THE PRESIDENT OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to Articles 88 and 91 of the Constitution of the Socialist Republic of Vietnam;

Pursuant to Article 80 of the Law on Promulgation of Legal Documents,

PROMULGATES:

The Law Amending and Supplementing a Number of Articles of the Law on Management and Use of Weapons, Explosive Materials and Support Tools,

which was passed on November 25, 2019, by the XIV^thNational Assembly of the Socialist Republic of Vietnam at its 8^thsession.

LAW

Amending and Supplementing a Number of Articles of the
Law on Management and Use of Weapons, Explosive Materials and Support Tools^[1]

Pursuant to the Constitution of the Socialist Republic of Vietnam;

The National Assembly promulgates the Law Amending and Supplementing a Number of Articles of Law No. 14/2017/QH14 on Management and Use of Weapons, Explosive Materials and Support Tools.

Article 1.To amend and supplement a number of articles of the Law on Management and Use of Weapons, Explosive Materials and Support Tools

1. To amend and supplement a number of clauses of Article 3 as follows:

a/ To amend and supplement Clause 2 as follows:

“2. Military-use weapons include:

a/ Weapons manufactured and produced up to technical standards and according to designs of lawful manufacturers, which are equipped for the people’s armed forces and other forces in accordance with this Law for the performance of their official duties, including:

Handguns: pistols, rifles, submachine guns, machine guns, anti-tank guns and grenade launchers;

Light weapons: heavy machine guns, mortars, recoilless rifles, anti-aircraft guns and man-portable anti-tank missiles;

Heavy weapons: jet fighters, armed helicopters, tanks, armored fighting vehicles, warships, submarines, landing force artillery, anti-aircraft artillery and missiles;

Bombs, mines, grenades, torpedoes, naval mines; ammunition used for the weapons specified at this Point;

b/ Weapons manufactured or produced manually or industrially, not up to technical standards and not according to designs of lawful manufacturers and are capable of causing casualties, harming human life and health and destroying physical structures like the weapons specified at Point a of this Clause, which are not equipped for the people’s armed forces and other forces specified in Article 18 of this Law for the performance of their official duties.”;

b/ To amend and supplement Clause 6 as follows:

“6.Weapons with functions and utilities similar to those of hunting rifles, rudimentary weapons or sports weaponsmeans weapons manufactured or produced manually or industrially not up to technical standards and not according to designs of lawful manufacturers and are capable of causing casualties, harming human life and health and destroying physical structures like hunting rifles, rudimentary weapons or sports weapons.”.

2. To amend and supplement Clause 2 of Article 73 as follows:

“2. The Ministry of National Defense shall perform the state management of weapons, explosive materials and precursors and support tools in accordance with this Law and relevant laws. The Minister of National Defense shall promulgate the list of military-use weapons specified at Point a, Clause 2, Article 3 of this Law.”.

Article 2.Effect

This Law takes effect on January 10, 2020.

This Law was passed on November 25, 2019, by the XIV^thNational Assembly of the Socialist Republic of Vietnam at its 8^thsession.-
