ANTI-CORRUPTION LAW

(Lawno.55/2005/QH11)

Pursuanttothe1992Constitutionof the Socialist Republicof Vietnam, which was amendedandsupplemented under Resolution No. 51/2001/QH10 ofDecember25,2001,oftheXthNational  Assembly, the 10thsession;

ThisLawprovidesfor corruptionprevention and combat.

ChapterI

GENERAL PROVISIONS

Article1.-Governingscope

1.This Law providesfor the prevention, detection and handling of persons who commit corrupt actsand the responsibilitiesof agencies, organisations, unitsandindividualsin corruption prevention andcombat.

2.Corruptionmeansactscommittedbypersonswithpositionsand/or powersof abusingsuchpositionsand/orpowersforself-seekinginterests.

3.Personswithpositionsand/orpowersshallinclude:

a)Publicservants;

b)Officers, professional armymen,defense workers in agenciesor unitsofthePeople sArmy;officers,non-commissionedofficers,professional- technical officers, non-commissioned officersin agencies or units of the People sPolice;

c) Leading,managerial officialsin state enterprises; leading, managerialofficials being representativesof theState s contributed capital portionsatenterprises;

d)Persons assigned tasksor official dities who have powers while performingsuchtasks orofficialduties.

Article2.-Interpretationofterms

InthisLaw,thetermsbelowshallbe construedas follows:

1. Corruption-related propertymeans property acquiredfrom corruptionacts,propertyoriginatingfromcorruptacts.

2.Publicitymeansthepublicization,supplyofofficialinformationon documents,activitiesorcertaincontentsbyagencies,organisationsorunits.

3.Propertyandincometransparencymeansthedeclarationofproperty, incomesbypersonswhoareobligedtomakesuchdeclarationwhich,when necessary,shallbeverifiedandconcluded.

4.Harassment means acts of bumbledom, authoritarianism, causing difficultiesortroubleswhenperforming tasks or official duties.

5.Self-seekinginterestsmeanmaterialand/orspiritualinterestswhich areobtained orcan be obtained by persons with positionsand/or powers through corrupt acts.

6.Agencies, organisations,units include state agencies, political organisations,socio-political organisations, people s armed force units, non- business units,state enterprises and other agencies, organisations and units usingthestatebudgetand/orproperties.

Article3.-Corruptacts

1.Embezzlingproperties.

2.Takingbribes.

3.Abusingpositions, powersto appropriate properties.

4.Taking advantage of positions, powers whileperforming tasksor officialdutiesforself-seekinginterests.

5.Abusing powers while performing tasks or official duties for self-seekinginterests.

6.Takingadvantageofpositions,powerstoinfluenceotherpersonsfor self-seekinginterests.

7.Committingforgeriesinworkfor self-seekinginterests.

8.Offering bribes, bribebrokerage by persons with positions and/or powerstosettleaffairsofagencies,organisations,unitsorlocalitiesforself- seekinginterests.

9.Taking advantage of positions, powers toillegallyuse state propertiesforself-seekinginterests.

10.Harassmentforself-seekinginterests.

11.Failureto perform tasks orofficialdutiesforself-seekinginterests.

12.Takingadvantageofpositions,powerstocoveruplawviolatorsfor self-seekinginterests; illegally hindering, intervening in the examinations, inspections,auditings,investigations,prosecutions,adjudicationsorjudgment executionsforself-seekinginterests.

Article4.-Principlesfor handling of corruption

1.Allcorruptactsmustbedetected,stoppedandhandledinatimely, strictandjust manner.

2.Personswhocommitcorruptactsshallbehandledaccordingtothe provisionsof law irrespective of their positions.

3. Corruption-related properties must berecovered,confiscated; persons committing corruptacts and causing damagemust pay compensations, indemnities according totheprovisionsof law.

4.Persons who commit corrupt acts and take initiative in reporting thembefore they are detected, actively limit damage caused by their illegal acts and/or voluntarily hand over corruption-related properties can be considered for alleviation of discipline, penalties or exemptionfrom penal liabilityexaminationaccordingtotheprovisionsoflaw.

5.The handling of corruptionmust be effected in a public manner accordingtotheprovisions oflaw.

6.Thosewhohavecommittedcorruptactsandhaveretired,lefttheir jobsorbeentransferredtootherjobsshallstillbehandledfortheircorrupt acts.

Article5.-Responsibilities of agencies, organisations,units and personswith positions and/or powers

1.Agencies, organisations and units shall, within the ambit of their respectivetasks and powers,havethefollowingresponsibilities:

a)To organise the implementation oflegal documents on corruption prevention and combat;

b)Toreceive and handle in timereports, denunciations and other information on corrupt acts;

c)To protect the legitimate rights and interests of persons who have detected,reported on,denouncedcorruptacts;

d)Totakeinitiativeinprecluding,detectingcorruptacts;topromptly supplyinformation,documentsandmeettherequestsofcompetentagencies, organisationsorindividualsintheprocessofdetectingandhandlingpersons whocommitcorruptacts.

2.Headsofagencies,organisationsorunitsshall,withintheambitof theirrespectivetasksandpowers,have thefollowing responsibilities:

a)To direct the implementation of the provisions of Clause 1 of this

Article;

b)To be exemplary, incorruptible; to periodically review the performanceof their tasks and responsibilities in precludinganddetecting corruptacts,handlingpersonswhohavecommittedcorruptacts;

c)To bear responsibilitywhen letting corrupt acts occurintheir respectiveagencies, organisations or units.

3.Persons with positions and/or powers shall have the following responsibilities:

a)Toperformtheirtasksand/orofficialdutiesstrictlyaccordingtothe provisionsof law;

b)Tobeexemplary,incorruptible;tostrictlyobservetheprovisionsof lawoncorruptionpreventionandcombat,thecodeofconductsandtherules onprofessionalethics;

c)Todeclaretheirpropertiesaccordingto theprovisionsofthisLaw andtakeresponsibilityfor theaccuracy, truthfulness of such declarations.

Article6.-Rightsandobligationsofcitizensincorruptionprevention andcombat

Citizensshallhavetherightstodetect,denouncecorruptacts,havethe obligationstocooperatewithandassistcompetentagencies,organisationsor individualsin thedetection and handling of persons who have committed corruptacts.

Article7.-Coordination responsibilities of inspectorates, the state audit, investigating bodies, procuracies, courtsand concerned agencies, organisationsaswellasunits.

Inspectorates,the state audit, investigating bodies, procuracies and courts shall, within the ambit of their respective tasks and powers,have to coordinate with one another and coordinatewith concerned agencies, organisations and/or units in detecting corrupt acts, handling corruption committersandtakeresponsibilitybeforelawfortheirrespectiveconclusions anddecisionsinthecourseofinspection,auditing,investigation,prosecution, adjudicationofcorruptioncases.

Concernedagencies, organisations and units shall haveto create conditions for,and collaborate with, inspectorates, thestate audit, investigatingbodies,procuracies,courtsindetectingandhandlingcorruption committers.

Article8.-Responsibilities of Vietnam Fatherland Front and its memberorganisations

VietnamFatherland Frontandits member organisations shall haveto mobilizepeopletoactivelyparticipateincorruptionpreventionandcombat; detect,propose competent agencies,organisations or individuals to handle persons who commit corrupt acts; supervise the observance of law on corruption prevention and combat.

Article9.-Responsibilitiesofpress agencies

Pressagenciesshallhavetheresponsibilitytoparticipateincorruption preventionandcombat;cooperatewithcompetentagencies,organisationsor individualsin corruption prevention and combat; must ensure accuracy, truthfulnessandobjectivenessintheirreportsandbearresponsibilityforthe contentsof information they have reported.

Article10.-Prohibitedacts

1.ActsspecifiedinArticle3ofthisLaw.

2.Intimidation, revenge, retaliation of persons who have detected, reportedon, denounced,suppliedinformation on corrupt acts.

3.Taking advantage of denunciation of corruption to slander other agencies,organisations, units orindividuals.

ChapterII

CORRUPTION PREVENTION

Section1.PUBLICITY,TRANSPARENCYINACTIVITIESOF AGENCIES,ORGANISATIONS,UNITS

Article11.-Principles on and contents of publicity, transparency in activitiesofagencies,organisations,units.

1.Policies, laws and the implementation of policies, lawsmust be publicisedandtransparent,ensuringfairnessanddemocracy.

2.Agencies, organisationsand units must publicise their activities, exceptforcontentsclassifiedasstatesecretsandothercontentsprescribedby theGovernment.

Article12.-Formsofpublicity

1.Publicityformsshallinclude:

a)Announcementatmeetingsofagencies,organisations,units;

b)Postingupatworkingofficesofagencies, organisations, units;

c)Written notification to concerned agencies, organisations, units or individuals;

d)Distributionofpublications;

e)Notificationonthemassmedia;

f)Load-uponwebsites;

g)Supply of information at the request of agencies, organisations or individuals.

2.Besides the cases where the publicity form providedfor by law, headsofagencies,organisationsorunitsshallhavetoselectoneoranumber ofpublicityformsspecifiedinClause1ofthisArticle.

Article13.-Publicity,transparencyinprocurementofpublicproperties andcapitalconstruction

1.The procurement of public properties and the capital construction must be publicised under theprovisionsoflaw.

2.Where the procurement of public properties and the capital construction,asprovidedforbylaw,mustbeputupforbidding,thepublicity contents shallcover:

a)Planonbidding,invitationtopre-qualificationandpre-qualification results,invitation to bidding;

b)Listofbiddersparticipatinginrestrictedbidding,shortlistofbidders participatinginrestrictedbidding,resultsofcontractorselection;

c)Information on individuals, organisations belonging to project owners, bid solicitors, contractors, managing agencies or other subjects that violate the law on bidding; information on contractors bannedfrom participationandinformationonhandlingofviolationsoflawonbidding;

d)Legal documents on bidding, systems of data information onbidding;

e)Report on review of bidding work nationwide of the Ministry of Planning and Investment; reports on review of bidding work ofministries, branches,localities and establishments;

f)Competence and procedures toreceive and settle complaints and denunciations inbidding.

Article14.-Publicity, transparency in management of construction investmentprojects

1.Construction investment planning projectsmust be commented by peopleoflocalitiescoveredbytheplanning.

2.Construction investment projectsfunded by local budgets must be consideredanddecided by People s Councils.

3.Construction investment projects, after being decided upon and approved,mustbemadepublicforpeopletosupervisethem.

Article15.-Financialandstate budget publicity, transparency

1.Budgetsofalllevels,budget-estimatingunitsmustpubliciseindetail theestimate and settlement figures, which have been decided, ratified by competentstatebodies,includingsupplementedbudgetamounts.

2.Budget-estimatingunitswithrevenuesourcesfromandexpenditures coveredbyconstructionsoforganisationsand/orindividualsaccordingtothe provisionsof lawmust publicise the mobilisation purposes,mobilisationresults and the efficiency ofthe useof mobilised sources.

3.Organisationsprovidedwithstatebudgetsupportsmustpublicisethe followingcontents;

a)Estimateandsettlementfigures;

b)Contributions of organisations, individuals(ifany);

c)Bases for determination ofsupport levels and state budget supportamounts.

4.Capital construction investment projects using state budget capital mustbepublicisedwith thefollowingcontents:

a)The allocation of investment capital in the state budget estimate assigned annually to the projects;

b)Budget estimates of investment projects under the approved investmentplans,theinvestmentcapitalofprojectsassignedinannualbudget estimates;

c)Annualinvestmentcapitalsettlementofprojects;

d)Investment capital settlement upon project completion, which has beenapprovedbycompetentauthorities.

5.Fundsoriginatingfromthestatebudgetmustbepublicisedwiththe followingcontents:

a)Operationregulationsandfinancialmechanismsofthethefunds;

b)Annual financial plans detailing revenues, expenditures related to state budget according to regulationsof competentauthorities;

c)Resultsofthefunds operation;

d)Annualsettlementalreadyapprovedbycompetentauthorities.

6.Theallocationanduseofstatebudgetandpropertyforprojectsand targetprogramsalready approved by competent state bodiesmust be made public to concerned agencies, organisations and/or units and people of localities directlybenefiting therefrom.

Article16.-Publicity,transparency of themobilisation and use of contributions of people

1.Themobilisationofpeople scontributionsforconstructionofworksorsetting up of funds in localities must be commented by people and consideredanddecidedbythePeople sCouncilsofthesamelevel.

2.The mobilisation and use of people s contributions specified in Clause1ofthisArticlemustbemadepublicforsupervisionbypeopleandbe subject to inspection, examinationand supervision underthe provisions of law.

3. The publicity contents shall covermobilisation purposes, mobilisationlevels,theuseofcontributions,resultsofsuchuseandthereport onsettlementthereof.

4.Infrastructure works in communes, wards ordistrict townships, which are financed by people s contributions,must be publicised with the followingcontents:

a)ThepublicitycontentsspecifiedinClause 3ofthis Article;

b)Cost estimate for every work item under the approved investment plans;

c)Investment capitalsourcesfor each workitem;

d)Resultsofmobilisationfromeachspecificsubject,themobilisation duration;

e)Results of selection of contractors, which have been approved by competent authorities;

f)Construction progress and resultsof pre-acceptancetests of work volume, work quality and worksettlement.

5.The mobilisation and use of people s contributions for charity and humanitarianpurposesshallcomplywiththeprovisionsofClause2and3ofthis Article.

Article17.-Publicityandtransparencyofthemanagementanduseof financialsupports,aidsThemanagement,allocationanduseofofficialdevelopmentassistance(ODA)capitalsourcesshallcomplywiththeprovisionsofArticle15ofthis Law. Non-governmentalaidsmustbemade public to beneficiaries.

Article18.-Publicity and transparency in management of state enterprises

Stateenterprises shallhavetheresponsibility to publicise the State s capital and propertiesinvested in the enterprises, preferential loan capital, financialstatementsandauditingresults,theappropriation,settingupanduse of theirfunds, the labor recruitment, theappointment of leading and managerial officialsofenterprisesandothercontentsasprovidedforbylaw.

Article19.-Publicity and transparency in equitisation of state enterprises

1.Theequitisationofstateenterprisesmustbepublicandtransparent; mustnot be conducted in aself-contained manner within the enterprises. Equitisedenterprisesshallhavetopublicisetheiractualfinancialstatusupon their valuation.

2.Competent state agencies shall have to publicise thevaluesof equitisedenterprisesandtheadjustment(ifany)ofenterprisevalue.

3.The first-time sale of equities of equitised enterprises mustbe conductedbyauction.

Article20.-Auditof the use ofstatebudgetandproperties

1.Agencies,organisationsandunitsshallhavetoaudit,andbesubject totheauditof,theuseofstatebudgetandpropertiesundertheprovisionsof lawonaudit.

2.AuditingreportsmustbemadepublicaccordingtoArticle12ofthis Law.

Article21.-Publicityand transparencyinmanagementanduseofland

1.The elaboration of land use plannings and plans must ensure democracyandpublicity.

2.In the processof elaborating and adjusting detailed land use plannings and/or plans, the elaborating agencies or organisationsmust publiclyannounce such to people of the localities where the plannings and adjustmentsaremade.

3.Detailed land use plannings andplans,theground clearance, the compensationlevels,afterbeingdecided,approvedoradjustedbycompetent statebodies,mustbemade public.

4.The competence, orderand proceduresfor grant of land use right certificatesandthegrantoflanduserightcertificates,detailedplanningson andallotmentofresidentiallandlotsandthesubjectsentitledtobeassigned residentiallandforhouseconstructionmustbepublicised.

Article22.-Publicity and transparency in management and use of dwelling houses

1.Thecompetence,orderandproceduresforgranting,andthegrantof, permitsforhouseconstructionaswellashouseownershipcertificatesmustbe madepublic.

2.Thesaleofstate-ownedhouses,subjectsentitledtobuystate-owned housesand money amountspayable upon purchase of state-ownedhouses mustbemadepublic.

3.Thesaleofhousestoresettledpeople,low-incomeearnersandother prioritysubjectsmustbemadepublic.

Article23.-Publicityand transparencyin the educational domain

1.The enrollment, exams,tests, award of diplomas and certificates mustbemadepublic.

2.Educational administration agencies, educational establishments usingstatebudgetandpropertiesmustpublicisethemanagementanduseofstate budget and properties, thecollection, management and use of school tuitions, enrollment fees, proceeds from consultancy activities, technology transfer, financial supports for and investment in education and otherrevenuesundertheprovisionsoflaw.

Article24.-Publicityand transparency in the healthdomain

1.Thecompetence,orderandproceduresforthegrantandrecoveryof privatemedical orpharmaceutical practice certificates, certificates of full satisfaction of practice conditions tomedical or phamarceutical establishmentsmustbemadepublic.

2.Health managementagencies, medical examination and treatment establishments which use state budget and propertiesmust publicise the collection,management,useofstatebudgetandproperties,medicineprices, the collection, management anduseof assorted chargesrelatedto medical examination and treatmentand otherrevenuesasprovidedbylaw.

Article 25.- Publicity and transparencyinthe scientific and technologicaldomain

1.The consideration, selection, direct assignment, financialsupports for implementationof scientific-technologicaltasks and the assessment and pre-acceptancetestsofresultsofperformanceofscientific-technologicaltasksmustbeconducted inapublicmanner.

2. Science-technology management agencies and scientific- technologicalresearchunitsmustpublicisethemanagementanduseofstate budgetandproperties,financialsupports, aids, investmentsand proceedsfrom scientificandtechnologicalactivities.

Article26.-Publicityand transparency inthe physical training and sports domain

Physicaltrainingandsportadministrationagencies,VietnamOlympic Committee,sportsfederations,physicaltrainingandsportestablismentsshall haveto publicise the managementand use of state budget and properties, proceeds from physical training and sport activitiesas well as services, financial supports, aids, contributions of domestic andforeignorganisationsas well as individuals tophysicaltrainingandsportactivities.

Article27.-Publicity and transparency in activities of inspection, settlementofcomplaints aswellas denunciations andstateaudit

1.Activitiesof inspection,settlement of complaints as well as denunciationsandstateauditmustbecarriedoutinapublicmannerunderthe provisions of law.

2.Thefollowingdocumentsanddecisionsmustbepublicised,except otherwiseprovidedforbylaw:

a)Inspectionconclusions;

b)Complaintsettlementdecisions,denunciationsettlementdecisions;

c)Auditingreports.

Article28.-Publicityandtransparencyinactivitiesofhandlingaffairs ofagencies,organisations,unitsorindividuals

1. Agencies, organisations and individuals having managing competenceinthefieldsofhousing,land,construction,businessregistration,projectconsideration and approval, state budget allocation, credit, banking, export, import,exit, entry, household registration administration, taxation, customs,insuranceandotheragencies,organisationsandindividualsdirectly involvedin handling affairs ofagencies, organisations, units or individuals mustpubliciseadministrativeproceduresandsettleaffairsontime,according tolawandlawfulrequests ofagencies,organisations,unitsorindividuals.

2.Agencies,organisations,unitsandindividualsshallhavetherightto requestcompetentagencies,organisationsorindividualstosettletheiraffairs andclearly explain relevant contents. Upon receiving requests of agencies, organisations, units or individuals, competent agencies, organisations or individuals mustgivetimelyandpublicexplanations.

3.Where competent agencies, organisations or individuals give unsatisfactory explanations or deliberately cause difficulties or troubles, the concerned agencies, organisations, units or individuals may lodge their petitionstotheformer simmediatesuperioragenciesororganisations.

Article29.-Publicityand transparencyinthejusticedomain

Thereception,investigation,prosecutionandadjudicationofcasesand thejudgementexecutionmustbemadepublicaccordingtotheprovisionsof procedurallawsandrelevantlaw work

Article30.-Publicityandtransparencyinorganisationalandpersonnel

1.Therecruitmentofpublicservantsandotherlaborersintoagencies, organisationsandunitsmustbemadepublicintermsofrecruitmentquantity, criteria,formsandresults.

2.The planning on, training, appointment, rank promotion, rotation, transfer,commendation,sackingof,relieffrompositionoroffice,dismissal,discipline, retirement of public servants and other laborersmust be made public within the agencies, organisationsorunitswheresuchpersons work.

Article31.-Rightsofagencies,organisationstorequestthesupplyof information

1.Stateagencies,politicalorganisations,socio-political organisations, press agencies shall, within the ambit of their tasks and powers, have the rights to request responsible agencies, organisations and units to supply information on theirrespective activitiesaccordingtotheprovisionsoflaw.

2.Within ten days as from the date ofreceiving therequests, the requestedagencies,organisationsorunitsmustsupplyinformation,exceptfor information contents alreadypublicised in the mass media, publicationsor posted up publicly; in cases where they do notsupply or can notsupply informationyet,theymustgivewrittenrepliestotherequestingagenciesor organisations, clearlystating the reasons therefor.

Article32.-Individuals rightsto request thesupply information

1.Publicservants and otherlaborersshall have the rightsto request heads of the agencies, organisations or units where they workto supply informationonactivitiesofsuch agencies, organisations orunits.

2.Citizens shall have the rights to request presidents of the People s Committees of communes, wards or district townships where they reside to supplyinformationactivitiesof suchPeople s Committees.

3.Within ten days as from the date ofreceiving therequests, therequestedpersonsshallhave to supplyinformation, exceptfor information contents already publicised on the massmedia, in publications or publicly postedup;incaseswheretheydonotsupplyorcannotsupplyinformation yet, theymust give written replies to the requesting persons, clearlystating the reasons therefor.

Article33.-Publicisation of annual reports on corruption prevention andcombat

1.Annually, the Government shall have to report tothe National Assembly on corruption prevention and combat nationwide; People s Committeesshallhave to report to People s Councils of the same level on corruption prevention and combatintheir respective localities.

2.Reportson corruption preventionandcombatmustbepublicised.

Section2.FORMATIONANDREALISATIONOFREGIMES,NORMS, CRITERIA

Article34.-Formation, promulgationand realisation of regimes, norms,criteria.

1.Stateagenciesshall,withintheambitoftheirtasksandpowers,have theresponsibilities:

a)Toformulate,promulgateandpubliciseregimes, norms,criteria;

b)Topubliciseregulationsonregimes,norms,criteriaofinterestsfor everytitleholderin theirrespective agencies;

c)Tostrictlyobserveregulationsonregimes,norms,criteria.

2.Political organisations,socio-political organisations, non-business units and other agencies, organisations or units using thestate budget shall base onthe provisions of Clause 1 of this Article to guide the application thereof or coordinate with competent state agencies in formulating, promulgatingand publicising regimes, norms and criteria to be applied in theirrespective agencies, organisationsorunits.

3.Agencies, organisations and units arestrictly forbidden to illegally promulgateregimes,normsand/orcriteria.

Article35.-Inspection and handling of violations of regulations onregimes,normsandcriteria

1.Agencies, organisations and units must regularly inspect the observanceofregulationsonregimes,normsandcriteriaandpromptlyhandle acts of violatingsuchregulations.

2.Personswhoviolateregulationsonregimes,norms,criteriamustbe

handledaccordingtotheprovisionsoflaw.

3.Persons who permit the use in excess of the set regimes,norms and/or criteria must compensate for the excessive use value they have permitted;personsusinginexcessofsetregimes,normsand/orcriteriashall bear joint liability to compensate for the excessive use value.

4.Personswhopermittheapplicationofregimes,norms,professional

criterialowerthantheprescribedlevelsshallhavetopaycompensationsfor thelowerusevaluetheyhavepermitted;personswhohavebenefitedfromthe applicationof lower regimes, norms and/or professional criteria shall bear jointliabilitytocompensateforthevaluetheyhavebenefited.

Section3.CODE OFCONDUCTS,RULESOFPROFESSIONALETHICS, CHANGESOFWORKINGPOSITIONSOFPUBLIC SRVANTS.

Article36.-Codeofconductsforpublicservants

1.Code of conducts mean standard behaviors of public servantsin performing their tasks and official duties and in socialrelations, covering things whichmust be done ormust not be done, suitable to the work peculiarityofeachgroupofpublicservantsandeachfieldofpublicactivities, aimingtoensuretherighteousnessandintegrityaswellasresponsibilitiesof public servants.

2.Codeofconductsofpublicservantsshallbemadepublicforpeople tosupervisethe observance thereof.

Article37.-Thingsmustnot bedone by public servants

1.Publicservantsmustnotdothefollowingthings:

a)Beingbumblelike,authoritarian,troublesomeinhandlingaffairsfor agencies,organisations,units and/or individuals;

b)Settingup,participatinginthesettingupof,orparticipatinginthe managementandadministration of, privateenterprises, limited liability companies, joint-stock companies, partnership companies, cooperatives, private hospitals, private schooland/or private scientific research establishments, exceptotherwiseprovidedforbylaw;

c)Acting asconsultantsfor other domesticor foreign enterprises, organisationsorindividualsonaffairsrelatedtostatesecrets,worksecrets,or affairs which fall under their respective settling jurisdiction or they have joined the settlementof:

d)Dealingindomainswhichtheypreviouslyhadtheresponsibilityto managewithinagivenperiodoftimeaftertheyresignedfromtheirpositions

accordingtotheGovernment sregulations;

e)Illegally using information, documents of agencies,organisations and/orunits for self-seekinginterests.

2.Heads and deputy-headsof agencies and their spouses are not allowed to contribute capital to enterprisesoperating in branchesor professions suchpersonsdirectlyperformthestatemanagement.

3.Headsanddeputy-headsofagencies,organisationsorunitsmustnot arrangetheirspouses, parents, children or siblings to hold managerial positions in organisational and personnel work, in accounting and financial affairs,to work as cashiers, warehouse keepers in their agencies, organisationsorunitsor to conducttransactions,tradinginsupplies,goods, conclusionof contractsofsuchagencies,organisationsorunits.

4.Heads and deputy-heads of agenciesmust not let their spouses, parents,childrendobusinesswithinthe scope they directly manage.

5.Public servants being members of the ManagingBoards, general directors, deputy-general directors, directors, deputy-directors, chief accountants or other managerial officials in state enterprises shall not be allowed to conclude contracts with enterprises under the ownership of their respective spouses, parents, children orsiblings; to permit enterprises under the ownership of their respective spouses, parents, children or siblings to participateinbiddingpackagesoftheirenterprises;toarrangetheirrespective spouses, parents, children or siblings to hold managerial positions in organisational and personnel, accounting and financial sections, to work as cashiers, warehouse keepers in their enterprises or conduct transactions, purchaseand sale of supplies, goods, toconcludecontractsforenterprises.

6.TheprovisionsofClauses1,2,3and4ofthisArticleshallalsoapply tothefollowingsubjects:

a)Officers, professional army men,defense workers in agenciesor units of thePeople sArmy;

b)Officers,non-commissionedofficers,professional-technicalofficers andnon-commissionedofficersinagenciesorunitsofthePeople s Police.

Article38.-Obligations toreport and handle reports onsigns of corruption

1.Upon detection ofsigns of corruption intheir respective agencies, organisationsorunits,publicservantsshallhavetopromptlyreportthemto the heads of their agencies, organisations orunits; where the heads of such agencies,organisationsorunitsareinvolvedinthosesignsofcorruption,they shall report them to their immediatesuperior agencies, organisations or units.

2.Withintendaysafterthereceiptofreportsoncorruptionsigns,thereport-receivingpersonsmusthandlethecasesaccordingtotheircompetence

ortransfer them to competent agencies, organisations or individualsfor considerationsandhandlingandnotificationtothereporters;forcomplicated cases or matters, the above time limitmay be prolonged butmust exceed thirty days; in case of necessity, todecide orpropose competent persons to decide on application of measures to prevent,overcome consequences of corruptactsandprotectthereporters.

Article39.-Responsibilitiesofpersonswhofailtoreportonorfailto handlereportsonsignsofcorruption.

Publicservantswhoareawareofcorruptactsbutdonotreportthereon andpersonswhoreceivereportsonsignsofcorruptionbutfailtohandlethem mustbearresponsibilitythereforaccordingtoprovisionsoflaw.

Article40.-Givingpresentsandreceivinggiftsbypublicservants

1.Agencies, organisations and units must not use state budget and propertiestopresentgifts,exceptotherwiseprovidedforbylaw.

2.Publicservantsmustnotreceivemoney,propertiesorothermaterial interestsof agencies, organisations, units and/or individuals involved in affairs which theyare settle orfallundertheirrespectivemanagement.

3.Itisstrictlyforbiddentotakeadvantageofthegivingandreceiptof giftsto bribe or perform otheractsforself-seekinginterests.

4.The Government shall specify the giving and receipt of gifts andsubmissionofgiftsbypublicservants.

Article41.-Competence to promulgate codes of conducts of public servants

1.Ministers,headsofministerial-levelagencies,headsofGovernment- attachedagencies,thedirectoroftheNationalAssembly sOffice,thedirector oftheStatePresident sOfficeshallpromulgate codesofconductsofpublic servants workinginagencies, branches, domains under their respective management.

2.The president of the Supreme People s Court, the chairman of the Supreme People s Procuracyshall promulgatecodesofconductsofjudges,jurors,courtclerks,procuratorsandotherofficialsandemployeesinthecourt or the procuracy.

3.TheMinisterofHomeAffairsshallpromulgatecodesofconductsof publicservantsworkinginlocaladministrationapparatuses;coordinatewith centralbodies of socio-political organisations in promulgating codes of conductsof publicservants in suchorganisations.

Article42.-Rulesofprofessional ethics

1.Rules of professional ethics mean behavioral standards suitable to thepeculiaritiesofeachprofession,ensuringrighteousness,integrity,honesty and responsibility in professionalpractice.

2.Socio-professional organisations shall coordinate with competent stateagenciesinpromulgatingrulesofprofessionalethicsfortheirmembers accordingtotheprovisions oflaw.

Article43.-Changeofworkingconditions of public servants

1.Agencies,organisationsandunitsshall,accordingtotheirrespective managementcompetence, have to conduct periodical transfer of public servantsholdinganumberofpositionsrelatedtomanagementofstatebudget and properties, directly involvedinthe handling of affairs of agencies, organisations, unitsand/or individuals with a view to actively preventing corruption.

2.Thechangeofworkingpositionsmustbeconductedunderplansand madepublicwithinagencies,organisationsorunits.

3.ThechangeofworkingpositionsspecifiedinClauses1and2ofthis Articleshall only applyto publicservants who do not hold managerial positions.Therotationofpublicservantsholdingmanagerialpositionsshall comply with the regulationsonrotationofofficials.

4.The Government shall issue listsof working positions subject periodicaltransferdefinedinClause1ofthisArticleandsetthedurationof periodicaltransfer.

Section4.TRANSPARENCY OFPROPERTIES,INCOMES

Article44.-Obligationstomakepropertydeclaration

1.Thefollowingpersonsshallhavetomake property declaration:

a)Officials holding therank of deputy-head of section of People s Committeesofruraldistricts,urbandistricts,provincialcapitalsortownsor higherand equivalent rank in agencies, organisations,units;

b)A number of officialsand public employees in communes, wards, district townships; persons managingstate budget and properties or directly involved in handling affairs ofagencies,organisations, units,individuals;

c)CandidatesfortheNationalAssembly,People sCouncils.

TheGovernmentshallspecify persons obliged to make property declaration according to theprovisionsofthisClause.

2.Personswhoareobligedtomakepropertydeclarationsshallhaveto declaretheir properties, all changes in properties under their respective ownershipandpropertiesundertheownershipoftheirrespectivespousesand minorchildren,

3.Personswhoareobligedtomakepropertydeclarationshallhaveto declarethemhonestlyandbearresponsibilityfortheirdeclarations.

Article45.-Propertieswhichmustbe declared

Thetobe-declaredpropertiesshallinclude:

1.Houses,land use rights;

2.Preciousmetals,gemstones,monies,valuablepapersandothertypes ofpropertyeachvalueatofVNDfiftymillionormore;

3.Properties, accountsinforeigncountries;

4.Taxableincomesunderthe provisions of law.

Article46.-Propertydeclaration procedures

1.Property declaration shall be carried out annually at agencies, organisations or units where persons subject todeclaration work and be completedby December 31 atthe latest.

2.Persons obliged to make propertydeclarationmust clearly state changes intheirproperties ascomparedwiththeirpreviousdeclarations.

3.Written property declarationsshall be submitted to competent agencies, organisationsorunitsmanagingtheobligatorypropertydeclarers.

Article47.-Verification of properties

1.Theverificationofpropertiesshallbemadeonlyupondecisionsof competentagencies or organisations managing the obligatory property declarers.

2.Theverificationof propertiesshallbe madeinthefollowingcases:

a)Servicing the election, appointment, dismissal of, relief from duty, removal from office or disciplining of persons whoare obliged to make property declarations, whenitis deemednecessary;

b)At the request of electoral councils or competent agencies, organisations;

c)Propertyofcorruptioncommitted.

Article48.-Property-verifying procedures

1. Before issuing decisions on property verification, competent agenciesor organisationsshall request persons who are obligedtomake property declaration to clearly explain their declarations. The explanation must be carried out within five days asfrom the date of receipt of the explanation request.

2. Competent agencies or organisations shall issue verification decisionswithinfivedaysasfromthedatethegroundsdefinedinClause2, Article47of this Law arise.

3.Concernedagencies,units,organisationsandindividualsshallhave tosupplyinformation,documentsinserviceoftheverificationsattherequest ofcompetent agencies ororganisations.

4.Withintwentydaysaftertheissueofverificationdecisions,agencies, organisationsor units managing persons who are obliged tomake property declarationshallconducttheexaminationsandverificationsandhavetomake conclusions on transparencyinthepropertydeclaration.

5.Theproceduresforverifyingpropertiesofpersonsnamedinthelists ofcandidatesfortheNationalAssembly,People sCouncilsshallcomplywith theprovisions of Clauses 1,2,3 and 4 of this Article. The verification time limitsmustmeettherequirementsontimeforelectionofNationalAssembly deputies,People s Councildeputies.

Article49.-Conclusionsontransparencyinpropertydeclarations

1. Conclusions on transparency in property declarationsmean conclusionsonhonestyinpropertydeclarations.

2.Conclusionsontransparencyinpropertydeclarationsmustbesentto verification-requestingagenciesororganisationsandthepersonshavingtheir propertiesverified.

3.Agencies,organisationsandunitsdefinedinClause4,Article48of thisLawmustbearresponsibilityfortheobjectiveness,accuracyandcontents oftheir conclusions.

Article50.-Publicity of conclusions on transparency in property declarations

1. At the request and by decision of competent agenciesor organisations, writtenconclusions ontransparencyin property declarations shallbepublicisedat the following places:

a)Agencies,organisationsorunitswherethepersonsobligedtomake propertydeclarations work when such persons are appointed, elected orratified;

b) Voters conferences at working places,residence places of candidatesfortheNationalAssemblyorcandidatesforPeople sCouncil;

c)Agencies, organisations or units where the personsproposed for election or ratification by the National Assembly, People s Councils or congressesof politicalorganisations or socio-political organisations.

2.Conclusionsontransparencyinpropertydeclarationsofpersonswho areprosecuted for actsof corruptionmust be made public at agencies, organisations or units wheresuch persons work.

Article51.-Responsibilities of agencies, organisations or units managing personswho are obligedtomakeproperty declarations

Agencies,organisationsand units have the responsibility tomanage andarchivethewrittenpropertydeclarationsofobligatorypropertydeclarers under their respective management; organise the verification under the decisions of competent agencies or organisations; conclude on the transparency in propertydeclarations and publicisesuch conclusions under decisionsof competent agencies or organisationsin the casesspecified in Article50of this Law.

Article52.-Handlingofdishonestpropertydeclarers

1. Dishonest property declarersshall be disciplined under the provisionsoflaw. Decisions to discipline dishonest property declarersmust bemadepublic at agencies,organisationsorunitswheresuchpersonswork.

2.National Assembly candidates,People sCouncil candidates who declaretheirassetdishonestlyshallhavetheirnamesdeletedfromthelistsof candidates; persons who are expected to beappointed or ratified but dishonestlydeclaretheirpropertiesshallnotbeappointedorratifiedforthe projected positions.

Article53.-Incomecontrol

The Government shallsubmit to the National Assemblyforpromulgationlegaldocumentsoncontrol of incomes of persons with positions and/orpowers.

Section5.REGIMEONRESPONSIBILITIESOFHEADSOFAGENCIES,ORGANISATIONS,UNITSWHENLETTINGCORRUPTION OCCURS

Article54.-Responsibilities of heads of agencies, organisations or units when letting actsof corruption occur in their respective agencies, organisations or units

1.Headsofagencies,organisationsorunitsmustbearresponsibilityfor theoccurrenceof corrupt actsin theirrespective agencies,organisations orunits.

Headsof agencies,organisationsor units must bear personal liability fortheoccurrenceofcorruptactsofpersonswhomtheydirectlymanageor assign tasks.

2.Deputy-headsofagencies,organisationsorunitsmustbearpersonal liabilityfortheoccurrenceofcorruptactsintheworkingdomainsandunits undertheirdirectcharge.

Headsof agencies,organisationsor units must bear joint liability for the occurrence of corruptacts in the working domains and units directly managedbytheirdeputies.

3.Heads of units attached to agencies or organisations must bear personalliabilityfortheoccurrenceofcorrupt actsintheir respective units.

4.Thehandlingofheadsorotherresponsible individualsin political organisations,socio-politicalorganisations, socio-professional organisations

orother organisations, which usestatebudget,forlettingactsofcorruption occurshall comply with the provisions of this law andthe charters or regulationsof suchorganisations.

5.Liabilitiesof heads and deputy-heads ofagencies, organisations or units defined in Clauses 1,2 and 3 of this Articleshall be exempt in cases wheretheywereunawareoforhave appliednecessary measurestoprevent andstopcorruptacts.

Article55.-Handlingofheadsofagencies,organisationsorunitswhen lettingactsofcorruptionoccurinagencies,organisationsorunitsundertheir respectivemanagementorcharge

1.Heads of agencies, organisations or units, whenhaving to bear personal responsibilities for the occurrence of corruptacts in agencies, organisationsorunitsundertheirmanagementorcharge,shallbedisciplined or examined for penal liability.

2.Headsofagencies,organisationsorunits,whenhavingtobearjoint responsibilitiesfortheoccurrenceofcorruptactsinagencies,organisationsor unitsundertheirmanagementorcharge,shall bedisciplined.

3.Heads of agencies, organisations or units shall be considered for exemptionorreductionoflegalliabilitiesdefinedinClauses1and2ofthis Articleiftheyhaveappliednecessarymeasurestoprevent,stop,remedyacts ofcorruption;severelyhandleandpromptlyreporttocompetentagenciesor organisation on acts of corruption.

4. Inspection conclusions, auditing conclusions, investigation conclusions on corruption cases or mattersmust clearly state the responsibilitiesofheadsofagencies,organisationsorunitsfortheoccurrence ofcorruptactsatthefollowingextends:

a)Poormanagementcapability;

b)Irresponsibilityinmanagement;

c)Coverage of corruption committers.

TheconclusionsmustbeaddressedtotheCentralSteeringCommittee forCorruptionPreventionandCombatandcompetent agencies, organisations.

Section6.ADMINISTRATIONREFORM,RENEWALOF MANAGEMENTTECHNOLOGIESANDPAYMENTNOTES

Article56.-Administrative reform for corruptionprevention

TheStateshallconductadministrativereformwithaviewtoenhancing theindependenceandaccountabilityofagencies,organisationsorunits;step upthedecentralisationofstatemanagementbetweenthecentralgovernment andlocalities;betweenlocaladministrations;clearlydefinetasksandpowers among state agencies; publicise, simplify and perfect administrative procedures;specify the responsibilityof each title holder in agencies, organisations or units.

Article57.-Intensification of scientific and technological application tomanagement

1.Agencies, organisationsand units shall regularly improve their activities, intensify the scientific and technological application in their activities, create conditions for citizens, agencies, organisations, units to exercisetheirlegitimaterightsandinterests.

2.Agencies, organisations and units shall have the responsibilityto guidetheaffair-handlingorderandproceduressothatagencies,organisations, units and individuals take initiatives in the implementation thereof without having to make direct contactswith officials and public servants.

Article58.-Renewalofpaymentmodes

1.TheState shall apply managerial measures to effect payment via accountsatbanksorstatetreasuries.Agencies,organisationsandunitsshallhavetoobserveregulationson via-account payment.

2.The Government shall applyfinancial, technological measures to proceed to effect via accountsallexpenditures for persons with positionsand/orpowersdefinedatPointsa,bandc,Clause3,Article1ofthisLawand othertransactionsinvolvingtheuseof statebudget.

ChapterIII

DETECTION OF CORRUPTION

Section1. INSPECTION WORK OF AGENCIES, ORGANISATIONS,UNITS

Article59.-Inspectionworkofstatemanagementagencies

1.Headsofstatemanagementagenciesshallhavetheresponsibilitytoregularly organisetheinspection of law observance by agencies, organisations,units and individuals under theirrespectivemanagement in ordertodetectintimeacts ofcorruption.

2.Upondetectionofcorruptacts,headsofstatemanagementagencies mustpromptlyhandlethemaccordingtotheircompetenceornotifythemto competentinspecting or investigating bodies, procuracies.

Article60.-Inspectionworkofagencies,organisations,units

1. Headsof agencies, organisations or units shall have the responsibilitytotakeinitiativeinorganisinginspectionoftheperformanceof tasks, official duties by public servants who regularly and directly handle affairs of agencies, organisations, units or individuals and by other public servantsundertheirrespectivemanagementinordertopromptlydetect,stop andhandleactsof corruption.

2. Headsof agencies, organisations or units shall have the responsibility to regularly urge heads of their attached units to inspect the performance of tasks and official duties by public servants under their management.

3.Upondetectionofcorruptacts,headsofagencies,organisationsor unitsmust promptly handle them according to their competence or notify them to competent inspecting,investigatingbodiesandprocuracies.

Article61.-Inspection forms

1.Regular inspections must be carried out under programs, plans, focusingondomainsandactivitieswherecorrupt actsoftenoccur.

2.Unexpectedinspectionsshallbecarriedoutupondetectionofsigns ofcorruption.

Section2.DETECTIONOFCORRUPTIONTHROUGHACTIVITIESOF INSPECTION,AUDIT,INVESTIGATION,CONTROL,ADJUDICATION AND/ORSUPERVISION

Article62.-Detection of corruption through activities of inspection, audit,investigation, control, adjudication

Inspectorates,state audit,investigating bodies, procuracies and courts shall, through inspecting, auditing, investigating, controlling or adjudicating activities, have the responsibility to take initiative in detecting corrupt acts and handle them accordingto their respective competence or propose the handlingthereof according to the provisions of law and take responsibility beforelawfortheirdecisions.

Article63.-Detectionof corruptionthroughsupervisoryactivities

TheNationalAssembly,NationalAssemblyagencies,delegationsofNational Assemblydeputies,People sCouncils,NationalAssemblydeputies,People s Councildeputiesshall,throughsupervisoryactivities,havetheresponsibility todetectcorruptacts,requestorproposethehandlingthereofaccordingtothe provisionsof law.

Section3.DENUNCIATIONSANDSETTLEMENTOF DENUNCIATIONSABOUTCORRUPT ACTS

Article64.-Denunciationsabout corruptacts and responsibilities of denouncers

1.Citizensshallhavetherighttodenouncecorruptactstocompetent agencies,organisationsorindividuals.

2.Denouncers must make honest denunciations, clearly state thefull names,addresses,supplyinformationanddocumentstheyhaveandcooperate withagencies, organisations orindividuals competenttosettledenunciations.

3.Denouncerswhodeliberatelymakeuntruthfuldenunciationsmustbe strictlyhandled;ifcausingdamagetothedenouncedpersons,theymustpay compensationsthereforaccordingto the provisions of law.

Article65.-Responsibilitytoreceiveand settledenunciations

1.Agencies, organisations, units and individualsshall have the responsibility to create favorable conditionsfor citizens to personally make oral denunciations, send written denunciations, make denunciations via telephone,makedenunciationsviaelectronicinformationnetworksandotherformsundertheprovisionsoflaw.

2.Heads of competent agencies or organisations, whenreceiving denunciationsaboutcorruptacts,mustconsiderandhandlethemaccordingto theircompetence;keepsecretthefullnames,addresses,autographsandother information of denouncers at the latter s request; promptlyapplynecessarymeasures to protect denouncers when there appear signs of intimidation, revenge or retaliation against them or when so requested bydenouncers;notifytheresultsofsettlementof denunciations to denouncers when sorequested.

3.Inspectorates shall have the responsibility to assistheads of state management agencies of thesame level in verifying andconcluding on denunciation contents and propose handlingmeasures; in case of detecting signsofcrime,theyshalltransferthecasestocompetentinvestigatingbodies and procuracies for handling according to legal provisions on criminal procedures.

Investigatingbodiesandprocuracieswhichhavereceiveddenunciationsabout corruptactsmusthandlethemaccordingto competence.

4.The time limit forsettlement of denunciations, the time limit for replyingdenouncersshallcomplywiththeprovisions oflaw.

Article66.-Coordination responsibilities of agencies, organisations, units, individualsAgencies,organisations,unitsandindividualsshall,withintheambitof theirrespectivetasksandpowers,havetocreateconditionsforandcooperate with, agencies,organisations and/or individuals competent to settle denunciationsindetecting,preventing,stoppingandhandlingintimecorrupt acts, limiting damage caused bycorrupt acts.

Article67.-Commendingdenouncers

Personswho make honest denunciations, actively collaborate with competent agencies, organisations or individuals in detecting, preventing, stopping and handling corruptactsshall be commended materially and/or spiritually according to the provisions oflaw.

ChapterIV

HANDLING OF CORRUPT ACTS AND OTHER ACTS OF LAW VIOLATION

Section1.DISCIPLINARYHANDLING,CRIMINALHANDLING

Article68.-Subjectsof disciplinary handling, criminal handling

1.Personswhocommitcorrupt acts defined in Article 3of this Law.

2.Personswhofailtoreporton,ordenouncecorruptactswhichthey areawareof.

3.Persons who fail to handle reports on, or denunciations about, corruptacts.

4.Persons who commit acts of intimidating, taking revenge on, retaliating those who detect, report on, denounce, supplyinformation on, corruptacts.

5.Headsofagencies,organisationsorunitswholetcorruptactsoccur intheirrespectiveagencies,organisationsorunits.

6.Persons who commit actsofviolating provisions of this Law or provisions of other relevant law.

Article69.-Handlingofcorruptioncommitters

Personswhocommitactsofcorruptionshall,dependingonthenatureandseriousness of their violations, be disciplined or examined for penal liability; in cases where they aresentenced for corrupt acts and the judgementsordecisionshavealreadytakenlegaleffect,theymustbesacked; for National Assembly deputies orPeople s Council deputies, they shall naturallylose therights of NationalAssemblyorPeople sCouncildeputies.

Section2.HANDLINGOFCORRUPTION-RELATEDPROPERTIES

Article70.-Principlesonhandlingofcorruption-relatedproperties

1.Competentagenciesororganisationsmustapplynecessarymeasures torecover,confiscatecorruption-relatedproperties.

2.Corruption-relatedpropertiesmustbereturnedtotheirlawfulowners ormanagersorconfiscatedforthestatefunds.

3.Thebribegiverswhotakeinitiativeinreportingthereonbeforetheir bribingactsaredetectedshallhavetheirbribed properties returned.

4.The confiscation of corruption-related properties, therecovery of corruption-related properties shall be carried outby decisions of competent state agencies according to the provisions of law.

Article 71.- Recovery ofcorruption-related properties involving foreignelements

OnthebasisoftreatiestowhichtheSocialistRepublicofVietnamisa partyand under the basic principles of Vietnamese laws, the Vietnamese government shall cooperate withforeign governments in recovering Vietnamese or foreign corruption-related propertiesand returning such propertiestotheirlawfulowners.

ChapterV

ORGANISATION, RESPONSIBILITIES AND COORDINATION ACTIVITIES OF INSPECTORATES, THE STATE AUDIT, INVESTGATING BODIES, PROCURACIES, COURTS AND CONCERNED AGENCIES, ORGANISATIONS AND UNITS IN CORRUPTION PREVENTION AND COMBAT

Section1.ORGANISATION,DIRECTION,COORDINATIONANDRESPONSIBILITIESINTHEWORKOFCORRUPTIONPREVENTION ANDCOMBAT

Article72.-Responsibilities of heads of agencies, organisations or unitsincorruptionpreventionandcombat

1.Headsofagencies,organisationsorunitshavetheresponsibilityto applythe provisions of this Law and other relevant legal provisions to organising corruption prevention and combatin their respective agencies, organisations or units.

2.Headsofagencies,organisationsorunitsshallbeanswerabletotheir immediatesuperioragencies,organisationsorunitsforcorruptionprevention andcombatintheirrespectiveagencies,organisations orunits.

Article73.-SteeringCommitteefor CorruptionPreventionand Combat

1.The Central Steering Committee forCorruption Prevention and CombatshallbeheadedbythePrimeMinisterandhavetheresponsibilityto direct, coordinate, inspect and urge activities of corruption prevention and combatnationwide. The Central Steering Committee for Corruption PreventionandCombatshallbeassistedbystandingsectionsoperatingona full-timebasis.

2. Theorganisation, tasks, powers and operation regulationsoftheCentral Steering Committee forCorruptionPreventionandCombatshallbe definedbytheNationalAssemblyStandingCommitteeattheproposalofthe PrimeMinister.

Article74.-Supervision of the work of corruption prevention andcombat

1.TheNationalAssembly,theNationalAssemblyStandingCommittee shallsupervisetheworkofcorruptionpreventionandcombatnationwide.

2.TheNationalityCouncilandCommitteesoftheNationalAssembly shall,within the ambit oftheir respective tasks and powers, supervise corruptionpreventionandcombatworkinthedomainsundertheirrespective charge.

TheLawCommitteeoftheNationalAssemblyshall,withintheambit ofitstasksandpowers,supervisethedetectionandhandlingofcorruptacts.

3.People s Councils at all levels shall, within the ambit of their respective tasks and powers, have the responsibility to supervise corruption prevention and combat workintheir respective localities.

4.TheNationalAssemblydeputies delegations,theNationalAssembly deputies,the People s Council deputiesshall, within the ambit of theirrespectivetasksandpowers,supervisetheobservanceoflegalprovisionson corruption prevention and combat.

Article75.-Specialisedanti-corruptionunits

1.The Government Inspectorate, the Ministry of Public Security and theSupremePeople sProcuracyshalleachhaveaspecialisedanti-corruptionunit.

2.The organisation, tasksand powers of specialised anti-corruption units defined in Clause 1 of this Article shall be stipulated by the National AssemblyStandingCommitteeandtheGovernment.

Article76.-Responsibilitiesofthe GovernmentInspectorate

Withintheambitofitstasksandpowers,theGovernmentInspectorate shallhavethefollowingresponsibilities:

1.To organise, direct and guide the inspection of the observance of legalprovisionsoncorruptionpreventionandcombat;incaseofdetectionof corruptacts,torequestcompetentagencies or organisations tohandle them;

2.To build-up systems of general data oncorruption prevention andcombat.

Article77.-Responsibilitiesofthe Stateaudit

TheStateauditshall,withintheambitofitstasksandpowers,havethe responsibilitytoorganisetheauditinordertopreventanddetectcorruption; incase of detecting corrupt acts, it shall request competent agencies or organisationstohandlethem.

Article78.-Responsibilitiesof the Ministry of Public Security, the MinistryofDefense

TheMinistry of Public Security and the Ministry of Defense shall, withintheambitoftheirrespective tasksandpowers,havetheresponsibility toorganise anddirecttheinvestigation of corruption-related crimes.

Article79.-Responsibilitiesof the Supreme People s Procuracy, the SupremePeople s Court

1.The Supreme People s Procuracyshall have the responsibility to organise and directthe prosecution of corruption-related crimes; control activities of investigation,adjudication and judgment execution against corruption-relatedcrimes.

2.The Supreme People s Courtshall have the responsibility to adjudicate,and directthe adjudicationof,corruption-relatedcrimes.

Article80.-Coordination of activities among inspectorates, the state audit, investigatingbodies, procuracies,courts

Inspectorates,the state audit, investigating bodies, procuracies and courts shall have the responsibility to coordinate with one another in corruption prevention and combat accordingtothefollowingcontents:

1.Regularlyexchanginginformation,documentsandexperiencesinthe workof corruption prevention andcombat;

2.Transferring corruption case files to competent statebodies for handling;

3.Summingup,assessingandforecastingthecorruptionsituationand proposingpoliciesandmeasurestopreventandcombatcorruption.

Article81.-Working coordination between inspectorates, the state auditandinvestigatingbodies

1.Whereinspectoratesorthestateaudittransfercorruptioncasefilesto investigatingbodies, the lattermustreceive them and settle the cases according to theprovisionsofcriminalprocedurelaw.

2.Ifdisagreeing with the settlement by investigating bodies, the inspectoratesorthestateauditshallhavetherighttonotifytheprocuraciesof the same level andthe superiorinvestigating bodies thereof.

Article82.-Working coordination between inspectorates, the state auditandprocuracies

1.Where corruption case files are transferred to investigating bodies, inspectorates and the state audit shall have to notify the procuracies of the same levelforcontrol thereof.

2.Whereinspectoratesorthestateaudittransfercorruptioncasefilesto procuracies,the lattermust consider and handle them, then notify the handlingresultsinwritingto thefile-transferringagencies.

Section2. INSPECTION OF ANTI-CORRUPTIONACTIVITIESIN INSPECTORATES,THE STATEAUDIT,INVESTIGATINGBODIES, PROCURACIES,COURTS

Article83.-Inspection of anti-corruption activities of officials and public employees of inspectorates, thestate audit, investigating bodies, procuracies,courts

1.The inspectorates, the state audit, investigating bodies, procuracies andcourtsmusttakeinspectingmeasurestopreventandstopactsofabusing powers,misusingauthorityand/orharassmentoftheirrespectiveofficialsand employeesinanti-corruption activities.

2.Heads of inspectorates, the state audit, investigatingbodies, procuracies, courtsmust enhance the management of their officials and employees;directtheinternalinspectionandexaminationinordertoprevent acts of law violation in anti-corruptionactivities.

3.Officialsand public employees of inspectorates, the state audit, investigatingbodies,procuracies,courtwhocommitactsoflawviolationin anti-corruption activitiesshall, depending onthe nature and seriousness of their violations, be disciplinedforpenalliability.

Article84.-Settlementofdenunciationsagainstofficialsand/orpublic employeesofinspectorates,thestateaudit,investigatingbodies,procuracies,courts.

Incase of denunciation of acts of law violation in anti-corruption activities, committed by inspectors, auditors, investigators, procurators, judges,jurors, court clerk orother officials and public employeesof inspectorates, the state audit, investigating bodies, procuracies,courts, the heads of such agencies must settle them accordingto their competence or propose competent agencies, organisationsorindividualstosettlethem.

Thedenunciation-settlingresultsmustbemadepublic.

ChapterVI

ROLES AND RESPONSIBILITIES OF THE SOCIETY IN CORRUPTION PREVENTION AND COMBAT

Article85.-RoleandresponsibilitiesofVietnamFatherlandFrontand itsmemberorganisations

1.Vietnam Fatherland Front and its member organisations shall have thefollowingresponsibilities:

a)To coordinate with competent state agencies in propagating and educating people and their members to observethe provisions of law on corruptionpreventionandcombat;toproposemeasurestodetectandprevent corruption;

b)To mobilise people to actively participate in detecting and denouncingcorruptacts;

c)To supplyinformation and coordinate with competent agencies, organisationsandindividualsindetecting,verifyingandhandlingcorruption cases;

d)Tosupervisetheobservanceofthelawoncorruptionpreventionandcombat.

2.Vietnam Fatherland Front and its member organisations shall have therighttorequestcompetentagencies,organisationsandindividuals toapply measuresto prevent corruption, verifycorruption cases, handle corruption committers;competentagencies,organisationsandindividualsmustconsider and reply within fifteen days after the receiptofrequests; in caseof complicatedcasesormatters,theabovetimelimitcanbeprolongedbutshall not exceedthirty days.

Article86.-Roleand responsibilities ofthe press

1.The State shall encourage press agencies,reporters to report on corruption cases and matters and activities ofcorruption prevention andcombat.

2.Pressagenciesshallhavetheresponsibilitytocommendgoodspirit andpositive deeds incorruption preventionand combat; condemn and struggle against persons who commit corruption; participate in propagating anddisseminatingthelawoncorruptionpreventionandcombat.

3.Pressagenciesandreportersshallhavetherighttorequestcompetent agencies,organisationsorindividuals tosupplyinformationand/ordocumentsrelated to corrupt acts.

The requested agencies, organisations and/or individualsshall have to supply information and/or documents according to theprovisionsoflaw;incaseofnon-supply,theymustgivewrittenreplies, clearlystatingthereasonstherefor.

4.Press agencies and reportersmust report honestly and objectively.Editors-in-chief,reporters areresponsiblefor the reports and observe the presslawand rules of professional ethics.

Article87.-Rolesand responsibilities of enterprises,professional associations

1.Enterprisesshall have the responsibilities to notify corrupt acts to and coordinate with competent agencies, organisations or individuals in verifyingandconcludingoncorruptacts.

2.Enterprises associations, professional associations shall have the responsibilitiestoorganise,mobiliseandencouragetheirmemberstobuildup ahealthy, non-corruptbusinessculture.

3.Enterprises associations, professional associations and members thereof shall have the responsibilities to propose the State to perfect managementmechanisms and policies in order to prevent and combat corruption.

4. The State shall encourage enterprises toengage inhealthy competition, work out mechanisms for internal control in order to preclude acts of corruption,bribe giving.

5.Competent agencies, organisations and individuals shall have the responsibility to coordinate with the VietnamChamber of Commerce and Industry, enterprises associations, professional associations and other organisationsinorganisingforumsforexchangeandsupplyofinformationin serviceofcorruptionpreventionandcombat.

Article88.-Responsibilities ofcitizens,people sinspectionboards

1.Citizensshall participate in corruption prevention and combat personally,through people s inspectionboardsortheirorganisations.

2.People sinspectionboardsincommunes,wards,districttownships, stateagencies,non-businessunits,stateenterprisesshall,withintheambitof theirrespectivetasks andpowers, supervisethe observanceof legalprovisions on corruptionpreventionandcombat.

ChapterVII.

INTERNATIONAL COOPERATION ON CORRUPTION PREVENTION AND COMBAT

Article89.-Generalprinciples for international cooperation

TheStatecommitstoimplementtreatiesoncorruptionpreventionand combattowhichtheSocialistRepublicofVietnamisaparty;cooperateswith other countries, international organisations,foreign organisations and individualsincorruptionpreventionandcombatactivitiesontheprinciplesof respectforeachother sindependence,sovereigntyandterritorialintegrityand ofmutualbenefits.

Article90.-Responsibilitytoimplement international cooperation

1.TheGovernmentInspectorateshallcoordinatewiththeMinistryof ForeignAffairs, the Ministry of Public Security and concerned agencies in implementing             international cooperation on research, training, policy formulation, information exchange,financial support, technical assistance, experience exchange incorruption prevention and combat.

2.The Supreme People s Procuracy, the Ministry ofJustice, the Ministry of Public Security shall, within the ambitof theirrespectivetasks and powers, perform the tasks of international cooperation on judicial assistancein corruption prevention and combat.

ChapterVIII

IMPLEMENTATION PROVISIONS

Article91.-Implementationeffect

1.This Lawshall takeeffectasfromJune1,2006.

2.TheFebruary26,1998Anti-CorruptionOrdinanceandtheApril28, 2000Ordinance Amending and Supplementing aNumber ofArticles ofthe Anti-Corruptionshallceasetobeeffectiveasfromtheeffectivedateofthis law.

Article92.-Implementationguidance

TheGovernmentshalldetailandguidetheimplementationofthisLaw.

ThisLawwaspassedonNovember29,2005,bytheXIthNationalAssemblyoftheSocialistRepublicofVietnamatits8thsession.
