreemptiverighttobuyit;withinthreemonthsasfromthedateofreceiving thenoticeonsaleofownershiprightandtheselling conditions,ifnotanyownerbuys,suchownershiprightpartshallbesoldtootherpersons.Incaseswherethepre-emptiverightsareviolated,theviolatorsshallbehandledaccording totheprovisionsofcivillaw.
Article97.-Tradingofhousescurrentlyonlease
Whereownerssellhouseswhicharecurrentlyonlease,theymustnotifythelesseesofthesale andthehouse-sellingconditions;thelesseesshallhavethepreemptiverights tobuyiftheyhave nootherlodgingsandhavefulfilledtheirobligations,exceptthecaseswherethehousesbelongtopersonalownershipandhousesbelongtocommonownership.Withinonemonthafterthereceiptofnotices,ifthelesseesdonotbuy,thehouseownersmaysellsuchhousestootherpersons,exceptwhere thepartiesotherwiseagreeon the timelimit.
Article98.-Prior-purchaseofhouses
WhenthepartieshavealreadysignedcontractsonhousetradingbuttheStatehasthedemandtobuysuchhousesforusefornationalinterestsorpublicinterests,thepresidentsofprovincial- levelPeople’sCommitteesshallissuedecisionsonprior-purchaseofsuchhouses.Theprices, conditionsandpaymentmodesshallcomplywiththeagreementinhouse-tradingcontracts concludedbytheparties.TheStateshallpaydamagestotheparties(ifany).Thehouse-tradingcontractsconcludedby thepartiesshallbenolongerlegallyvalid.
Section3.HOUSELEASE
Article99.-House-leasingprices
1.House-leasingpricesshallbeagreeduponbytheparties.Wherethehouse-leasingpricebracketisprovidedforbylaw,theleasingpricesmustnotexceed thatbracket.
2.Wherethecontractshavenotyetexpiredbutthehouselessorsrenovatethehousesandgettheconsentofthelessees,thelessorsmayadjustthehouse-leasingprices.Thenewhouse-leasingpricesshallbeagreeduponbytheparties;wheretheycannotreachagreement,thelessorsmayunilaterallyterminatethehouse-leasingcontractsandmustpaycompensationstothelesseesaccording totheprovisionsoflaw.
Article100.-Leaseofhousesunder commonownership
1.Leaseofhousesundercommonownershipmustbeconsentedinwritingbyalltheownersofsuchhouses,exceptthecaseswhereownersofthehousesundercommonownershipleasethehousesectionsunder their respectiveownership.
2.Ownersofhousesundercommonownershipmayagreetonominatetheirrepresentativestosignhouse-leasing contracts.
Article101.-Leaseofhousesunderstateownership
1.Leaseofstate-ownedhousesmustbefortherightsubjects.Thehouselesseesmustusethehousesfor therightpurposes,mustnotassign,exchangeorsublease them.
2.Unitsassignedtomanagestate-ownedhousefundsshallhavetomanagetheuseofhouses,maintainand renovate themaccordingto regulationsonmanagementofstate-ownedhouses.
Article102.-Caseswherehouse-leasing contractsterminate
1.House-leasingcontractshaveexpired;wherecontractsfailtoidentifytheterm,thecontractsshallterminateaftersixmonthsasfromthedatethelessorsnotifythelesseesoftheterminationofthe contracts.
2.Theleasedhousesnolongerexist.
3.Thelesseeshavediedwithoutanyonelivingtogether.
4.Theleasedhousesareheavilydamaged,indangerofcollapseorlocatedinareassubjecttoland recovery,ground clearanceorhousedemolitionunderdecisionsofcompetentstatebodies.
Article103.-Unilateral terminationofperformanceofhouse-leasing contracts
1.Thehouselessorsmayunilaterallyterminatethe contractswhen thelesseescommitoneofthefollowingacts:
a/Failingtopayrentsasagreeduponincontractsfor threeormoreconsecutivemonthswithoutplausible reasons;
b/Using thehousesnotfortheagreedpurposes;
c/Deliberatelydamaging theleasedhouses;
d/Repairing,renovating,exchangingthehousestheyarerenting,orsubleasingsuchhouseswithoutthe consentofthehouselessors;
e/Causingdisorder,environmentalunhygiene,whichseriouslyaffectsthedailylifeofpeople aroundandhasnotbeenredressedeventhoughsuchactshadbeenrecordedforthethirdtimeby thelessors,populationgroupleaders,villageorhamletchiefs.
2.Thelesseesmayunilaterallyterminatethehouse-leasingcontractswhenthelessorscommitoneofthefollowingacts:
a/Failingto repairtheirhouseswhen theyareheavilydamaged;
b/Increasingthehouse-leasingpricesunreasonablyorincreasingthepriceswithoutnotifyinginadvance thelesseesthereofasagreedupon;
c/When thehouseuse rightsare restricteddue tointerestsofthe thirdperson.
3.Thepartyunilaterallyterminatingthehouse-leasingcontractsmustnotifytheotherpartyatleastonemonthinadvance,unlessotherwiseagreeduponby theparties.
4.Thepartyunilaterallyterminatingthehouse-leasingcontractsviolates theprovisionsofClause3ofthisArticle;ifcausingdamage,itmustcompensatethereforaccordingtotheprovisionsoflaw.
Article104.-The righttocontinue rentinghouses
1.Wherehouseownersdiewhilethehouse-leasingtermhasnotexpired,thelesseesmay continuerentingthehousesuntiltheexpirationofthecontracts.Theheirsshallhavetheresponsibilitytocontinueperformingthepreviouslysignedhouse-leasingcontracts,unlessotherwiseagreeduponby theparties.
Incaseswherethereisnoheirundertheprovisionsoflaw,suchhousesshallbelongtostate ownershipandthecurrentlesseesmaycontinuerentingthehousesuntiltheexpirationofthecontracts.
2.Incaseswherehouseownerstransfertheownershiprightstothehousescurrentlyleasedwhilethehouse-leasingtermhasnotexpired,thelesseesmaycontinuerentingthehousesuntiltheexpirationofthecontracts;newhouseownersshallhavetheresponsibility tocontinue performingthepreviouslyconcludedhouse-leasingcontracts,unlessotherwiseagreeduponbytheparties.
3.Whenthehouselesseesdiewhilethehouse-leasingtermhasnotexpired,thepersonswho livedtogetherwiththelesseesmay continuerentingthehouses tilltheexpirationofsuchcontracts,unlessotherwiseagreeduponby theparties.
Section4.RENT-PURCHASEOFSOCIALHOUSES
Article105.-Proceduresforrent-purchaseofsocialhouses
1.Rent-purchaseofsocialhousesmeansthatthehouselesseesarerecognizedbycompetentstatebodiestohavetheownershiprightsoverthehousestheyarerentingafterfulfillingthelessees’obligationswithinasetperiodoftime.
2.Rent-purchaseofsocialhousesmustbecarriedoutundercontractsconcludedbetweenunitsassigned tomanage thesocial-housefundsand the rent-purchasers.
3.Upontheexpirationofthe contractualrent-purchaseterm,the rent-purchasersofsocialhousesmustcarryouttheproceduresaccordingtotheprovisionsofArticle16ofthisLawforbeing grantedhouseownership rightcertificates.
Article106.-Rightsandobligationsofsocial-house rent-purchasers
1.Social-houserent-purchasersmustnottransfertherent-purchaserightsinanyform.Incaseswheretheynolongerhavetherent-purchasedemands,theymustreturnsuchhousestosocial-housemanagingunits.Socialhouse-managingunitsmustrefundasumofmoneyequalto20%ofthe contractualvalueinitiallypaidbysocial-house rent-purchasers.
Ifthesocial-houserent-purchaserstransfertherent-purchaserightstootherpersons,socialhouse-managingunitsshallbeentitled to recover thehouseswithouthavingto refund themoneyamountsinitiallypaidbysocial-house rent-purchasers.
2.Where asocial-house rent-purchaserdies,the caseshallbesettledasfollows:
a/Ifhis/herlawfulheir(s)has(have) coinhabitedin thathouse,suchlawfulheir(s)shallbeentitledto continue to rent-purchase thathouse;
b/Ifhis/herlawfulheir(s)has(have)notcoinhabitedinthathouseandthesocial-houserent-purchaserhasgonethroughtwo-thirdsoftherent-purchaseduration,thelawfulheir(s)mayfullypaythemoneyamountcorrespondingtotheremainingone-thirdoftherent-purchasedurationandshallbegrantedhouseownershiprightcertificatesbycompetentstatebodiesaccordingtotheprovisionsofthisLaw;
c/IflawfulheirsareavailablebutnotthesubjectsdefinedatPointsaandbofthisClause,such lawfulheirsshallberefundedbysocialhouse-managingunits20%ofthemoneyamountsinitiallypaidbythesocial-houserent-purchasersplustheintereststhereonaccordingtoregulationsoftheStateBank;
d/Ifthereisnolawfulheir,thesocialhouse-managingunitsshallhavetheresponsibilitytomanagesuchhouses.
Section5.HOUSEDONATION
Article107.-Donationofhousesunder commonownership
1.Incaseofdonationofhousesundercommonownershipbyintegration,thewrittenconsentofalltheownersofthehousesunder commonownershipisrequired.
2.Incaseofdonationofhousesundercommonownershipbyshares,ownersmayonlydonatethesharesundertheirrespectiveownershipandguaranteenottoaffecttheinterestsofotherownersofthehousesunder commonownership.
3.Doneesofhousesunder commonownershipshallbe recognizedasownersofdonatedhousesunder commonownershipasfrom thetimehousedonation contractsarenotarized.
Article108.-Donationofhousescurrentlyonlease
1.Ownersofhousescurrentlyonleasemustnotifythehouselesseesofthedonationofthehouses.
2.Thelesseesmaycontinuerentingthehousesuntiltheexpirationofthecontractsconcludedwith thedonors,unlessotherwiseagreeduponby theparties.
Section6.HOUSEEXCHANGE
Article109.-Exchangeofhousesunder commonownership
1.Exchangeofhousesundercommonownershipbyintegrationmustbeagreeduponinwriting byalltheownersofthehousesunder commonownership.
2.Incaseofexchangeofhousesundercommonownershipbyshares,theownersofthehousesundercommonownershipcanexchangeonlythesharesundertheirrespectiveownershipandguaranteenottoaffecttheinterestsofotherjointowners.
Article110.-Exchangeofhousescurrentlyonlease
1.Ownersofhousescurrentlyonleasemustnotify thelesseesofthehouseexchange.
2.Thelesseesmaycontinuerentingthehousesuntiltheexpirationofthecontractsconcludedwith theformerhouseowners,unlessotherwiseagreeduponby theparties.
Article111.-Paymentofvaluedifference
Ifahouseexchangeentailsdifferenceinvalue,thepartiesinvolvedinthehouseexchangemustpaysuchvaluedifference,unlessotherwiseagreeduponby theparties.
Section7.HOUSEINHERITANCE
Article112.-Inheritanceofhousesunder commonownershipbyintegration
Iftheheir(s)ofahouseundercommonownershipbyintegrationis(are)theremainingowner(s)ofthehouseundercommonownership,thesepersonsareentitledtoinheritsuchhousesaccordingtotestamentorlaw.Incaseswhereaheirisnotownerofthehouseundercommonownershipbyintegration,suchheirshallbepaidwith thehousevalueparthe/sheisentitled to.
Article113.-Inheritanceofhousesunder commonownershipbyshares
Forhousesunder commonownershipbyshares,the sharesoftheestateleaversshallbedivided
to testamentaryorat-lawheirs;ifthehousesaresoldfordivisionoftheirvalues,theheirsshallbe givenprioritytobuythem;iftheheirsdonotbuythehouses,theotherownersofthehousesundercommonownershipshallhavethepreemptiverightstobuytheinheritedpartsofsuchhousesandpay thevalueofthepurchasedhousesto theheirs.
Section8.HOUSEMORTGAGE
Article114.-Conditionsforhousemortgage
Houseownersmaymortgagetheirhouses toensuretheperformanceofoneormanyobligations
ifthevaluesofsuchhousesarebiggerthanthetotalvalueoftheobligationsbuteachcanonlymortgagehis/herhouseatone creditinstitution.
Article115.-Mortgageofhousesunder commonownership
Mortgageofhousesundercommonownershipmustbeagreeduponinwritingbyalltheownersofsuchhouses.Ownersofhousesunder commonownership shallbearjointresponsibilityfor theperformanceofobligationsofthehousemortgagorsaccording totheprovisionsofcivillaw.
Article116.-Mortgageofhousescurrentlyonlease
Houseownerscanmortgage theirhouses currentlyonleasebutmustnotify thehouselesseesofthemortgageinwriting.Thelesseesmaycontinuerentingthehousesuntiltheexpirationofthecontracts.
Wherehousescurrentlyonleaseareputtoauctionforperformanceoftheobligationsofthehousemortgagors,thehouselesseesmaycontinuerentingthehousesuntiltheexpirationofthecontracts,unlessotherwiseagreeduponby theparties.
Article117.-Caseswherehousemortgage contractsterminate
1.Theobligationsguaranteedby themortgagehavebeenperformed.
2.Thehousemortgagehasbeen cancelledor replacedbyothersecuritymeasures.
3.Themortgagedhouseshavebeenhandled.
4.Underagreementoftheparties.
Article118.-Handlingofmortgagedhouses
1.Handlingofmortgagedhousesforperformanceofobligationsshallbeeffected throughauction accordingtotheprovisionsoflawonpropertyauction,exceptwherethepartiesotherwiseagreeupon.Themortgageesshallbegivenpriorityinpaymentfromtheproceedsfromthesaleofmortgagedhousesafterminustheexpensesforpreservation,fororganizationofhouseauction.
2.Thepurchasersofmortgagedhousesshallberecognizedashouseownersfromthetimeof concludingthe contracts.
Section9.LENDING,PERMITTINGOTHERSTOTEMPORARILYSTAYIN,ONE’SHOUSES
Article119.-Lending,permittingothersto temporarilystayin,housesunder commonownership
1.Lendingof,andthepermittedtemporarystayin,housesundercommonownershipmustbe agreeduponinwritingbyalltheownersofsuchhouses,exceptlendingof,orthepermittedtemporarystayinhousesunderprivateownership.Thehouselendersshallhavetherighttoreclaimtheirhousesaccording toprovisionsoftheCivilCode.
2.Ownersofhousesundercommonownershipmayagreetonominaterepresentativestosigncontractsonlendingof,orpermittedtemporarystayin,theirhouses.
Article120.-Casesofterminationofcontractsonlendingof,permittedtemporarystayin,one’shouses
1.Thedurationofhouselendingorpermitted temporarystayhasexpired.
2.Thehouseslentorpermittedfortemporarystaybyothersnolongerexist.
3.Thehouseborrowersorthepersonswhoarepermittedtotemporarilystayinothers’housesdiewithoutanyonelivingtogetherwiththem.
4.Thehouseslentorpermittedfortemporarystaybyothersareindangerofcollapseorsubject toground clearance,demolitionorland recoveryunderdecisionsofcompetentstatebodies.
5.Underagreementoftheparties.
Section10.HOUSEMANAGEMENTAUTHORIZATION
Article121.-Contentsofhousemanagementauthorization
1.Housemanagementauthorizationmeansthathouseownersauthorizeotherpersonsto performtheowners’responsibilitiesinthemanagementofhouses.Theauthorizationcontentsanddurationshallbeagreeduponby thepartiesandstatedin theauthorization contracts;ifthereisnoagreementontheauthorizationduration,acontractonauthorizationshallbevalidforoneyearasfrom thedate theauthorization contractisconcluded.
2.Thehousemanagementauthorizersmustpaymanagerialexpenses,unlessotherwiseagreeduponby theparties.
Article122.- Authorizationofmanagementofhousesunder commonownership
1.Authorizationofmanagementofhousesundercommonownershipbyintegrationmustbe agreeduponinwritingbytheownersofsuchhouses.
Ownersofhousesundercommonownershipwhopossesspartsunderprivateownershipmayauthorizeotherpersons tomanagesuchprivatelyownedpartsbutmustnotaffecttheinterestsofotherowners.
2.Ownersofhousesundercommonownershipshallhavethe responsibilitytonotifyotherhouseownersoftheauthorizationofhousemanagement,exceptwherethepersonsauthorizedtomanage thehousesarealsojointownersofsuchhouses.
Article123.-Casesofterminationofcontractsonhousemanagementauthorization
1.Theauthorization contracthasexpired.
2.Theauthorization contentshavebeen realized.
3.Theauthorizeror theauthorizedunilaterally terminates thehousemanagementcontractaccording totheprovisionsofArticle124ofthisLaw.
4.Theauthorizerortheauthorizeddiesorhasbeendeclareddeadbythe court.
5.Theauthorizedhasbeen missingorbeendeclaredby the courtashavinglostcivilactcapacity.
6.Underagreementofthetwoparties.
Article124.-Unilateral terminationofperformanceofhousemanagementauthorization contracts
1.Thehousemanagementauthorizersshallunilaterally terminatecontractsinthefollowingcases:
a/Iftheauthorizationcoversmanagementexpenses,theauthorizersshallnothavetonotifythe authorizedinadvanceoftheunilateralterminationofperformanceoftheauthorizationcontractsbutmustpaytheauthorizedallmanagementexpensescorrespondingtotheworkperformedby theauthorizedandpaydamagesto theauthorized;
b/Iftheauthorizationdoesnotcovermanagementexpenses,theauthorizersmustnotifytheauthorizedoftheunilateralterminationoftheperformanceoftheauthorizationcontractatleastonemonthinadvance.
2.Theauthorizedshallunilaterally terminatethe contractin thefollowing cases:
a/Iftheauthorizationcoversmanagementexpenses,theauthorizedneednottonotifytheauthorizerinadvanceoftheunilateralterminationofperformanceoftheauthorizationcontract,butmustpaydamagestotheauthorizer(ifany);
b/Iftheauthorizationdoesnotcovermanagementexpenses,theauthorizedmustnotifytheauthorizeroftheunilateralterminationofperformanceoftheauthorizationcontractatleastonemonthinadvance.
3.Thehousemanagementauthorizersandauthorizedmustnotifytherelevantthirdpartyoftheunilateralterminationofperformanceofthehousemanagementauthorization contracts.
Chapter VI
VIETNAM-BASED HOUSES OF OVERSEAS VIETNAMESE, FOREIGN ORGANIZATIONS OR INDIVIDUALS
Section1.RIGHTSTOHOUSEOWNERSHIP
Article125.-RightsofforeignorganizationsandindividualstoownhousesinVietnam
1.ForeignorganizationsandindividualsinvestingintheconstructionofhousesforleaseinVietnamshallbegrantedbycompetentstatebodiescertificatesofownershiprightstosuchhouses.Thedurationofhouseownershipshallbethedurationstatedintheinvestment certificatesandspecifiedinhouseownership rightcertificates.
2.Foreignorganizationsandindividualsinvestingintheconstructionofhousesforsale,afterthecompletionofconstructionunderprojects,investorsmaysellthesehousestosubjectsentitledtoownhousesinVietnamdefinedinClause2,Article9ofthisLaw.PurchasersofhousesoforganizationsorindividualsdefinedinthisClauseshallbegrantedbycompetentbodies ahouseownership rightcertificateaccording totheprovisionsofthisLaw.
3.Organizationsorindividualsinvestingintheconstructionofhousesforsaleshallhavetopaylanduseleviesandfulfillotherfinancialobligationsasprovidedforbylaw.
Article126.-OverseasVietnamese’srightstoownhousesinVietnam
1.OverseasVietnamese returningtoVietnamforlong-terminvestment,beingpersonswithmeritsofmakingcontributionstothecountry,culturalactivists,scientistswishingtoconductregularactivitiesinVietnamtoservethecauseofnationalconstruction,personspermittedtoleadastablelifeinVietnamandothersubjectsdefinedbytheNationalAssemblyStandingCommittee,mayownhousesinVietnam.
2.OverseasVietnameseother than thosedefinedinClause 1ofthisArticle,whohavereturned toVietnam forstayforsixormoremonthsmayeachown asinglehouseoranapartment.
Article127.-Dossiersofapplicationforhouseownershiprightcertificates
DossiersofapplicationforhouseownershiprightcertificatesofoverseasVietnamese,foreign organizationsorindividualsshalleach comprise:
1.Applicationforhouseownership rightcertificate;
2.Copyoftheinvestmentcertificate,forforeignorganizationsorindividualsinvestingintheconstructionofhousesforlease;theoriginalofthecontractontrading,donationofhouse,house inheritancepapersasprovidedforbylaw,foroverseasVietnamese;
3.Papers certifyingthesubjectentitledtoownhousesinVietnamundertheprovisionsofClause 1,Article125andArticle126ofthisLaw;
4.Planofthehouse,residentialland.
Article128.-Houseownership rightcertificate-grantingorder,procedures
1.Foreignorganizationsandindividuals,overseasVietnameseinvestingintheconstructionofhousesforlease,afterthecompletionofinvestmentconstruction,shallhavetocarryoutproceduresforbeinggrantedhouseownershiprightcertificatesasprovidedforinArticle16of thisLawbeforeleasing thehouses.
Incaseofinvestmentintheconstructionofhousesforsale,investorsmustcarryoutproceduresforcompetentbodiestogranthouseownership rightcertificatestohousepurchasers.
2.OverseasVietnamese tradingin,donating,inheritinghousesunder theprovisionsofChapter VofthisLawmustcompiledossiersforcompetentstatebodiestogranthouseownershiprightcertificates.
Article129.-RightsandobligationsofhouseownersbeingoverseasVietnamese,foreignorganizationsorindividuals
HouseownersbeingoverseasVietnamese,foreignorganizationsorindividualsshallhavetherightsandobligationsdefinedinArticles21and22ofthisLawbuthavetocomplywiththefollowingprovisions:
1.Tomortgagehousesatcreditinstitutionslicensed tooperateinVietnam;
2.Tosell,donate,bequeathhousestodomesticorganizationsorindividuals,overseasVietnameseentitledtoownhousesinVietnam.Incasesofdonatingorbequeathinghousestoothersubjects,suchsubjectscanonlyenjoythevalueofsuchhouses;
3.Whentheirinvestmentcertificatesexpire,foreignorganizationsandindividualsdefinedinArticle125ofthisLawshallhavetheresponsibilitytohandoverthehousesforleaseandtheunsoldhousesnotsubjecttodemolitiontotheprovincial-levelPeople’sCommitteesofthelocalitieswheresuchhousesexist.Theprovincial-levelPeople’sCommitteepresidentsshallissuedecisionstoestablishstateownershipoversuchhousesandassignenterpriseswithfunctionofmanagingstate-ownedhousestomanagetheuseofsuchhousesaccordingto provisionsoflaw.
Article130.-Otherprovisionsapplicabletohouseowners
Theproceduresforgrant,change,re-grantofhouseownershiprightcertificatesorcertificationof changesafterthegrantofcertificatesshallcomplywiththeprovisionsofArticles12,13,14,17,18and19ofthisLawapplicabletooverseasVietnamese,foreignorganizationsandindividuals.
Section2.HOUSERENTING
Article131.-Houselesseesand renting conditions
ForeignorganizationsandindividualsthatareallowedtoenterandstayinVietnamforthreeormoreconsecutivemonthsandoverseasVietnamesemay renthousesinVietnam.
Article132.-Conditionsonleasedhouses
HousesinVietnam,whichareleasedtooverseasVietnamese,foreignorganizationsorindividuals,mustfullysatisfythefollowing conditions:
1.Beinggrantedhouseownership rightcertificatesunder theprovisionsofthisLaw;
2.Beingseparatehousesorenclosedapartments;
3.Ensuringqualityandsafetyforlessees;
4.Ensuringelectricityandwatersupply,environmentalsanitationandotheressentialconditions;
5.Beingfreefromdisputesoverownership rightsoruse rights.
Article133.-Otherregulationsonhouseleasing
TheprovisionsofArticles92,93,99,100,102,103and104ofthisLawshallbeapplicableto overseasVietnamese,foreignorganizationsandindividualsthatrenthousesinVietnam.
Chapter VII
STATE MANAGEMENT OF HOUSES
Article134.-Contentsofstatemanagementofhouses
1.Toformulateanddirecttheimplementationoforientations,programs,planningsandplansonhousingdevelopment.
2.Topromulgatelegaldocumentsonhousingandorganize theimplementation thereof.
3.Topromulgatehousestandardsandmanagehousequalityunderhousestandards.
4.To recognizehouseownership rights.
5.Topermitorsuspend the construction,renovationofhouses.
6.Tomanagehousedossiers.
7.To conductsurveysandstatisticsandbuilddataonhouses.
8.Toresearchinto,applyscienceandtechnology,andpromoteinternationalcooperationinthehousingdomain.
9.To trainhuman resourcestomeethousingdevelopmentandmanagementrequirements.
10.Tomanagehousingbrokerageactivities.
11.Tomanagehouse-relatedpublicservices.
12.Toexamine,inspectandsettlecomplaintsanddenunciationsandhandleviolationsinthe housingdomain.
Article135.-Housingdevelopmentorientations,programsandplannings
1.Basedonsocio-economicdevelopmentprograms,theGovernmentshallpromulgate orientationsfornationalhousingdevelopment,whichshallserveasbasesforformulationofspecificpoliciestosatisfy thepeople’sessentialdemandsforimprovementofhousing conditions.
2.Basedonnationalhousingdevelopmentorientations,housingpolicies,provincial-levelPeople’sCommitteesshalldrawupprogramsforhousingdevelopmentintheirrespectivelocalitiesandsubmitthem toprovincial-level People’sCouncilsforadoption.
3.Povincial-levelPeople’sCommitteesshallhavetoelaborateandapproveplanningsonresidentialareasandhousingdevelopmentanddrawupplannings,plansontheuseoflandforhousingdevelopment;directtheimplementationofhousingdevelopmentprograms,planningsandplansin their respectivelocalities.
Article136.-Promulgationoflegaldocumentsonhousing
1.BasedontheHousingLaw,thenationalhousingdevelopmentorientationsandthepractical nationalsocio-economicdevelopmentsituation,theGovernmentshallpromulgatelegaldocumentsonhousemanagementanduseaswellashousingdevelopment.
2.Thecentralagencyperformingthestatemanagementofhousesshall,withintheambitofitstasksandpowers,havetopromulgateorproposecompetentbodiestopromulgatelegal documentsonhousemanagementanduseaswellashousingdevelopment.
3.Provincial-levelPeople’sCommitteesshall,withintheambitoftheirtasksandpowers,promulgatelegaldocumentsonhousemanagementanduseaswellashousingdevelopmentandorganizetheimplementationofprovisionsoflawonhousemanagementanduseaswellashousingdevelopment.
Article137.- Permission,suspensionofthe construction,renovationofhouses
1.Permissionofhouseconstructionor renovationmustbebasedonplanningson constructionofurban centersand ruralpopulationquarters.
2.Presidentsofprovincial-levelordistrict-levelPeople’sCommitteesshallapprovehousing developmentprojectsin theirrespectivelocalitiesaccording todecentralization.
3.Houseconstructionorrenovationrequiresconstructionpermitsofcompetentstatebodies,exceptthecaseswhicharenotsubjecttoconstructionpermitsasprovidedforbythelawonconstruction.
4.Houseconstructionorrenovationwhichfails tocomplywiththeprovisionsofClauses1,2and3ofthisArticleshallbesuspendedbyagenciescompetenttoapprovehousingdevelopmentprojectsor tograntconstructionpermits.
Article138.-Recognitionofhouseownership rights
1.Competentstatebodiesshallhavetogrant,changeandre-granthouseownershiprightcertificatestoorganizationsandindividualsthatlawfullyestablishtheirhousesunderthe provisionsofthisLaw.
2.Thecentralagencyperformingthestatemanagementofhousesshallhavetoinspectandsupervise thegrantofhouseownership rightcertificatesthroughoutthe country.
Article139.-Managementofhousedossiers
1.Provincial-levelhousemanagementagenciesshallhavetomanagehousedossiersdefinedinArticle66ofthisLaw,forcaseswhereprovincial-levelPeople’sCommitteesgranthouseownership rightcertificates.
2.District-levelPeople’sCommitteesshallhavetomanagehousedossiersdefinedinArticle66of thisLaw,forcaseswheredistrict-levelPeople’sCommitteesgranthouseownershipright certificates.
3.Housedossier-managingagenciesshallhavetosupplyinformationonhousedossierswhensorequestedbyorganizationsorindividuals.Theinformationrequestersmustpaychargesthereforaccording totheprovisionsoflaw.
Article140.- Surveys,statistics,buildingofdataonhouses
1.People’sCommitteesatalllevelsshallhavetomakestatisticsandbuildupdataonhousesintheirrespectivelocalitiesinserviceofrequirementsofelaborationofhousingdevelopmentprograms,plans.
2.Onceeveryfiveyears,thecentralhousemanagementagencyshallconductsurveysandsynthesizedataonhousesthroughoutthe country.
3.TheGovernmentshallallocatebudgetforsurveys,statisticsandbuildingofdataonhouses.
Article141.-Scientificandtechnologicalresearchandapplication,andinternationalcooperationin thehousingdomain
1.TheStateadoptspoliciestoencourageandcreateconditionsforscientificandtechnologicalresearchandapplicationandinternationalcooperationinserviceofhousingdevelopmentandmanagementrequirements.
2.TheStateshallprovidefundingsupportsfor theapplicationofnewtechnologies,newmaterialsin constructionofhousestoensure constructionquality,progressand costreduction.
Article142.-Trainingofhuman resourcesforhousingdevelopmentandmanagement
1.TheStateadoptspoliciesontrainingofcadresandpublicservantsinserviceofhousing developmentandmanagement.
2.Thecentralagencyperformingthestatemanagementofhousesshalldefinetheprogramcontentsand coordinatewithprovincial-levelPeople’sCommitteesinorganizing thefosteringandraisingofknowledgeonhousingdevelopment,businessandstatemanagementforthecontingentofcadresandpublicservants.
Article143.-Managementofhousingbrokerageactivities
1.Organizationsandindividuals conductinghousingbrokerageactivitiesmustregistertheirhousingbrokeragebusinessactivitiesaccording totheprovisionsoflaw.
2.TheGovernmentshallspecifythe conditionsforparticipationinhousingbrokerageactivities.
3.Thecentralagencyperformingthestatemanagementofhousesshallpromulgateregulationsonorganizationofhousingestatebrokerageactivities.
Article144.-Managementofhouse-relatedpublicservices
1.House-relatedpublicservice-providingorganizationsshallbesetuptomeetthedemandsoforganizationsandindividualsinhousemanagementanduse.
2.Thecentralagencyperformingthestatemanagementofhousesshallissueregulationsonhouse-relatedpublicservicesfornationwideapplication.
3.Provincial-levelPeople’sCommitteesshalldecideon theestablishmentofhouse-relatedpublicservice-providingorganizationsandpromulgateregulationsontheoperationsthereofintheirlocalities.
Article145.-Inspectionoftheobservanceoflawonhousing
1.Thespecializedconstructioninspectorateshallhavetoinspecttheobservanceoflawonhousing.
2.Localhousemanagementagenciesshallhavetoinspecttheobservanceoflawonhousingintheirrespectivelocalities.
Article146.-Housemanagementagencies
1.TheGovernmentshallperform theunifiedstatemanagementofhouses.
2.ThecentralagencyperformingthestatemanagementofhousesshallbeanswerabletotheGovernmentforperformanceoftheunifiedstatemanagementofhouses.
3.Ministriesandministerial-levelagenciesshall,withintheambitoftheirrespectivetasksandpowers,havetocoordinatewiththecentralagencyperformingthestatemanagementofhousesinperformingthestatemanagementofhouses.
4.People’sCommitteesofalllevelsshallhavetoperformthestatemanagementofhousesintheirrespectivelocalitiesunder theGovernment’sdecentralization.
The Governmentshalldefine themodelofhousingdevelopmentandmanagementorganizations,efficientlyensuring theattainmentofhousingdevelopmentobjectivesspecifiedinthisLaw.
Chapter VIII
SETTLEMENT OF DISPUTES, COMPLAINTS, DENUNCIATIONS AND HANDLING OF VIOLATIONS OF LAW ON HOUSING
Section1.SETTLEMENTOFHOUSE-RELATEDDISPUTES,COMPLAINTS,DENUNCIATIONS
Article147.- Settlementofhouse-relateddisputes
1.TheStateencouragesthepartiestosettledisputesoverhousesthrough conciliation.
2.DisputesoverhousesshallbesettledbyPeople’sCourtsaccording to theprovisionsoflaw.
Article148.-Complaints,denunciationsandsettlementofcomplaints,denunciations
1.Complaint,denunciationandsettlementofcomplaintsanddenunciationsshallcomplywiththe provisionsoflawon complaintsanddenunciations.
2.Whilelodging their complaints,denunciationsorinitiatinglawsuits,organizationsand individualsshallstillhavetoabidebyadministrativedecisionsofcompetentstatebodies,excludingdecisionsoncoercivedemolitionofhouses.Upontheissuanceofdecisionsonsettlementofhouse-relatedcomplaintsordenunciationsbycompetentstatebodiesorcourtjudgmentsorrulingswhichhavetakenlegaleffect,theconcernedpartiesshallhavetoexecutesuchdecisionsorjudgments.
Section2.HANDLINGOFVIOLATIONSOFLAWONHOUSING
Article149.-Handlingofviolatorsoflawonhousing
1.Personscommittingactsofviolatingthelawonhousingshallbeadministrativelyhandledorexaminedforpenalliability,dependingon thenatureandseriousnessoftheirviolations.
2.Organizationsandindividualsthatbuildhousesincontraventionofplanningwithout constructionpermits,forcasesthepermitsarerequired,oratvariancewithpermits,shallbe handledaccording totheprovisionsoflaw.
3.Thosewhotakeadvantageoftheirpositionsorpowerstoactagainsttheprovisionsoflawonhousing,showirresponsibilityinmanagementthuslettingviolationsoccurorcommitotheractsofviolation,thuscausingdamagetotherightsandinterestsofhouseowners,lawfulhouseusersshallbedisciplined,administrativelyhandledorexaminedforpenalliabilityaccordingtotheprovisionsoflaw,dependingonthenatureandseriousnessoftheirviolations.
Article150.-HandlingofviolationsofthelawonhousingwhichcausedamagetotheState,organizationsand/orindividuals
Personswhocommitactsofviolatingthelawonhousing,ifcausingdamagetotheinterestsoftheState,thelegitimaterightsandinterestsoforganizationsand/orindividualsshall,apartfrombeinghandledaccordingtoArticle149ofthisLaw,stillhavetopay compensationstherefor.
Chapter IX
IMPLEMENTATION PROVISIONS
Article151.-Implementationeffect
ThisLawshalltakeeffectasfrom July1,2006.
Article152.-LegalvalidityofhouseownershiprightandlanduserightcertificatesissuedbeforetheeffectivedateoftheHousingLaw
Houseownershiprightandlanduserightcertificatesissuedinpreviousperiods,landuseright certificatesissuedundertheprovisionsofthelandlawwhichhaverecognizedthehousesbuild onsuchlandshallremainlegallyvalidandmustnotbechangedundertheprovisionsonhouseownershiprightcertificatesofArticle11ofthisLaw,exceptwherehouseownerswishtochangethemfornewhouseownership rightcertificates.
Article153.-Implementationguidance
The GovernmentshalldetailandguidetheimplementationofthisLaw.
ThisLawwaspassedonNovember29,2005,bytheXIthNationalAssemblyoftheSocialistRepublicofVietnamatits8thsession.
